DECREE NO 3,797, DE April 19, 2001

Provides on the execution of the Trigenth Fourth Additional Protocol to the Economic Supplementation Agreement No. 2 (Automotor Vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, December 19 of 2000.

THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the office of President of the Republic, using the attribution conferring you the art. 84, inciso IV, of the Constitution,

Considering that the 1980 Treaty of Montevideo, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980 and approved by the National Congress, through Legislative Decree No. 66, of November 16, 1981, provides for the modality of Economic Supplementation Agreement ;

Considering that the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the 1980 Treaty of Montevideo, signed, on December 20, 1982, in Montevideo, the Supplementation Agreement Economic paragraph 2, between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, which has been incorporated into the Brazilian legal order by means of Decree No 88,419 of June 20, 1983 ;

Considering that the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the 1980 Treaty of Montevideo, signed, on December 19, 2000, in Montevideo, the Trigh Fourth Protocol Additional to the Economic Supplementation Agreement No. 2 (Automor Vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay ;

DECRETA:

Art. 1º It is promulgated, for all purposes, the Trigenth Fourth Additional Protocol to the Economic Supplementation Agreement No. 2 (Automotive Vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, apensed by copy to the present Decree.

Art. 2º This Decree goes into effect on the date of its publication.

AGREEMENT OF ECONOMIC SUPPLEMENTATION # 2 CONCLUDED BETWEEN THE FEDERATIVE REPUBLIC OF BRAZIL AND THE

EASTERN REPUBLIC OF URUGUAY

Trigenth Fourth Additional Protocol

The Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, accredited by their respective Governments under powers that have been bestowed in good and due form, deposited expeditiously in the Secretariat-General of the Latin American Integration Association,

CONSIDERING the decision of the Brazilian Government not to be worth the faculty of automatically extending the Economic Supplementation Agreement No. 2 by the 6-year deadline under Article 14 of the said instrument.

CONSIDERING that the almost totality of the tariff items marketed between Brazil and Uruguay are already under the free trade regime established by the Economic Supplementation Agreement No. 18 and instruments complementary.

CONSIDERING the need to ensure appropriate time frame for the settlement of the trade issue from special customs areas of the States Parties.

CONSIDERING the adoption by the Common Market Council of Decision No 70/00, which approves the Agreement on Automotive Policy of Mercosur, to enter into force from 1º February 2001.

CONVEEM IN

Single Article. Extend from December 20, 2000 until January 31, 2001 the duration of the Economic Supplementation Agreement No. 2 and the preferences agreed upon in its scope.

The General Secretariat of the Latin American Integration Association shall be depositary of this Protocol, of which it shall send duly authenticated copies to the signatory Governments.

IN FÉ DO THAT, the respective Plenipotentiaries subscribe to this Protocol in the city of Montevideo, to the nineteen days of the month of December two thousand, in an original in the Spanish and Portuguese languages, both of which are also texts valid.
