DECREE NO 6,934, DE August 11, 2009.

Approves the Regimental Framework and the Framework Demonstrative of the Cargos in Commission, the Gratified Functions and the Commissioned Functions of the National Social Insurance Institute-INSS, has on the redeployment of positions in commission and fulfilling functions, and amends Annex II to the Decree no 6,417, March 31, 2008, which approves the Regimental Structure and Demonstrative Framework of the Cargos in Commission and the Gratified Functions of the Ministry of Social Welfare, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, point?a?, of the Constitution, and in view of the provisions of art. 50 of Law no 10,683, of May 28, 2003,

DECRETA:

Art. 1the Ficam approved the Regimental Structure and the Demonstrative Framework of the Posts in Commission, Gratified Functions and Commissioned Functions of the National Institute of Social Insurance-INSS in the form of Annexes I and II.

Art. 2o Ficam remanded, in the form of Annex III, the following posts in commission of the Grupo-Direction and Superior Advising-DAS and Gratified Functions-FG:

I-from the Ministry of Social Welfare to the Office of Management, Ministry of Planning, Budget and Management: four DAS 101.3, three DAS 101.2, a DAS 102.5, a DAS 102.4, three FG-1, two FG-2 and one FG-3 ;

II-from the Office of Management, the Ministry of Planning, Budget and Management, to the INSS: a DAS 101.5, a DAS 101.4, five DAS 101.3, two DAS 101.2, a DAS 101.1, a DAS 102.2, three FG-1 and two FG-2 ; and

III-from the INSS to the Office of Management, Ministry of Planning, Budget and Management: a DAS 102.3, a DAS 102.1 and thirteen FG-3.

Art. 3o As a result of the provisions of the art. 2o, Annex II to Decree no 6,417 of March 31, 2008, passes effect in the form of Annex IV to this Decree.

Art. 4o The apostillations arising from the approval of the Regimental Structure that treats the art. 1o should occur within twenty days, counted from the date of publication of this Decree.

Single Paragraph. After the apostillations provided for in the caput, the President of the INSS shall publish in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, nominal relationship of the holders of the posts in committee of the Group-Direction and Superiors-DAS and Commissioned Functions of the INSS-FCINSS, referred to in Annex II, indicating, inclusive, the number of posts and vacant functions, their denomination and their level.

Art. 5the The internal regiment of the INSS will be approved by the Minister of State of the Social Security and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 6o This Decree goes into effect on the date of its publication, producing effects as of August 20, 2009.

Art. 7o It is revoked, as of August 20, 2009, the Decree no 5,870, of August 8, 2006.

ANNEX I

REGIMENTAL STRUCTURE OF THE NATIONAL INSTITUTE OF SOCIAL INSURANCE

CHAPTER I

OF NATURE, HEADQUARTERS AND PURPOSE

Art. 1o The National Institute of Social Insurance-INSS, federal municipality with headquarters in Brasilia-Federal District, linked to the Ministry of Social Security, instituted on the basis of the provisions of the art. 17 of Law no 8,029 of April 12, 1990, is intended to promote recognition, Social Security, entitlement to receive benefits by it administered, ensuring agility, amenity to its users and extension of social control.

CHAPTER II

DA ORGANIZATIONAL STRUCTURE

Art. 2o The INSS has the following organizational structure:

I-the body of direct and immediate assistance to the President: Cabinet ;

II-sectional bodies:

a) Specialized Federal Prosecutor's Office ;

b) Auditorial-General;

c) Corregedorial-General;

d) Directorate of Budget, Finance and Logistics ; and

e) Human Resources Directorate ;

III-singular specific organs:

a) Directors of Benefits ;

b) Director of Worker Health ; and

c) Directorate of Attenment ;

IV-units and decentralized bodies:

a) Regional Superintendencies ;

b) Generation-Executivas;

c) Social Security Agencies ;

d) Solicitor-Regional ;

e) Prosecutions-Sectional ;

f) Auditorias-Regional ; and

g) Corregedorias-Regional.

