PROVISIONAL MEASURE # 68, OF September 4, 2002

Altera the Leis n 10,209, of March 23 2001, and 10,233, of June 5, 2001, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 62 of the Constitution, adopts the following Interim Measure, with force of law:

Art. 1º The Law # 10,209, of March 23, 2001, passes vigorously with the following changes:

Single Paragraph. The value of the Valley-compulsory toll and the data of the own model, necessary for its identification, should be highlighted in specific field in the comprobatory landing document.? (NR)

?Art. 3º As of October 25, 2002, the shipper will pass anticipation of the Valley-compulsory toll on the carrier, on own model, regardless of the value of the freight, re-salvaged the provisions of § 5º of this article.

§ 6º Until the October 15, 2002, the highway dealerships that practice toll collection will inform the National Transportation Agency Terrestrial-ANTT the very own model of Vale-compulsory toll, usable on all national highways, which are making available to the interested and the places in which they can be acquired.

?Art. 6º Compete for ANTT the adoption of the measures indispensable to the deployment of the Valley-compulsory toll, regulation, coordination, delegation and supervision, processing and application of penalties for infractions to this Act.

§ 2º ANTT compels to provide the organs or the entities that it treats § 1, by providing them with necessary and up-to-date elements.? (NR)

?Art. 7º Should the Ministry of Labour and Employment come to exercise, by delegation and decentralisation, the activities inherent in ANTT, the values raised, arising from the fines imposed by it, will constitute additional revenue from the Amparo Fund to the Worker-FAT, of which it treats Law No. 7,998 of January 11, 1990.? ?Art. 9º-A. ANTT will articulate with states and Municipalities that directly operate highways with toll, or through concessions, with a view to the implementation of the provisions of this Act in their acting spheres.? (NR)

Art. 2º The Law # 10,233, of June 5, 2001, passes vigorously with the following changes:

XVII-exercise, directly or upon convenium, the skills expressed in the inciso VIII of the art. 21 of Law No. 9,503 of September 23, 1997-Brazilian Transit Code, on the federal highways by it administered.

§ 1º The assignments to which the caput refers does not apply to the elements of the infrastructure granted or leased by ANTT and ANTAQ.

§ 3º It is, still, attribution of DNIT, in its sphere of acting, exercise, directly or upon convengen, the skills expressed in art. 21 of Law No. 9,503, 1997, observed the provisions of the inciso XVII of the art. 24 of this Act.? (NR)

Art. 3º This Measage Provisional shall enter into force on the date of its publication.

Art. 4º It is revoked the art. 4º of Law No. 10,209 of March 23, 2001.
