Decree No. 5079, of 11 MAY 2004 on the composition, structure, competence and functioning of the National Council of food and nutrition security-CONSEA, and other matters.
The PRESIDENT of the REPUBLIC, in the use of the powers conferred. 84, subparagraphs IV and VI, paragraph a, of the Constitution, and in view of the provisions of the sole paragraph of art. 30 of law No. 10683 of 28 May 2003, DECREES: Art. 1 the National Council of food and nutrition security-CONSEA, advisory body to the President of the Republic immediately, aims to propose the formulation of public policies and guidelines for national policy on food and nutritional security of the Federal Government.
Art. 2nd The CONSEA competes: I-advising the President of the Republic on the formulation of policies aimed at integrating governmental actions to guarantee the human right to food;
II-to propose and comment on: a) the guidelines of the national policy on food and nutritional security, to be implemented by the ministries, secretariats and other bodies and entities executors of that policy;
b) projects and priority actions of the national policy on food and nutritional security, included in the Multi-annual Plan of Government;
c) ways to articulate and mobilize civil society organized within the framework of the national policy on food and nutritional security, establishing priority indications; and (d)) to conduct studies to support the proposals linked to food and nutritional security.
III-propose monitoring strategies, monitoring and evaluation, as well as to participate in the deliberative process of policy guidelines and procedures related to food and nutritional security in the national territory;
IV-stimulate the expansion and improvement of mechanisms for participation and social control, through a national network of collegiate bodies State, regional and local, to strengthen the development of the activities of food and nutritional security;
V-promote and organize the implementation of National Conference on food and nutritional security;
VI-propose the update of legislation related to the development and promotion of food and nutritional security;
VII-set guidelines and programmes of action of the Board; and VIII-draw up its rules of procedure and proposals for amendments.
Sole paragraph. CONSEA will stimulate the creation of State and municipal councils on food and nutritional security, which will maintain close relations of cooperation, especially in relation to the actions defined as priorities under the National Policy on food and nutritional security.
Art. 3rd CONSEA shall consist of 42 members, appointed by the President of the Republic, who represent civil society, and by the following Ministers of State, Secretaries and chief aide of the President of the Republic's Special Advisory: I-of Social development and fight against hunger;
II-agriculture, livestock and food supply;
III-the cities;
IV-of agrarian development;
V-education;
I saw on the farm;
VII-the environment;
VIII-the planning, budgeting and management;
IX-health;
X-of labor and employment;
XI-of national integration;
XII-head of the General Secretariat of the Presidency of the Republic;
XIII-the Special Secretariat of Aquaculture and fisheries of the Presidency of the Republic;
XIV-the Special Secretariat of policies for women of the Presidency of the Republic;
XV-the Special Secretariat for human rights of the Presidency of the Republic;
XVI-the Special Secretariat for policies to promote Racial Equality of the Presidency of the Republic; and XVII-the Chief Adviser of the Special Assistance of the Presidency of the Republic.
§1 the CONSEA will be chaired by one of the representatives of civil society members, appointed by the President of the Republic, and the Minister of State Secretariat of Social development and fight against hunger.
§ 2 the representatives of civil society, of which this is the caput, will have two-year term, allowed the renewal.
paragraph 3 May be invited to attend the meetings of CONSEA, without voting rights, holders of other organs or public authorities, as well as people representing civil society, whenever matters of the agenda appear in your area of practice, or the judgment of his President.
§ 4 the CONSEA will have as permanent guests, observers, representatives of the following organs and entities: I-Council for economic and Social development;
II-National Council for sustainable Rural Development;
III-Intersectoral food and Nutrition Commission;
IV. United Nations Development Programme-UNDP;
V-United Nations Children's Fund-UNICEF;
VI-the United Nations food and Agriculture Organization-FAO;
VII-United Nations Educational, scientific and Cultural Organization-UNESCO;
VIII-International Labour Organization-ILO;
IX-International Bank for reconstruction and development-IBRD;
X-inter-American Development Bank;
XI-National Silverware;
XII-National Report of the human right to food;
XIII-Brazilian Association of Municipalities;
XIV-National Confederation of Municipalities; XV National Front Mayors.
§ 5 participation in CONSEA will be considered relevant, unpaid public service.
Art. 4th CONSEA will feature themed permanent cameras, as established in the rules of procedure, which will prepare the proposals to be examined by him.
§1 The thematic Chambers shall be composed of Directors designated by the Chairman of CONSEA, in compliance with the conditions laid down in the internal regulations, as well as Government technicians working in areas in which they are applied.
§ 2 in the drafting of the proposals to be submitted to the plenary of CONSEA, thematic cameras may invite representatives of civil society entities and organs and public entities.
§ 3 each Chamber must have a Thematic Coordinator chosen from civil society advisors and a Secretary tied to government agency.
Art. 5th CONSEA may establish working groups, temporary, to study and propose specific measures.
Art. 6 the Chairman of CONSEA, the thematic Chambers and the working groups will have the administrative and technical support of the Ministry of Social development and fight against hunger.
Art. 7 the internal rules of CONSEA shall be approved by the Minister of State Chief of staff of the Presidency of the Republic.
Art. 8 for the fulfilment of its functions, the CONSEA will feature budget and financial resources contained in the budget of the Civil House of the Presidency of the Republic.
Art. 9 this Decree shall enter into force on the date of its publication.
Art. 10. Is repealed Decree No. 4582, of 30 January 2003.