CHAPTER III

DA DIRECTION AND APPOINTMENT

Art. 3o The INSS is driven by a President and five Directors, appointed in the form of the law.

Art. 4o The nominations for the posts in commission, for the commissioned functions and for the gratified functions integral to the INSS regimental structure will be effected in accordance with the current legislation.

§ 1o The Generates-Executives will be chosen, exclusively, in quintipla list composed from internal selection process, which prioritize professional merit, in the form and conditions defined in ministerial portrition, promoted upon spontaneous adherence of the occupational servers of effective positions, belonging to the framework of personal of the INSS.

§ 2o The positions in commission and the gratified functions of Superintendencies Regional, Managers-Executives and Social Security Agencies, fixed and mobile, will be provided, exclusively, by occupant servers of effective positions belonging to the INSS personnel framework or the Ministry of Social Security.

§ 3o The posts in commission, the commissioned functions and the gratified functions, of legal nature, within the framework of the Specialized Federal Prosecutor's Office will be provided by members of the Federal Attorney General and, exceptionally, of the Advocacy-General of the Union, in the form of the caput, heard the Chief Prosecutor.

§ 4o The other posts in commission, the commissioned functions and the functions gratified in the scope of the Specialized Federal Prosecutor's Office will be provided by public occupiers of effective posts, appointed by the President of the INSS, heard the Chief Prosecutor.

CHAPTER IV

DAS COMPETENCIES OF THE ORGANS

Section I

of the Direct and Immediate Care Bodies to the President

Art. 5o The Cabinet competes:

I-attend the President of the INSS in his political and social representation and occupy himself from communication social and the preparation and dispatch of their administrative expedient ;

II-arrange for the official publication of the matters relating to the area of acting of the President ;

III-coordinating the schedule and drafting of the Speaker's dispatches and hearings ;

IV-arrange for the fulfillment of applications and consultations arising from the National Congress and routed by the Ministry of Social Security ;

V-coordinate and monitor the flow of entry and exit of the institutional documents of responsibility of the President ; and

VI-exercise other functions assigned to it by the President.

Section II

Of Sectional Organs

Art. 6o To the Specialized Federal Prosecutor's Office, the execution body of the Federal Prosecutor-General, competes:

I-represent judicial and extrajudicially the INSS and other entities, upon designation of the Federal Prosecutor-General ;

II-to ensure compliance with the Constitution, laws and acts emanating from the Public Powers, under the normative guidance of the Federal Prosecutor General and the Advocacy-General of the Union ;

III-exercise the activities of consultancy and legal advice within the INSS, applying, in what couber, the provisions of the art. 11 of Supplementary Law No. 73 of February 10, 1993

IV-fixing the legal orientation of the INSS, intervening in the elaboration and editing of its normative and interpretative acts, in articulation with the organ components of INSS ;

V-coordinate and supervise, technical and administratively, the Regional Prosecutions and the Prosecutions-Sectional ;

VI-refer to the Federal Attorney General or the Advocacy-General of the Union, as the case may be, application for a practical lack of functional practice, in the exercise of their assignments, by their respective members ; and

VII-refer to the proposed President of Structuring and localization of the Regional and Public Prosecutions-Sectional, heard beforehand Federal Prosecutor-General.

