Decree No. 5353 of 24 JANUARY 2005 on the jurisdiction, composition, functioning and structure of the National Council of Industrial Development-CNBDI, and other matters.
The PRESIDENT of the REPUBLIC, in the use of the role that gives the art. 84, subparagraphs IV and VI, paragraph a, of the Constitution, and in view of the provisions of art. 18 of law No. 11080, of 30 December 2004, DECREES: Art. 1 the National Council of Industrial Development-CNBDI, collegial body, linked to the Presidency of the Republic, has the assignment to propose to the President of the Republic national policies and specific measures to promote the industrial development of the country.
Art. 2nd the CNBDI: I-subsidize upon propositions submitted to the Presidency of the Republic, the formulation and implementation of public policies aimed at industrial development, in line with the policies of foreign trade and of science and technology, so as to comply with, among others: a) to the development and promotion of industrial production;
b) infrastructure activities to support the production and marketing;
c) the standardization of measures allowing greater competitiveness of enterprises in the industrial sector.
d) more consistent and lasting financing of entrepreneurial activities; and e) to maintain, in conjunction with the States, the Federal District and the municipalities, effective and sustainable programs of industrial development, trade and science and technology;
II-propose goals and priorities of Government regarding Industrial Policy, technology and foreign trade (PITCE), indicating the respective means and resources to achieve them with the specifications of instruments;
III-proposing strategies for monitoring, tracking and evaluation of PITCE, as well as participation in the decision-making process, qualified agents to formulate policies related to the development and industrial development; and IV-propose the realization of studies, debates and research on the implementation and the results achieved by strategic programs developed by the Government in the areas of industrial development, foreign trade and science and technology.
Art. 3 the CNBDI shall be composed of fourteen members, who represent civil society, and by the following Ministers of State and President of entity: I-the development, industry and foreign trade;
II-Chief of staff of the Presidency of the Republic;
III-science and technology;
V-of Foreign Affairs;
I saw the planning, budgeting and management;
VII-of national integration;
IX-mines and energy;
X-agriculture, livestock and food supply;
XI-of labor and employment;
XIII-Chief of the General Secretariat of the Presidency of the Republic; and XIV-Banco Nacional de Desenvolvimento Econômico e Social-BNDES.
§1 the CNBDI is chaired by State Minister of development, industry and foreign trade.
(2) The civil society representatives of the caput shall be appointed by the President of the Republic, for a period of two years, allowed the renewal.
paragraph 3 May be invited to attend the meetings of CNBDI, without voting rights, holders of other bodies or public or private entities, as well as people representing civil society, whenever matters of the agenda appear in your area of practice, or the judgment of the President of the Council.
§ 4 the CNBDI shall decide upon resolutions, by absolute majority, obeying the minimum quorum of two thirds of its members, and the President has a casting vote.
§ 5 the internal rules and the additional rules will be submitted to CNBDI, upon a proposal by the Ministry of development, industry and foreign trade, and approved by an absolute majority.
paragraph 6 CNBDI meetings shall be convened by the Minister of development, industry and foreign trade, in advance of 15 days.
Art. 4 the CNBDI will feature an Executive Secretariat, to be exercised by administrative unit among those existing in the structure of the Ministry of development, industry and foreign trade, with the following tasks:-promote the administrative support and the necessary resources for carrying out the work of CNBDI;
II. direct assistance to the President of CNBDI;
III-preparing meetings of CNBDI, as well as to cultivate their respective acts;
IV-prepare and maintain the file CNBDI documentation; and V-follow the progress and implementation of the propositions CNBDI, forwarded to competent bodies.
Art. 5th CNBDI members won't notice remuneration for the performance of the functions of Directors, considering how relevant public services.
Art. 6. This Decree shall enter into force on the date of its publication.
