DECREE OF September 20, 2000

Declaration of social interest, for the purposes of agrarian reform, the rural real estate that mentions, and gives other providences

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon you to the arts. 84 inciso IV, and 184 of the Constitution and under the terms of arts 2º of Law No. 1964, and 2º of Law No. 8,629 of February 25, 1993.

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters?a,?b? ,?c?, and?d?, and 20, inciso VI, of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I? ? Branquinha and Patos?, with area of novelty and ninety and seven hectares and fifty airs, situated in the Municipality of Inhapi, object of Registration # R-01-1.194, fls. 56, Book 2-E, of the Estate Registration Office of the Comarca of Mata Grande, State of Alagoas (Process INCRA/SR-22/nº 54360.000427 /00-11) ;

II? ?Jurema?, with area of two hundred and seventy-two hectares and twenty-five airs, situated in the Municipality of Delmiro Gouveia, object of Register No R-1-7.031, fls. 145, Book 2-AG, from the Single Oficio Carthorium of the Delmira Gouveia, State of Alagoas (Process INCRA/SR-22/nº 54360.000601 /00-16) ;

Mayer One?, with area of thirty-one hectares, novemta and five airs and seventeen centiars, situated in the Muncipio de Fraiburg, object of Registration # R-7-607, Ficha 1, Book 2, of the Carthium Registration of the Fraiburden Comarca, State of Santa Catarina (Process INCRA/SR-10/nº 54211.000085/00?43).

Art. 2º Excludes from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in the preceding article and belonging to those who will be beneficiaries with their destination.

Single Paragraph. It is also excluded from the effects of this Decree the area of five hectares, seventy and one airs and fifty-nine centiars, constant from the real estate specified in the inciso VI of the previous article, belonging to the strip of the Municipal Road.

Art. 3º The National Institute for Colonization and Agrarian Reform INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Act No. 76 of July 6, 1993, and to maintain the areas of Legal reservation and preservation perpetually provided for in Law No. 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. This Decree shall enter into force on the date of its publication.