Art. 7o The Auditorial-General competes:

I-plan, monitor, and control the development of preventive and corrective audits, identifying and evaluating risks, recommending preventive and corrective actions to decentralized organs and units, in line with the management model by results ;

II-subsidizing the President and Directors with information on the audits and their results, with a view to the improvement of audit and management procedures of INSS ;

III-subsidizing the Directorate of Attention in the proposition of standards, systems, and methods of evaluation and follow-up of the quality and productivity of INSS activities, as well in the actions aimed at institutional administrative modernization ;

IV-propose to the President, in articulation with the Coordination-General of Information Technology, plans, programs and targets of technological innovation in processes and systems used by INSS ;

V-evaluate the internal controls of management as to their effectiveness, efficiency, effectiveness and economicity, resguarding the interests of the INSS ;

VI-refer to Corregedoria-General solicitation of ascertainment of responsibility, when in your activity if evidenced irregularity of examination under the disciplinary aspect, indicating with clarity the irregular fact ;

VII-obtain from external sources information to confirm the fidedignity of evidence obtained internally ;

VIII-follow up and evaluate the effectiveness of activities conducted at INSS, for the planning, execution and improvement of integrated operations with other organs of the Public Administration as well as propose corrective measures ;

IX-monitor the execution of the INSS Action Plan and request effective actions from the areas for your due compliance ;

X-analyse and refer to the demonstrative President and accountability reports of the INSS ;

XI-refer to the proposed President of Structuring and localization of the Auditorias-Regional ; and

XII-producing knowledge about vulnerabilities and illicit acts concerning the area of acting INSS, upon the use of research techniques and analyses.

Art. 8o À Corregedorial-General competes:

I-monitor the performance of the servers and leaders of the INSS bodies and units, scrutinizing and evaluating their functional conduct ;

II-examine the relevance of complaints regarding the performance of INSS leaders and servers ;

III-promote the establishment of trade unionists and disciplinary administrative proceedings ;

IV-judgeting INSS's servers in disciplinary administrative processes, when the penalty proposal for warning ;

V-propose actions integrated with other bodies for combating fraud ;

VI-plan, coordinate, orient and supervise the activities of the Regional Corregedors, disciplinary committees, unionists and Ethics Commissions ;

VII-promote studies for the elaboration of standards, in their acting area ;

VIII-refer to the Directorate of Budget, Finance and Logistics processes for taking accounts special ;

IX-propose to the President the referral to the Federal Prosecutor General and the Advocacy-General of the Union of application for correction in the Specialized Federal Prosecutor's Office or ascertaining of functional lack practiced, in the exercise of their assignments, by its members ;

X-propose to the President the creation of Ethics Commissions within each Regional Oversight and Manager-Executive, as well as to promote the administration, installation and coordination of the matters pertinent to these ; and

XI-refer to the proposed President of structuring and location of the Regional Corregedorial.

Art. 9o The Directorate of Budget, Finance and Logistics competes:

I-plan, coordinate, control, guide, normalize and supervise related activities with the areas of logistics, tender and contracts, engineering, heritage, budget, finance and accounting ;

II-submit to the proposed President of:

a) annual and multiannual plans and programmes of the areas of budget and finance ;

b) plans and revenue generation programs arising from the use or disposal of real estate assets non-operational ;

c) consolidation of the annual budget proposal, starting from the propositions drawn up by the organs of the INSS, as well as investment plan for conservation, expansion, acquisition or disposal of real estate assets belonging to the INSS, used directly in its operational and administrative activities ;

d) General guidelines, including quantitative and qualitative global targets, as to the use, maintenance and management of heritage and operational expenses, in line with the action plan approved by the President ;

e) guidelines for the celebration of arrangements and contracts with financial institutions and too much payer agents ; and

f) criteria for the improvement of controls and security over the physical and financial flows of the payment of benefits, through the financial institutions and the other paying agents ;

III-consolidate plans and programmes approved by the President, compatibilizing them with the budget ;

IV-manage the physical-budgetary and financial execution of the established annual schedule and propose the corrective actions ;

V-manage the decentralization of credits and resource transfer to the organs and for the decentralized units ;

VI-evaluate, by monitoring the execution, the results obtained with the implantation of the annual and multi-annual plans and programmes for the areas of budget and finance, reconciling execution and its accounting ;

VII-exercise accounting management, accompanying the review and registration carried out by the organs and the decentralized units ;

VIII-control the acts and facts stemming from budgetary, financial and heritage execution and to draw up the demonstratives required by the legislation ;

