Declaration of public utility, for the purposes of misappropriation, in favor of ViaBahia Concessionaire de Rodovias S.A., the real estate that mentions, located in the Municipality of Santana Fair, in the State of Bahia.

THE REPUBLIC OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, caput, inciso IV, of the Constitution, and in view of the willing in the arts. 3 °, 5 °, points "h" and "i", and 6 ° of Decree-Law No 3,365 of June 21, 1941 in the arts. 29, caput, inciso VIII, and 31, caput, inciso VI, of Law n ° 8,987 of February 13, 1995, and what is stated in the ANTT Case No. 50500.060683 / 2011-52,

D E C R E T A:

Art. 1 ° Ficam declared of public utility, for the purposes of dispossession, total or partial, in favor of ViaBahia Concessionaire de Rodovias S.A., the real estate covered and delimited by the topographical coordinates described below, excluded the goods from public domain, adjacent to the Rodovia Santos Dumont, BR-116/BA, necessary for the execution of the execution works of the stretch between the km 433 + 000m and the km 442 + 000m:

Art. 2º Stay the ViaBahia Concessionaire de Rodovias S.A. authorized to promote, with own resources, the dispossession of the areas of land and benefits of which it treats art. 1 °, in the form of the current legislation and regulations.

Single Paragraph. The exproprier is allowed to invoke the urgency character in the process of dispossessing that it treats the caput, for purposes of immission in possession, in the terms of art. 15 of Decree-Law No. 3,365 of June 21, 1941.

Art. 3rd This Decree comes into force on the date of its publication.
