DECREE OF September 19, 2005

Declaration of social interest, for the purposes of agrarian reform, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2 that of Supplementary Law n o 76, July 6, 1993, 18 and 20 of Law n o 4,504 of November 30, 1964 and 2 to that of Law n o 8,629 of February 25, 1993,

D E C R E T A:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law n o 4,504, of November 30, 1964, and 2 to that of Law n o 8,629, February 25, 1993, the following rural real estate:

I-"Farmed Farms Esplanada", with registered area of four thousand, three hundred and seventy and a hectares and fifteen airs, and area measured of four thousand, two hundred and ninety and seven hectares and forty-eight ares, situated in the Municipality of Santa Rita de Cassia, object of the Registrars n the R-3-2.223, Book 2-G ; and R-3-2.430, Book 2-H, of the Carthium of Registration of Real Estate of the Comarch of Santa Rita of Cássia, State of Bahia (Case INCRA/SR-05/n 54160.004112/2004-68) ;

II-"Farm Tanks and Varjota", with area of one thousand and eight hundred hectares, situated in the Municipality of Santana do Acaraú, object of Registration n o 135, fls. 135, Book 2, of the Estate Registration Office of the Santana Comarca of Acaraú, State of Ceará (Process INCRA/SR-02/n the 54130.002298 /2004-78) ;

III-"Farm Seven Rivers, Bocaina and Imbé", with area of two thousand, forty-two hectares, seventy-two eight airs and five centiars, situated in the Municipality of Flores of Goiás, object of the Registrars n the R-11-269, fls. 94v, Book 2-D ; R-9-291, fls. 200, Book 2-A ; and R8-169, fls. 63, Book 2-A, of the Estate Registration Card of Flores of Goiás, Comarca of Formosa, State of Goiás (Case INCRA/SR-28/n the 54700.000537 /2004-43) ;

IV-"Gleba Jardim", with area of a thousand, five hundred and seventy-five hectares, situated in the Municipality of Bacabal, object of Registration n o 4,199, fls. 241, Book 3-H, of the Real-estate Registration Card of the Bacabal Comarch, State of the Maranhão (Case INCRA/SR-12/n the 54230.005865 /2003-39) ;

V-"Farm Behind the Serra or Extremy", with area of five hundred and eight hectares, fifty and one ares and sixty-four centiars, situated in the Municipality of Buritis, object of Registration n o R-14.103, Ficha 4,103, Book 2, of the Estate Registration Office of the Comarca of Buritis, State of Minas Gerais (Case INCRA/SR28/n o 54700.000135 /2004-49) ; and

VI-"Portrait, Bar of the Kávers and New Nile", with area of three thousand, five hundred and eighty six hectares, forty-nine airs and twenty-five centiars, situated in the Municipality of Union, object of Registration n o 2,099, fls.87, Book 3-B, of the Carthorium of the 1 o Oftice of the Real Estate Registration of the Union Comarca, State of Piauí (Case INCRA/SR-24/n o 54380.001837 /2003-29).

Art. 2º Delete from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in art. 1 o and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute for Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Law No. 76 of July 6, 1993, and to maintain the areas of Legal reservation and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree shall enter into force on the date of its publication.