IX-draw up demonstratives of the revenue and previdual expenses, within the framework of its competence ;

X-setting standards, systems and working methods aimed at enhancing the systems of financial, financial and accounting management of the INSS ;

XI-manage the acquisition, use and maintenance of movable goods, materials and services, in compliance with the established targets for operational expenses by adopting the corrective actions ;

XII-manage the plans and programs concerning real estate assets, as well as the administration carried out by indirect performers ;

XIII-exercise the technical supervision of the internal management activities of the organs and units decentralized ;

XIV-manage information on benefit payments, promoting comparative analysis of the physical and finance flows ;

XV-set up special account takeover commissions ; and

XVI-perform the activities of general and budget services, finance and accounting required the operation of the central administration of the INSS and the centralised hiring.

Art. 10. To the Directorate of Human Resources competes:

I-propose to the President, in articulation with the other Directories:

a) general guidelines for decentralized organs and units, as for preparation of plans, programs and goals of improvement, development and management of human resources ;

(b) general guidelines on the qualification of human resources linked to indirect performers of material, ancillary or instrumental activities to those that make up the legal mission of INSS ; and

c) guidelines and parameters regarding the profile and lotation of the servers for the proofing of human resources and for the administration of the general framework of INSS personnel ;

II-propose guidelines and manage the actions inherent in the administration and development of people ;

III-manage the plans and programs of empowerment and development of human resources and evaluate your results ;

IV-judgeting INSS's servers in disciplinary administrative processes, when the penalty proposal for suspension up to thirty days ;

V-approver:

a) the participation of servers in the Post-Graduate Program, within the framework of INSS ; and

b) the national-wide capacity-building actions ;

VI-decide on resources interposed by servers against administrative decisions rendered by the Generates-Executivos;

VII-supporting the areas of INSS in the Lifting of the Capacitation Needs-LNC, in order to subsidise the elaboration of the Annual Capacitation Plan ; and

VIII-run the actions of personnel administration within the central administration of INSS.

Section III

Of The Singular Specific Organs

Art. 11. To the Directorate of Benefits competes:

I-manage:

a) the bases of the enrollment data, linkages, remuneration and contributions of the Security insured persons Social, with a view to the automatic recognition of the right ;

b) the initial recognition, feature and review of rights to receive benefits previdential and assistive, previdential compensation, arrangements with companies, representative entities and public bodies ; and

c) the payment to the beneficiaries of Social Security and Welfare ;

II-develop studies aimed at the improvement of the mechanisms of recognition of law upon receipt of benefits ;

III-propose to the President the exchange with governmental entities and national institutions and international ;

IV-establish general guidelines for the development of plans, programs and targets of the information administration activities of insured persons, initial recognition, maintenance, resource and review of rights to the receipt of previdential and assistive benefits, pension compensation, as well as for the formalization of venues with companies, representative entities and public bodies concerning their area of acting, exercised by the Generations-Executivas;

V-normatization, guide and standardize the procedures of administration of information from insured, initial recognition, maintenance, resource and review of rights to the receipt of previdential and assistive benefits, consignment benefits and monitoring of the operationalization of benefits ;

VI-subsidizing exchange actions with public and private entities, as a result of programmes and projects, aiming at the spread of institutional information ; and

VII-to monitor compliance with the clauses of the arrangements and contracts concluded with the network of service providers of benefits administered by INSS.

