DECREE OF March 20, 2002

Declares of social interest, for agrarian reform purposes, rural real estate that mentions, and gives other arrangements.

THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the office of President of the Republic, using the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of Supplementary Law No. 76 of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964 and 2º of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Fight Vavá", with area recorded one hundred and fifty seven hectares, seventy-six airs and eighty centials, and area measure of one hundred and fifty-nine hectares, ninety and five airs and sixty-eight centiars, situated on the Municipality of Uruçuca, object of the Records in the R-1-377, Book 2 and R-2-377, Book 2, of the Estate Registration Card of the Comarca of Uruçuca, State of Bahia (Process INCRA/SR-05/nº 54160.002878 /2001-65) ;

II-"Fight Lagoon from Within I and II", with registered area of two thousand, two hundred and sixty-three hectares, three airs and forty-eight centials, and measured area of two thousand, two hundred and sixty-one hectares, sixty-two airs and eighty-one centiars, situated in the Municipality of Ouroland, object of the Registrars in the R-1-3.420, fls. 165, Book 2-H and R-1-3.846, fls. 598, Book 2-H, of the Estate Registration Office of the Jacobin Comarca, Bahia State (Process INCRA/SR-05/nº 54160.002200 /2001-82) ;

VII-"Fazenda Nova Galicia", with registered area of four hundred and ninety-seven hectares, thirty-five airs and sixty-five centiars, and area measure of four hundred and eighty-nine hectares, fifty and six airs and ninety and ninety and four centiars, situated in the Municipality of Una, object of the Registrars n R-3-1.029, Book 2 and R-4-1.029, Book 2, of the Estate Registration Office of the Una Comarch, State of Bahia (Process INCRA/SR-05/nº 54160.000094 /2002-83).

Art. 2º Excludes from the effects of this Decree the semovents, machines and agricultural implements as well as the existing benefits in the real estate referred to in art. 1º and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is hereby authorized to promote the dispropriations of rural real estate that it treats this Decree, in the manner provided for in Supplementary Law No. 76 of July 6, 1993, and to maintain the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication.
