DECREE OF September 26, 2007.

Creates the Extractive Reserve Clean, located in the Municipality of Chapadinha, State of the Maranhão, and gives other providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the provisions of art. 18 of Law No 9,985 of July 18, 2000, and what is stated in the Process at 02012.000103 /2006-60,

DECRETA:

Art. 2nd The Clean Chaped Extractive Reserve is aimed at protecting the means of life and guarantee the use and conservation of renewable natural resources traditionally used by the extractivist population resident in the area of their comprehension.

Art. 3rd Caberá to the Chico Mendes Institute for Conservation of Biodiversity-Chico Institute Mendes administer the Clean Extractive Reserve, adopting the necessary measures for their deployment and control, in the terms of the art. 18 of Law No 9,985 of July 18, 2000, providing the contract for the granting of royal duty free of charge with the traditional extraction population, and to monitor compliance with the conditions in it stipulated in the form of the law.

Art. 4th Ficam declared of social interest, for the purposes of dispropriation, in the form of the Act in the 4,132, of September 10, 1962, rural real estate of legitimate private domain and their benefits that come to be identified within the limits of the Clean Sheet Extractive Reserve, for the purposes provided for in art. 18 of Law No. 9,985, 2000.

§ 1st The Chico Mendes Institute is allowed to promote and execute the dispossession that it treats the caput of this article, and may, for the purpose of immission in possession, aller the urgency to which the art is referred. 15 of Decree-Law No 3,365 of June 21, 1941.

§ 2nd The Federal Prosecutor-General's Office, the body of the Union Advocate-General, through its unit legal implementation with the Chico Mendes Institute, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of eventual property securities and respective real estate records considered irregular, incidents in the Extractive Reserve Clear.

Art. 5th This Decree goes into effect on the date of its publication.