Art. 12. To the Worker's Health Directorate competes:

I-manage and normalize the activities of medical expertise of previdential benefits, assistential and those concerning federal public servants, in accordance with the terms of § 4o of the art. 30 of Law no 11,907, of February 2, 2009, of professional rehabilitation and social service, including when effected by indirect performers ;

II-develop studies aimed at the further improvement of the medical-pericial activities of previdential, assistive benefits and those concerning federal public servants, professional rehabilitation and social service, as well as promoting the guidance to society objecting to the recognition of the right ;

III-propose to the President of the INSS:

a) interaction and exchange with governmental bodies, aiming for monitoring and control epidemiological disease of higher prevalence in disability benefits ;

b) the celebration of partnerships, concerning their area of acting, with companies, public bodies, other institutions and non-governmental, national and foreign entities ; and

c) actions on the basis of the analysis of the oscillations and variables occurring in the recognition of rights of the benefits for previdential and assistential disability, including those identified by the Benefit and Service Directors ;

IV-plan the specialization of actions for the improvement of quality, correction and enhancement of the recognition of rights to benefits for previdential disability and assistential.

Art. 13. To the Board of Service competes:

I-ensure the quality of the services provided to the users of INSS ;

II-coordinate the direct and remote service actions to users of the INSS services ;

III-coordinate the strategy of disseminating information to the listening network ;

IV-standardize the procedures of the fulfillment network ;

V-coordinate and supervise the support and maintenance services of informatics to the network of listening for INSS ;

VI-promote technical studies and actions for the expansion, classification and diversification of the network of fulfillment, including conformations in the number of fulfillment units ;

VII-afering the performance of the listening network and its managers ;

VIII-co-ordinating the management of partnerships and arrangements related to user service, without prejudice to the tasks of the Directorate of Budget, Finance and Logistics and the Directorate of Benefits ;

IX-propose to the President of INSS:

a) standards, systems and methods for evaluation and monitoring of quality and productivity ;

b) criteria for location, alteration and installation of Social Security Agencies, fixed and furniture, and from the Generes-Executivas;

c) guidance programs to users of Social Security services ;

d) criteria for the purposes of aferition of institutional performance of the Generations-Executives and the Agencies ; and

e) the expedition of normative acts for orientation and standardization of procedures and standards of supervision of the network activities ;

X-monitor the results obtained with the application of the standards, systems and methods of evaluation of productivity and quality and recommend actions of improvements and empowerment of human resources ;

XI-subsidizing the Ouvidoria-General of Social Security in the exercise of its assignments and promote joint analysis and evaluation of the previdual and assistential services provided to users ;

XII-to promote exchange with public and private entities, in the conduct of programmes and projects, targeting the spread of institutional information ;

XIII-promote the exchange with the Management Office of the Ministry of Planning, Budget and Management, through the Undersecretion of Planning, Budget and Administration of the Ministry of Social Welfare, seeking the excellence of the services provided, in line with the guidelines of the Federal Government's programs and projects ; and

XIV-establish guidelines and coordinate the actions of the Previdual Education-PEP Education Program.

Section IV

Common competencies of the Direct and Immediate Care Bodies to the

Speaker, Sectional and Specific Specific

Art. 14. To the bodies of direct and immediate assistance to the President, the sectional organs and the singular specific, observed their respective areas of acting, competes:

I-submit to the President of the INSS proposal of:

a) guidelines for the elaboration of the INSS Annual Plan of Action and, as of its approval, its plans and programs ;

(b) legal instruments aiming at the improvement of legal performance, budgetary management, financial, accounting and real estate assets, from initial recognition, maintenance, resource and review of rights to the receipt of previdential and assistive benefits and benefits in benefits ; and

c) plans, programs and technological innovation targets in processes and systems used in their activities, in articulation with the Coordination-General of Information Technology ;

II-subsidizing the Directorate of Service in the proposition of standards, systems, and methods of evaluation and follow-up of the quality and productivity of their activities and services, as well in the actions aimed at institutional administrative modernization, without prejudice to the assignments of the other bodies involved ;

III-keep informed the President of the INSS on:

a) the results of the processes of the technical-administrative litigation, especially those arising from the administration of real estate ;

b) preventive and corrective audits and their results ;

c) the internal management actions ; and

d) the initial recognition, maintenance, resource, and review actions of rights to the receipt of previdential and assistecial benefits, benefits in benefits as well as in relation to previdential compensation ;

