DECREE OF May 8, 2008.

Disposes on the creation of the Forest National of Iquiri, in the Municipality of Lábrea, in the State of Amazonas, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 17 of Law No 9,985 of July 18, 2000, and what is stated in the Process at 02001.002746 /2006-77,

DECRETA:

Art. 1st It is created the National Forest of the Iquiri, in the Municipality of Lábrea, in the State of the Amazon, with the objectives of promoting sustainable multiple use maneuver of forest resources, maintenance and protection of water resources and biodiversity, recovery of degraded areas, support for development of methods of sustainable exploitation of native forests and scientific research.

Art. 3rd Caberá to the Chico Mendes Institute for Conservation of Biodiversity-Chico Institute Mendes administer the Iquiri National Forest, adopting the necessary measures to its effective implantation.

Art. 4th Ficam declared of public utility, for the purposes of dispropriation, by the Institute Chico Mendes, the existing private rural real estate in the Iquiri National Forest, in the terms of the arts. 5th, point?k?, and 6º of Decree-Law No. 3,365 of June 21, 1941.

Single Paragraph. The Federal Prosecutor-General's Office, the Union Advocate General's Office, through its legal unit of execution with the Chico Mendes Institute, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of eventual property securities and respective real estate records deemed irregular, incidents in the Iquiri National Forest.

Art. 5th Union lands contained within the limits of the Iquiri National Forest, of which it treats the art. 2nd of this Decree, will be ceded to the Chico Mendes Institute by the Union Office of the Union of the Ministry of Planning, Budget and Management, in the form of the law.

Art. 6th Participation in the analysis and elaboration of the National Forest Manal Plan of the Iquiri, the National Defense Council, through its Executive Secretariat, and the Ministry of Defense.

Art. 7th In the exercise of the constitutional and legal tasks of the Armed Forces and Police Federal in the National Forest of the Iquiri, are understood:

I-the freedom of transit and access, by water, air or land, from military and police for the realization of displacement, parking, patrolling and other operations or activities, indispensable to the security and integrity of the national territory ;

II-the installation and maintenance of military and police units, of equipment for surveillance and support for air and maritime navigation, as well as access routes and other necessary infrastructure and logistics measures, compatibilized with the Unit's Manejo Plan, when outside the border strip ; and

III-the deployment of programs and projects of control and occupation of the border.

Art. 8th This Decree goes into effect on the date of its publication.
