DECREE No. 6690, OF 11 DECEMBER 2008
Establishes the License Extension Program for Pregnant and adopters, establishes the criteria for joining the program and other measures.
The PRESIDENT OF THE REPUBLIC, using the powers conferred upon him by art. 84, item IV of the Constitution, and in view of the provisions of art. 2 of Law No. 11.770, of September 9, 2008, DECREES
Art. 1 is instituted within the direct federal public administration, autonomous agencies and foundations, the License Extension Program for Pregnant and adopters.
Art. 2nd will be benefited by the Extension Program License to pregnant women and the adopter the crowded federal public servants or exercise in the organs and entities of the direct federal public administration, autonomous agencies and foundations.
§ 1 The extension will be granted to the public network that requires the benefit to the end of the first month after birth and will last sixty days.
§ 2 The extension referred to in § 1 shall commence on the following day at the end of the license term provided for in art. 207 of Law 8,112 of December 11, 1990, or benefit referred to in art. 71 of Law 8213 of 24 July 1991.
§ 3 The benefit they are entitled to public servants mentioned in the caput will also be guaranteed to those who adopt or obtain legal custody for child adoption purposes, in the following proportions :
I - for public servants in the enjoyment of the benefit referred to in art. 71-A of Law No. 8213, 1991:
a) sixty days, in the case of children under one year of age;
B) thirty days, the child if more than one and less than four years old;
and c) fifteen days in a child case of four to eight years.
II - for public servants in the enjoyment of the benefit referred to in art. 210 of Law No. 8112, 1990:
a) forty-five days in the case of children under one year of age;
and b) fifteen days in a child case more than one year of age.
§ 4 For the purposes of § 3, clause II, item? B ?, considered child a person up to twelve years of age incomplete, pursuant to art. 2 of Law No. 8069 of 13 July 1990.
§ 5 The extension of the license will be funded using the National Treasury.
Art. In the third maternity leave period and the adopter of this Decree, public servants referred to in art. 2 may not engage in any gainful activity and the child can not be kept in child care or similar organization.
Sole paragraph. In the event of any of the situations referred to above, the beneficiary will lose the right to extend, subject to due compensation to the public treasury.
Art. 4th servant on maternity leave enjoyment of the date of publication of this Decree may request the extension of the license as long as required within thirty days after that date.
Art. 5 This Act applies to public servant who has your maternity leave period completed between September 10, 2008 and the date of publication of this Decree.
Sole paragraph. The public servant mentioned in the caput shall be entitled to the enjoyment of the license for the days corresponding to the extension, as appropriate.
Art. 6. The Ministry of Planning, Budget and Management may issue additional rules for implementation of this Decree.
Art. 7 This Decree shall enter into force on the date of its publication.
