DECREE NO 6,464, DE May 27, 2008.

Disposes on the assignment and acting of agricultural attachments together with Brazilian diplomatic missions abroad, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso VI, point?a?, of the Constitution,

DECRETA:

Art. 1st This Decree sets out general standards and guidelines regarding the designation and acting of agricultural adids.

Single Paragraph. The agricultural attachement, for the purposes of this Decree, shall exercise permanent assignment of advising on agricultural matters to the Brazilian Diplomatic Missions referred to in art. 4th.

Art. 2nd Only may be designated agricultural attachable one that filling in the following requirements:

I-be Brazilian nato or naturalized ;

II-ser, for at least four years:

a) Federal public servant occupier of office effective from the Ministry of the Ministry's personnel framework Agriculture, Livestock and Supply ; or

b) employed from the effective framework of public enterprise or federal mixed economy society, since that ceded to the Ministry of Agriculture, Livestock and Supply ;

III-having completed superior course recognized by the Ministry of Education, preferably in areas related to agribusiness ;

IV-attest proficiency in foreign language ; and

V-have completed course of preparation for the exercise of an advisory mission in matters agricultural, organized and delivered by the Rio Branco Institute, the Ministry of Foreign Affairs, in collaboration with the Ministry of Agriculture, Livestock and Supply.

Single Paragraph. The Ministry of Agriculture, Livestock and Supply and the Ministry of Foreign Affairs will set out, in joint act, the required foreign language, which could be more than one, considering the country where the nominees will play their missions, and the forms of proficiency proving, as provided for in inciso IV.

Art. 3rd agricultural attachable shall be designated in act of the President of the Republic upon appointment of the Minister of State for Agriculture, Livestock and Supply, heard beforehand the Ministry of Foreign Affairs.

Single Paragraph. The designation to perform the mission that it treats this Decree will be conditioned on the granting of the government of the country of destination, when it is the case, to be obtained by the Ministry of Foreign Affairs.

Art. 4th Stay authorized the exercise of agricultural adido activity together with the Missions Diplomatic from Brazil in Buenos Aires, Brussels, Geneva, Moscow, Beijing, Pretoria, Tokyo and Washington.

Single Paragraph. Each mission shall be exercised by only one agricultural attachable who, for the purposes of the provisions of the Act No 5,809 of October 10, 1972, shall be deemed equivalent to Councilor of the Diploma Career.

Art. 5th The duration of the mission of advising on agricultural matters will be two years consecutive, extendable one time for equal period, counted from the date of presentation of the agricultural attachement to the diplomatic mission for which it has been designated.

§ 1st The extension provided for in the caput will depend on assessment and justification of the Registry of International Relations of Agronegox from the Ministry of Agriculture, Livestock and Supply, in coordination with the head of the diplomatic mission.

§ 2nd At any time, by joint decision of the Ministry of Agriculture, Livestock and Supply and of the Ministry of Foreign Affairs, the periods of time provided for in this article may be halted.

§ 3rd The server or public servant, who has exercised the mission that it treats this Decree, does not can be re-assigned again to occupy it before decorated four years of the previous mission's termination.

Art. 6th The agricultural attachable can be assisted by up to two local auxiliaries, for each post, which may be contracted in line with the devices of Chapter V of Title I of Law No 11,440 of December 29, 2006.

Art. 7th general assignments of agricultural attachments:

I-seek better access conditions for products from Brazilian agribusiness in local markets or regional ;

II-prospecting new opportunities for the products of Brazilian agribusiness ;

III-collect, analyze and disseminate information on the local market and trade trends ;

IV-articulating actions supporting the external promotion of Brazilian agribusiness products in the markets local or regional ;

V-inform the Ministry of Agriculture, Livestock and Supply on effective problems or potentials that affect the trade in products of Brazilian agribusiness ;

VI-follow up, analyse and inform on the agricultural policies and legislations of interest of the Brazilian agribusiness ;

VII-follow up, inform and anticipate possible modifications to health policies and phytosanitary of other countries ;

VIII-follow up and inform consumption trends and quality requirements of products of the agronegócio ;

IX-follow up and inform news of interest of Brazilian agribusiness vehicultured in the media location ;

X-organize and participate in meetings or events on matters of interest of agribusiness Brazilians ;

XI-indication and facilitate contacts with experts, importers and local authorities ; and

XII-draw up periodic reports to be submitted to the head of the diplomatic mission, to knowledge and subsequent referral to the Ministry of Agriculture, Livestock and Supply.