IV-provide the Coordination-General for Planning and Strategic Management information required for the elaboration and monitoring of the planning process of the INSS ;

V-provide the Board of Service with the information necessary to follow up on results and evaluation of the listening network ;

VI-systematization and disseminate guidelines for the generation of institutional information ;

VII-co-ordinate and supervise the Regional and Public Prosecutions-Sectional, the Auditorias-Regional, Regional Corregedics, as well as initial recognition, maintenance, resource and review of rights to the receipt of previdential and assistive benefits, pension compensation, and internal control of benefits ;

VIII-answer requests for information from external control bodies and subsidize the drawing up of the annual account reporting, by observing the legal deadlines ;

IX-refer to the Directorate of Budget, Finance and Logistics processes for taking accounts special ;

X-support the realisation of the internal selection process for the choice of occupants of the posts of Manager-Executive;

XI-manage, in articulation with the Ouvidoria-General of Social Security, the resolution of the demands regarding your acting area, with the aim of improving the quality of the provision of the previderal services ; and

XII-to enforce the deliberations of the President.

Section V

Of Organs and Uncentered Units

Art. 15. The Regional Superintendencies, subordinated to the President of the INSS, competes:

I-supervise, coordinate and articulate the management of the Generations-Executives under their jurisdiction ;

II-submit to the President the Regional Oversight Action Plan and its General Managers-Executives jurisdictional, in accordance with the guidelines emanating from the Pluriannual Plan of the Federal Government and Strategic Planning of the INSS, in articulation with the Coordination-General Planning and Strategic Management ;

III-program and perform the following common activities necessary for the operation of organs and units of the INSS under its jurisdiction:

a) coordination, guidance, consolidation, monitoring and evaluation of projects and activities, in scope of Regional Oversight ;

(b) coordination, monitoring, evaluation and consolidation of the tender budgeting, in line with the Action Plan, within the framework of Regional Oversight ;

c) coordination of the budgetary, financial and accounting implementation activities within the framework of the Regional Oversight ;

d) special account takeover within the framework of Regional Oversight, according to the guidelines from the Directorate of Budget, Finance and Logistics ;

e) scheduling and monitoring of bidding procedures and hiring of goods and services ; and

f) performance of general and budget services activities, finance and accounting, accordingly with the Guidelines of the Budget, Finance and Logistics Directorate ;

IV-supporting the actions of personnel development, through the elaboration, coordination and implementation of the programming of empowerment and server development within the framework of Regional Oversight and subordinate units, depending on the guidelines of the Human Resources Directorate ;

V-approve the annual programming of empowerment of the Generations-Executives under their jurisdiction ;

VI-authorize the execution of capacity-building projects-Executives under your jurisdiction;

VII-perform human resources administration activities, within the framework of Superintendency Regional, depending on the deliberation of the Human Resources Directorate ;

VIII-implement the guidelines and actions defined by the Directorate of Service and the Directorate of Benefits ;

IX-support and execute, through the Social Communication Advisor, the communication activities social and political and social representation of the INSS, under the supervision of the unit responsible for social media in the Ministry of Social Security ;

X-manage, in articulation with the Ouvidoria-General Social Security the resolutability of the demands regarding your area of comprehension, with the aim of improving the quality of the provision of the previdual services ; and

XI-answer the information requests of the control bodies and subsidize the Presidency in elaboration of the annual accountability report, with consolidated information from its Courts-jurisdictional executives.

