DECREE OF December 12, 2005.

Declaration of social interest, for the purposes of agrarian reform, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184, of the Constitution, and in the terms of the arts. 2nd of the Supplementary Law no 76, July 6, 1993, 18 and 20 of the Act No 4,504 of November 30, 1964 and 2nd of the Act No 8,629 of February 25, 1993,

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law No 4,504 of November 30, 1964, and 2nd of the Law No 8,629 of February 25, 1993, the following rural real estate:

I-"Diamond Farm", with area of three thousand, seishundred and thirty-one hectares and thirty ares, situated in the Municipalities of Marco and Morrinhos, object of Registration No 22, fls. 22, Book 2, of the Estate Registration Card of the Comarch of Marco, State of Ceará (Process INCRA/SR-02/no 54130.002051 /2003-71) ;

II-"Fazenda Corrego Novo", with area of one thousand and seven hundred hectares, situated in the Municipalities of Acaraú and Itarema, object of the Registration in R-1-2.489, fls. 126, Book 2-I, of the Estate Registration Card of the Acaraú Comarch, State of Ceará (Process INCRA/SR-02/no 54130.001468 /2004-05) ;

IX-"Fazenda Jacuípe and Rumo Torto", with area of one thousand, one hundred and nineteen hectares and ninety ares, situated in the Municipality of Parnamirim, object of Registration No 3,606, fls. 11, Book 2-O, of the Estate Registration Office of the Parnamirim Comarch, State of Pernambuco (Processo/INCRA/SR-29/no 54141.000527 /2005-71) ;

X-"Fazenda Hills", with area of a thousand, two hundred and seventy-seventh hectares, situated in the Municipalities of Granite and Parnamirim, the object of Registration No 2,714, fls. 01, Book 2-J, of the Estate Registration Office of the Bodocó Comarca, State of Pernambuco (Processo/INCRA/SR-29/no 54141.000502 /2005-78) ; and

XI-"Farm Timber", with area of three hundred and fifty five hectares and forty and four ares, situated in the Municipality of Japoatã, object of the Registration in the R-4-5.402, fls. 259, Book 2-H, of the Estate Registration Office of the Comarca of Neópolis, State of Sergipe (Processo/INCRA/SR-23/no 54370.000850 /2004-61).

Art. 2º Delete from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in art. First and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute for Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Law no 76 of July 6, 1993, and to maintain the areas of Legal reservation and permanent preservation provided for in Law No 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree shall enter into force on the date of its publication.
