DECREE OF June 5, 2009.

Disposes about the creation of the Reservation Extractivist Renascer, in the Municipality of Pqueen, in the State of Pará, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, having and seen the provisions of the art. 18 of Law n^o 9,985, of July 18, 2000, and on Decree n^o 4,340, August 22, 2002, and the constant in the process n^o 2048.000978 /2003-10,

DECRETA:

Art. 1^o It is created the Extractive Renascer Reservation, in the Municipality of PQueen, in the State of Pará, with an approximate area of two hundred and eleven thousand, seven hundred and forty-one hectares and thirty-seven airs of terrestrial areas, on the basis of Charter SA-22-00, published by NASA/Project ZULU, at scale 1:250.000, with the following descriptive memorial: departing from Point 01, of approxic geographical coordinates 53 ° 29'54.353 "W and 1 ° 59' 23.069" S, located in the confluence of the Pará River of Urushall with the Furo Taumataí, follows on the left bank of the Furo Taumataí, its amount, by an approximate distance of 9,975.335 meters to Point 02, of approximate geographical coordinates 53 ° 25'15.398 "W and 1 ° 59' 21.504" S, located on the left bank of the said scoop ; of this one, follows by a reta of azimute 124 ° 16' 20.34 " and approximate distance of 8,579.499 meters to Point 03, of approximate geographical coordinates 53 ° 21'25.675 "W and 2 ° 01' 58.205" S, located on the left bank of the Guajr River ; of this, it follows by the left bank of the Guajr River, its amount, by a distance of 15,172.680 meters to Point 04, of approxic geographical coordinates 53 ° 16'09.121 "W and 2 ° 05' 10.689" S, located at the confluence of this river with an igarapé without denomination ; of this one, it follows by the left bank of the Guajr River, its amount, by an approximate distance of 41,986.808 meters to Point 05, of approximate geographical coordinates 53 ° 13'04.935 "W and 2 ° 22' 21.495" S, located at the confluence of the Guajr River with another igarapé without denomination ; of this one, follows by the left margin of the igarapé without denomination, its amount, by a distance of 27,249.027 metres to Point 06, of approximate geographical coordinates 53 ° 22'48.514 "W and 2 ° 30' 18.063" S, located in the spring of the said water course ; follows by a straight of azimute 264 ° 44'12 "for an approximate distance of 26,184.68 meters to Point 07, of approximate geographical coordinates 53 ° 56' 52.220" W and 2 ° 31' 34.600 " S, located in the confluence of the Pará River of Urushall with the igarapé without denomination ; of this, it follows by the right bank of the Pará River of the Urushall, its downstream, in an approximate distance of 83,537.757 metres to Point 08, of approximate geographical coordinates 53 ° 37' 43.321? S, located in the confluence of the Pará River of the Urushall with an igarapé without denomination ; of this one, it follows by the right bank of the Pará River of the Urushall, its downstream, in a distance of 23,990.935 meters to Point 01, beginning of this descriptive memorial, totaling an approxic perimeter of two hundred and forty-two thousand, five hundred and fifty-six metres and eighty-one centimetres.

Art. 2^the It is established an exclusion area within the Extraction Reservation Reborn with approximately one thousand, seven hundred and seventy and one hectare and sixty-two airs of terrestrial areas, on the basis of Charter A-22-00, corresponding to the LANDSAT project 5 and 7 (year 2000), at scale 1:250.000, published by the Institute Brazilian Geography and Statistics, with the following descriptive memorial: departing from the Marco 01, of approxic geographical coordinates 53 ° 31' 35.869? W and 2 ° 07' 09.692? S, located in the confluence of the Acarai River with the Igarapé White Water, follows on the left bank of the Acarai River, its amount, by an approximate distance of 3,480.328 meters to Marco 02, of approximate geographical coordinates 53 ° 31' 00.570? W and 2 ° 08' 44.465? S, located on the left bank of the Acarai River ; of this one, follows by a reta of azimute 232 ° 55' 08.26? and approximate distance of 2,417.815 meters up to the Marco 03, of approximate geographical coordinates 53 ° 32' 03.093? W and 2 ° 09' 31.718? S, located on the right margin of an igarapé without denomination ; of this one, it follows by the right margin of the said igarapé, its amount, by a distance of 1,338.199 metres to the Marco 04, of approxic geographical coordinates 53 ° 32' 29.963? S, located on the right margin of an affluent of the Igarapé Water Good ; of this one, follows by the right margin of the said tributary, its downstream, by an approximate distance of 3,099.534 meters to the Marco 08, of approximate geographical coordinates 53 ° 32' 29.421? W and 2 ° 07' 44.618? S, located in the confluence of the Igarapé Water Good, with an affluent without denomination ; of this one, it follows by the right margin of the Igarapé Water Good, its downstream, in a distance of 1,985.745 meters to the Marco 01, beginning of this descriptive memorial, totaling a approxic perimeter of nineteen thousand, one hundred and sixty-eight meters and sixty-six centimeters.

Art. 3^the The Extractor Reservation ora created aims to protect the means of life and ensuring the sustainable use and conservation of natural resources traditionally used by the extractivist population resident in the area of its comprehension, especially the resident communities along the Rios Pará do Uruce and Guajr.

Art. 4^o Caberá to the Chico Mendes Institute for Conservation of Biodiversity- Chico Mendes Institute to administer the Renascer Extraction Reserve, adopting the necessary measures for its deployment and control, in the terms of the arts. 18 and 23 of Law n^o 9,985, of July 18, 2000.

Single Paragraph. The organs of the Federal Public Administration will be able, in the form of the law, to firm instruments with the Chico Mendes Institute, targeting the efficiency of federal public heritage management located within the Extraction Reservation.

Art. 5^o Ficam declared of social interest, for the purposes of misappropriation, in form of Law n^o 4,132 of September 10, 1962, rural real estate of private domain legitimization and their benefits to be identified in the conservation unit ora created, for the purposes provided for in art. 18 of Law n^o 9,985, from 2000.

§ 1^o The Chico Mendes Institute is authorized to promote and execute the dispossession of which it treats this article, and may, for the purpose of immission of possession, aller the urgency to which the art refers. 15 of Decree-Law n^o 3,365, of June 21, 1941.

§ 2^o The Federal Prosecutor-General's Office, the Union Advocacy-General's Office, through its legal unit of execution with the Chico Mendes Institute, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of eventual property securities and their respective real estate records considered irregular, incidents in the conservation unit ora created.

Art. 6^o This Decree goes into effect on the date of its publication.