Art. 16. To the Generations-Executives, subordinated to the respective Regional Superintendencies, competes:

I-supervise the Social Security Agencies under its jurisdiction in the activities of:

a) initial recognition, maintenance, resource, and review of rights to receive benefits previdential and assistential ;

b) medical expertise and professional rehabilitation, including those carried out by indirect performers ; and

c) operationalization of the previdual compensation between the General Social Welfare Regime and other pension schemes ;

II-ensure social control, in particular through the maintenance of the Welfare Councils Social ;

III-meet the demands arising from the Ouvidoria-General of Social Security ;

IV-elaborate, execute and follow the Annual Plan of Action, within the scope of its competence ;

V-support the management of the reception, distribution and execution of litigation, depending deliberation of the President ;

VI-support and monitor, in the administrative plan, the activities of judicial representation or extrajudicial, consultancy and legal advising ;

VII-support and monitor, in administrative plan, correctional activities and audits installed in their area of comprehension ;

VIII-intersect resources and offer counter-reasons to the Board of Appeal Board and Judgment Chambers of the Social Security Resource Board-CRPS, in relation to the subjects of their competence ;

IX-perform the activities of general and budget services, finance and accounting required to the operation of organs and jurisdictional units, with the annuence of Regional Oversight and in accordance with the Guidelines of the Budget, Finance and Logistics Directorate ;

X-run human resource administration activities, in its jurisdiction, consonant deliberation of the Directorate of Human Resources ;

XI-draw up capacitor project for your servers, forwarding it to Superintendency Regional ;

XII-perform the capacity-building actions authorized by Regional Superintendencies ;

XIII-support and execute the social media and political and social representation activities of the INSS, observed the willing on art. 15 ;

XIV-promover, in articulation with the Board of Service, the actions of the Education Program Previdual-PEP, keeping informed the Regional Oversight ; and

XV-draw up information from your area of comprehension to subsidize the Prestation of Annual Accounts of the INSS, forwarding them to Regional Oversight.

§ 1o At Managers-Executives competes, yet, supervise, support and control the units of care linked to them, through the celebration of arrangements and partnerships consisting of companies, municipal prefectures and other public and community actors.

§ 2o In the capitals of Federation units where Superintendence is installed Regional, it will be up to this implementation of the social media activities, with the Executive Generation being tasking to support it.

Art. 17. The Social Welfare Agencies, subordinated to their respective Generations-Executives, competes:

I-proceed to initial recognition, maintenance, appeal and review of rights to benefits administered by the INSS, medical expertise, habilitation and professional rehabilitation, social service, as well as the operationalization of pension compensation and the issuance of contribution-time certificates ;

II-propose formal consultation to the technical areas of the Executive Generation to which it links ;

III-perform the orientation and information activities, in accordance with the established guidelines in the specific acts that define the subject ;

IV-meet the demands of the Ouvidoria-General Social Security ;

V-render the information requested by the Prosecutor's Office to subsidize the defence of INSS in judgment and comply, under the guidance of the Prosecutor's Office, judicial decisions ; and

VI-perform the activities of orientation, information and awareness of the society, inclusive those arising from local, regional or national partnerships, in accordance with the guidelines set out in the Previdual-PEP Education Program in articulation with the General-Executive.

Single Paragraph. The Social Welfare Agencies of specific competencies will be identified in act of the President of the INSS, observed the interest of the administration.

Art. 18. To the Regional Prosecutors competes:

I-when acting together with the second-degree organ, monitor judicial proceedings within the framework of the Federal Regional Court and the Regional Uniformization of the respective Federal Special Special Court, as well as the Regional Court of Labour, the Court of Justice and the Recursal Class of the Federal Special Juvenile in its acting area, in addition to establish uniformity of procedures in the processes of interest of the INSS who tramway in the degree of appeal before these judicial bodies ;

II-when they act together with the first-degree judicial body, represent the INSS and other entities, upon designation of the Federal Prosecutor General ; and

III-exercising consultancy and legal advising activities to INSS and entities designated by the Federal Prosecutor-General, applying, in what couber, the provisions of the art. 11 of the Supplemental Law no 73, 1993.

Art. 19. The Attorney-Sectional competes to represent judicial and extrajudicially the INSS and other entities, upon designation of the Federal Prosecutor-General, in addition to exercising consultancy and legal advice activities, applying, in what couber, the willing on art. 11 of Supplementary Law No. 73, 1993.

