DECREE OF February 13, 2006.

Cria the National Forest of the Trairal, nos Municipalities of Rurópolis, Trashall and Itaituba, in the State of Pará, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 17 of Law No 9,985 of July 18, 2000, and what is stated in the Process at 02001.005847 /2005-19,

DECRETA:

Art. 1º It is created, in the State of Pará, in the Municipalities of Rurópolis, Trashall and Itaituba, the National Forest of the Trawill, with the basic objectives of promoting the sustainable multiple use manejo of forest resources, maintenance and protection of the water resources and biodiversity, as well as support for the development of methods of sustainable exploitation of natural resources.

Art. 2º The National Trait Forest has an approximate area of 257,482 ha (two hundred and fifty and seven thousand, four hundred and eighty-two hectares), as per the following descriptive memorial and perimeter: begins the description of this memorial to depart of section 1, located in the confluence of the undenominational tributary of the Itapacura-Mirim; River of point 1, of c.g.a. 55o46'8.87 "W and 4o54' 41.08" S, proceeds downstream by the left bank of the Itapacura-Mirim River to section 2 ; from point 2, from c.g.a. 55o48' 5.51 "W and 4o51'39.85" S, follows in straight line up to section 3, located in the undenominational tributary of the Itapacura-Mirim; Rio Itapacuri River ; from point 3, from c.g.a. 55o46'7.86 "W and 4o49' 52.18" S, proceeds upstream by the right margin of the said tax up to point 4 ; from point 4, from c.g.a. 55o45'8.76 "W and 4o49' 49.68" S, follows in straight line up to section 5, located in the undenominational tributary of the Itapacura-Mirim; River of point 5, of c.g.a. 55o43'45.29 "W and 4o48' 0.87" S, follows in straight line up to section 6, located in the undenominational tributary source of the Itapacurá River ; from point 6, from c.g.a. 55o40'59.12 "W and 4o46' 32.81" S, proceeds downstream by the left margin of the tax referred to section 7, located in the confluence of the Itapecurá River with no-denomination tributary ; from point 7, of c.g.a. 55o36' 18.97 "W and 4o41'28.21" S, follows in straight line up to section 8, located in drainage without denomination ; from point 8, from c.g.a. 55o36'33.96 "W and 4o37' 48.93" S, proceeds downstream by the left margin of this drainage up to point 9, located in the confluence of undenominational drains ; from point 9, from c.g.a. 55o37'47.78 "W and 4o34' 17.33" S, proceeds upstream by one of the undenominational drains up to point 10, located in the municipal divisa of Itaituba with Ruropolis ; from point 10, from c.g.a. 55o32'20.81 "W and 4o33' 43.27" S, follows in straight line up to section 11, located in the nascent tributary without denomination of the Cupari River ; from point 13, of c.g.a. 55o28'21.51 "W and 4o33' 3.85" S, proceeds downstream by the left bank of the Igarapé Santa Cruz to section 14, at the confluence of the Igarapé Santa Cruz with undenominational tax ; from point 14, from c.g.a. 55o26'10.67 "W and 4o30' 12.42" S, proceeds upstream by undenomination drainage up to section 15, located in confluence of undenominational drains ; from point 15, from c.g.a. 55o24'3.53 "W and 4o30' 2.77" S, follows upstream by the right margin of the drainage without denomination to section 16, at the source of the said drainage ; from point 27, from c.g.a. 55o13'57.90 "W and 4o27' 56.20" S, proceeds upstream by the right margin of the River Cupari Braço East to section 28, at the confluence of the East Cupari Braço River with non-denomination tributary ; from point 28, from c.g.a. 55o8'59.21 "W and 4o33' 56.30" S, follows upstream by the right margin of the said tax until point 29, located in the nascent of this tax ; from point 29, from c.g.a. 55o8'20.11 "W and 4o36' 45.94" S, follows in straight line up to section 30, located in the municipal currency of Rurópolis with Altamira and perimeter of the Extractive Reservation Riozinho of the Anfrísio (Decree of November 8, 2004) ; from point 30, of c.g.a. 55o8'11.58 "W and 4o36' 48.13" S, proceeds by the delimitation of the mentioned conservation unit up to section 31, located in the municipal divisa of Itaituba, Rurópolis and Itaituba and Extractive Reserves Riozinho of the Anfrísio ; from point 31, of c.g.a. 55o29'50.10 "W and 4o37' 12.28" S, proceeds by the delimitation of the unit mentioned up to section 32, located in the municipal divisa of Itaituba with Trairão Itaituba and Extractive Reservation Riozinho of the Anfrísio ; from point 32, of c.g.a. 55o28'56.29 "W and 4o44' 7.27" S, proceeds by the delimitation of the mentioned unit follows up to section 33 ; from point 33, from c.g.a. 55o21'10.06 "W and 5o2' 29.16" S, follows in straight line up to section 34, located in the spring of the White River ; from point 37, from c.g.a. 55o55'10.96 "W and 5o9' 13.46" S, proceeds downstream by the left margin of the tax referred to section 38, in the confluence of this tributary with the Tucunaré River ; from point 38, from c.g.a. 55o57'3.10 "W and 5o6' 13.03" S, proceeds downstream by the left bank of the Tucunaré River to section 39, located in the confluence of the Tucunaré River with undenominational tributary ; from point 39, from c.g.a. 55o56'43.55 "W and 5o0' 6.12" S, proceeds upstream by the right margin of this tributary to point 40 ; from point 40, from c.g.a. 55o50'4.67 "W and 4o58' 5.87" S, follows in straight line up to section 41, located in the non-denomination tributary of the Itapacura-Mirim; River of point 41, of c.g.a. 55o48'22.86 "W and 4o58' 5.92" S, proceeds downstream by the left margin of the tax mentioned up to point 1, beginning of the description of this descriptive memorial.

Art. 3º The Union lands inserted into the limits of the National Forest of the Trairal, of which it treats art. 2nd, will be the subject of assignment of use, and the Brazilian Institute of Environment and Renewable Natural Resources-IBAMA shall provide the respective contracts for the purpose of their celebration by the Office of the Heritage of the Union of the Ministry of the Planning, Budget and Management, and monitor compliance with the conditions in them stipulated in the form of the law.

Art. 4º Stay declared for social interest, for the purposes of dispropriation by IBAMA, the existing private rural real estate within the limits described in art. 2nd of this Decree, in the terms of the art. 5th, point "k", and 6th of Decree-Law No 3,365 of June 21, 1941.

Single Paragraph. The Advocacy-General of the Union, through its legal unit of implementation with the IBAMA, is authorized to promote the relevant administrative and judicial measures, seeking the declaration of nullity of possible property securities and respective real estate records deemed irregular, incidents in the conservation unit of which treats this Decree.

Art. 5º It Will Be for IBAMA to administer the National Forest of the Trairal, adopting the necessary measures to its effective protection and deployment.

Art. 6º This Decree shall enter into force on the date of its publication.
