Disposal on the creation of the Green Extractivision Reserve for Always, in the Municipality of Porto de Moz, State of Pará.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 18 of Law No. 9,985 of July 18, 2000 and what is contained in Process No 02001.007795 /2001-91,

DECRETA:

Art. 1º It is created the Green Extractivision Reserve for Always, located in the Municipality of Porto de Moz, State of Pará, with an approximate area of one million, two hundred and eighty-eight thousand seven hundred and seventeen hectares, twenty airs and ninety centials, based on the sheets SA-22-V-C, SA-22-V-D, SA-22-Y-A and SA-22-Y-B, at scale 1:250.000, published by the Brazilian Institute of Geography and Statistics-IBGE, with the following Descriptive Memorial: departing from Point 01, from coordinates approxic geographic 52 ° 59'41, 21 "Wgr and 01 ° 46' 02, 60" S, located on the right bank of the Amazon River, follows by the right bank of the Amazon River in the downstream sense to Point 02, of approxic geographical coordinates 52 ° 14' 48, 45 Wgr and 01 ° 31'21, 49 " S, located in the confluence of the Xingu River with the Amazon River ; of this follows on the left bank of the Xingu River, in the upstream sense up to Point 03, of approxic geographical coordinates 52 ° 15'07, 11 "Wgr and 01 ° 48' 53, 30" S, located on the left bank of the confluence of the Jarauçú River with the Xingu River ; Art. 2º The Green Extraction Reserve for Always aims to ensure the sustainable use and conservation of renewable natural resources, protecting the livelihoods and culture of the local extraction population.

Art. 3º The Office of the Brazilian Institute of Environment and Renewable Natural Resources-IBAMA administer the Green Extractivision Reserve for Always, adopting the necessary measures for its deployment and control, in the terms of art. 18 of Law No. 9,985 of July 18, 2000 providing for free use assignment contracts with the traditional extraction population, for the purpose of their celebration by the Office of the Union Heritage of the Ministry of Planning, Budget and Management, and monitor compliance with the conditions in them stipulated in the form of the law.

Art. 4º Stay declared for social interest, for the purposes of dispossession, in the form of Law No. 4,132 of September 10, 1962, rural real estate of legitimate private domain and their benefits that come to be identified within the limits of the Reservation Green Extraction For Always.

§ 1º The IBAMA is authorized to promote and execute the misappropriations of which it treats the caput of this article, and may, for the purpose of immission in possession, aller the urgency to which the art is referred. 15 of Decree-Law No. 3,365 of June 21, 1941.

§ 2º The areas that come to be identified as domain of the State of Pará may only be misappropriated after due legislative authorization.

§ 3º The Federal Prosecutor-General's Office, the Union Advocacy-General, through its legal unit of implementation with the IBAMA, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of eventual property securities and respective real estate records deemed irregular, incidents in the Green Extraction Reserve For Always.

Art. 5º This Decree shall enter into force on the date of its publication.