Art. 20. The Auditorias-Regionals, subordinated directly to the Auditoria-General, competes:

I-follow up and perform preventive and corrective audits and recommend preventive actions and corrective in the decentralized organs and units, as per guidelines set by the Auditorial-General, through its Coordinations-General ; and

II-monitor the apuration and solution, in charge of the execution lines, of complaints forwarded by Ouvidorian-Social Security General.

Art. 21. To the Regional Corregedorials, subordinated directly to the Corregedoria-General, competes:

I-monitor the performance of the servers and leaders in the decentralized organs and units, fiscalizing and evaluating their functional conduct ;

II-define on the relevance of the finding of denunciations concerning the activities of the leaders and servers of INSS, without prejudice to their competencies ;

III-promote the establishment of trade unionists and disciplinary administrative proceedings ;

IV-requisition representations, information, processes and documents necessary to the performance of your activities ; and

V-receive and ascertain the complaints forwarded by the Ouvidoria-General of Social Security and communicate solution.

CHAPTER V

DAS ASSIGNMENTS OF DIRECTORS

Section I

From the President

Art. 22. To the President it is incumbent:

I-exercise the superior direction and hierarchical command within the INSS ;

II-represent the INSS ;

III-exercise disciplinary power under the legislation ;

IV-coordinating institutional communication within the INSS ;

V-refer to the Ministry of Social Welfare proposals of legal instruments, documents and reports that should be submitted to the National Social Security Council-CNPS ;

VI-draw up and disseminate half-yearly reports on the activities of the INSS, referring them to the CNPS and to the Minister of State for Social Security, without prejudice to the forwarding of other reports and information when per this requested ;

VII-refer to the Minister of State for Social Security list quintupla for appointment of Managers-Executives, chosen pursuant to § 1the of art. 4the;

VIII-refer to the Minister of State for Social Security the proposals of:

a) creation, extinction, changing location and installation of new Regional Superintendencies Management-Executives, Auditorial-Regional, Regional, Regional Prosecutions-Regional and Public Prosecutions-Sectional ;

b) alteration of the internal regiment of the INSS ; and

c) plans, programmes and technological innovation targets in processes and systems used by the INSS ;

IX-refer to the Federal Attorney General and the Advocate General of the Union application for correction or Functional lack of which treats the inciso IX of the art. 8the;

X-send the accountability to the Ministry of Social Security for the purposes of forwarding to the Tribunal of Accounts of the Union ;

XI-to celebrate and rescend contracts, arrangements, agreements and adjustments, as well as order expenses ; and

XII-decide on:

a) Annual Plan of Action, the annual budget proposal and its changes ;

(b) disposal and acquisition of real estate, in conjunction with the Director of Budget, Finance and Logistics ;

c) hiring external audits to analyze and issue opinion on demonstratives econo-financial and accounting, as well as on payment of benefits, submitting the results obtained to the appreciation of the Minister of State for Social Security and the CNPS under the legislation ;

d) location, change and installation of Social Security Agencies, fixed and mobile ; and

e) the creation of Ethics Commissions in Regional Superintendencies and Generations-Executives.

Section II

Of the other Leaders

Art. 23. The Directors, the Chief Prosecutor, the Chief of Staff, the Auditor-General, the Correged-General, the Regional Superintendents, the Generates-Executives, the Managers of Agencies, the Prosecutors-Regionals, the Attorneys-Sectional, the Directors, the Directors, the Regional Superintendents, the Directors of the Regional Directors, the Directors Auditors-Regional, the Regional-Regional and the other leaders is to plan, direct, coordinate, guide, monitor and evaluate the execution of the activities affected to their respective units and exercise other assignments that they are committed, in their areas of acting, by the President.

CHAPTER VI

GENERAL PROVISION

Art. 24. The organization and operation standards of the organs and integral units of the INSS Regimental Structure will be established in the internal regiment.
