Declaration of social interest, for the purposes of agrarian reform, the rural real estate named Farm Eyes D' Water of the Mosque and others, situated in the Municipality of Boa Vista of the Tupim, State of Bahia.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer him the arts. 84, caput, inciso IV, and 184, caput, of the Constitution, and in the terms of art. 2 ° of Supplementary Law No. 76 of July 6, 1993, arts.18 and 20 of Law No. 4,504 of November 30, 1964, and art. 2 ° of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1 ° Stay declared of social interest, for the purposes of agrarian reform, the rural real estate named Farm Eyes D' Water of the Mosque and others, with recorded area of a thousand and seventy-two hectares, five airs and twenty-two centiars, and measured area of a thousand, one hundred and twenty-eight hectares, forty-four airs and sixty-four centials, situated in the Municipality of Boa Vista of the Tupim, State of Bahia, object of the Registries n ° R-2-1.870, fls. 125, Book 2-G ; R-1-4,268, fls. 375, Book 2-S ; and n ° R-1-4.227, fls. 271, Book 2-S, of the Estate Registration Card of the Comarca of Itaberaba, State of Bahia (Case INCRA/SR-05/n ° 54160.003444 /2006-97).

Art. 2 ° This Decree, regardless of discrimination or collection, does not hear any particular compensation effects, in respect of areas of public domain constituted by law or registration and private domain areas harvested by nullity, prescription, common or ineffectiveness operated exclusively for the benefit of any legal person in public law, in exception of good faith benefits in them previously to the science of the commencement of the administrative procedure, excluding even from its effects the soothing, the machines and the agricultural implements and any benefactor introduced by whoever comes to benefit from its intended destination.

Art. 3 ° The National Institute of Colonization and Agrarian Reform-INCRA, attested to the private dominial legitimacy of the mentioned planimeter area, is authorized to promote the dispossession of the rural real estate that it treats this Decree, in the manner provided for in the Act Add-on No 76 of July 6, 1993 and to maintain the areas of Legal Reserve and permanent preservation provided for in Law No. 12,651 of May 25, 2012, preferably in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4 ° This Decree goes into effect on the date of its publication.
