DECREE NO 4,005, DE November 12, 2001

Disposal on the execution of the Quadragtieth Nono Additional Protocol to the Economic Supplementation Agreement No. 2 (automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, July 31 of 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers you the art. 84, inciso IV, of the Constitution,

Considering that the 1980 Treaty of Montevideo, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980 and approved by the National Congress, through Legislative Decree No. 66, of November 16, 1981, provides for the modality of Economic Supplementation Agreement ;

Considering that the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the 1980 Treaty of Montevideo, signed, on December 20, 1982, in Montevideo, the Supplementation Agreement Economic paragraph 2, between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, which has been incorporated into the Brazilian legal order by means of Decree No 88,419 of June 20, 1983 ;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the Treaty of Montevideo of 1980, signed on July 31, 2001, in Montevideo, the Quadragenth Nono Protocol Additional to the Economic Supplementation Agreement No. 2 (automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay ;

D E C R E T A:

Art. 1º It is promulgated, for all purposes, the Quadragenth Nono Additional Protocol to the Economic Supplementation Agreement No. 2 (automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, apensed by copy to the present Decree.

Art. 2º This Decree goes into effect on the date of its publication.

Economic Supplementation Agreement No. 2 concluded between the Federative Republic of Brazil AND The Eastern Republic of Uruguay

Quadrageth Nono Additional Protocol

The Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, accredited by their respective Governments under powers that have been bestowed in good and due form, deposited expeditiously in the Secretarial-General of the Latin American Integration Association (ALADI),

Concoming in:

Article 1º-The Federative Republic of Brazil outorates to the Eastern Republic of Uruguay, for the period from 1º until August 31, 2001, a share of one thousand and eighty-four units of automotive vehicles, classified in the positions NALADI/SH 87.02, 87.03 and 87.04, for any category.

Article 2º-The Eastern Republic of Uruguay outorga to the Federative Republic of Brazil, for the period from 1º until August 31, 2001, a quota of three hundred and thirty-four units of automotive vehicles, classified in the positions NALADI/SH 87.03 and 87.04, for units up to 4,000 kg total gross weight.

Article 3º-The units of automotive vehicles, constants of the quotas outwarded by the Federative Republic of Brazil and the Eastern Republic of Uruguay in the Twenty-Seventh, Twentieth Eighth, Twentieth Nineteenth, Thirtieth, Thirtieth First, Thirtieth Second, Thirtieth Third, Thirty-fifth, Thirtieth Seventh, Thirtieth Ninth, Quadrageth First, Quadragential Third, Quadragth Fifth and Quadragtieth 7th Additional Protocols, which were not used in the period of 1º from January 2000 until July 31, 2001, they may be availed in the period from 1º until August 31, 2001, without prejudice to the quotas set forth in Articles 1º and 2º of this Protocol.

Article 4º-Fixed as source standard 60/40% for the models in production and 55/45% for the new models.

Article 5º-The percentage of parts of regional origin applicable to the models in production, under Article 4º of the Seventeenth Additional Protocol to ACE No. 2, will be 25%.

Article 6º-This Protocol has been in force since 1º from August 2001 until August 31, 2001. However, shall it lapse at the time of entry into force of the?Agreement on the Automotive Policy of Mercosur?.

The General Secretariat of ALADI shall be depositary of this Protocol, of which it shall send duly authenticated copies to the signatory Governments.

In faith than, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the thirty-one days of the month of July two thousand and one, in an original in the Portuguese and Spanish languages, both of which are texts equally valid.