Art. 8th are duties of the agricultural attachus:

I-know and observe the laws and norms of the country for which it is designated ;

II-refrain from any public, written or oral manifestations, on matters concerning the Brazilian domestic and foreign policies, without the prior authorization of the head of the

III-advising, in matters of the sphere of competence of the Ministry of Agriculture, Livestock and Supply, the head of the diplomatic mission, whenever you are asked to do so ;

IV-inform the head of the diplomatic mission on all matters which, within the framework of their attributions, are relevant to the performance of the activities of the apportionment ;

V-maintain exchange of information with the relevant bodies of the country where you are accredited ;

VI-provide assistance to the servers of the Ministry of Agriculture, Livestock and Supply in the exterior, in transit or on mission of permanent or transient character ; and

VII-follow the guidelines of the Ministry of Agriculture, Livestock and Supply on the technical activities, in coordination with the Ministry of Foreign Affairs

Art. 9th The agricultural attachr, during the period in which to remain performing the mission of which treats this Decree, will be considered a member of the diplomatic mission for which it is designated.

§ 1st will be granted diplomatic passport to the agricultural attachr and its dependents.

§ 2nd The agricultural adido will be subordinate, administratively, to the head of the diplomatic mission, of who will receive instructions for their acting, and should still present their reports, provide assistance and collaboration, and, technically, to the Office of International Relations of Agronegócio of the Ministry of Agriculture, Livestock and Supply.

§ 3rd There will be no removal of agricultural attaches between outposts.

Art. 10. The agricultural attachments and its local auxiliaries will occupy office at the premises of the Brazilian diplomatic mission in the country for which they have been assigned.

§ 1st In the hypothesis of the agricultural attachable being assigned to exercise its activities together with more than one diplomatic mission, your office will be installed in the mission-headquarters.

§ 2nd The Brazilian diplomatic missions abroad will make available the necessary infrastructure for the performance of the activities of the agricultural attachant and its local auxiliaries, with the Ministry of Agriculture, Livestock and Supply the return of the resources required to the Ministry of Foreign Affairs for that purpose.

Art. 11. The agricultural attachable will be able to move away from your mission-headquarters, provided that previously authorized by the Ministry of Agriculture, Livestock and Supplies and the head of its diplomatic mission.

Art. 12. The official correspondence of the agricultural attachable will observe the prescriptions set out in Decree No 4,553 of December 27, 2002.

Single Paragraph. In the mailings with the authorities of the country where you are accredited, the agricultural attachment will observe the standards edited by the competent national authority, and must adopt language and form that meet local requirements.

Art. 13. The consideration and other rights of the agricultural attachement will be provided by the Ministry of Agriculture, Livestock and Supplies, observing the legal scheme of assignment provided for in art. 2nd, inciso II, point?b?, the provisions of the Act No. 5,809, 1972, and Decree No 71,733 of January 18, 1973, as well as the other standards governing the permanence of public servants abroad.

Single Paragraph. The Ministry of Agriculture, Livestock and Supply will provide, in the form of the current legislation, the resources necessary for the payment of administrative expenses and salaries and charges arising from the hiring of the local auxiliaries provided for in the art. 6th.

Art. 14. The holiday gozo during the mission will be limited to a period of thirty days for each year of duration, observed the interest of the service.

Single Paragraph. The server or public servant, assigned to perform the mission that it treats this Decree should enjoy, before commenting on its overseas mission, the vacation to which it makes jus.

Art. 15. You will not be granted the enjoyment of licence-award for assiduity or leave for empowerment during the period of the mission abroad.

Art. 16. Medical-hospital expenses of the agricultural attachable, as well as dependents accompanying it, will be covered by insurance-health contracted by the Ministry of Agriculture, Livestock and Supply.

Art. 17. Completed the mission deadline, the agricultural attachr will maintain its activities until its replacement takes them, unless otherwise determined.

Art. 18. Joint Act of State Ministers of Agriculture, Livestock and Supply and Foreign Affairs will establish specific standards, guidelines and procedures necessary for the application of this Decree

Art. 19. The art. 28 of Annex I of the Decree No 5,351 of January 21, 2005, passes the vigorous addition of the inciso XVII:

?XVII-coordinate, guide, inspect and evaluate the advising missions in subjects agricultural together with Brazilian diplomatic missions abroad.? (NR)

Art. 20. The art. 1st of Decree No 72,021 of March 28, 1973, passes the vigorous addition of inciso VIII:

?VIII-Ministry of Agriculture, Livestock and Supply: mission of advising on matters agricultural together with the Diplomatic Missions of Brazil in Buenos Aires, Brussels, Geneva, Moscow, Beijing, Pretoria, Tokyo and Washington.? (NR)

Art. 21. This Decree shall enter into force on the date of its publication.
