DECREE NO 6,540, DE August 19, 2008.

Altera and add devices to the Decree n° 4,376 of September 13, 2002, which has had on the organization and operation of the Brazilian Intelligence System, instituted by Law n° 9,883 of December 7, 1999.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, paragraph "a", of the Constitution, and in view of the provisions of Law n^o 9,883 of December 7, 1999,

DECRETA:

Art. 1^o The art. 4^o of Decree n^o 4,376, of September 13, 2002, passes vigorously with the following essay:

IV-Ministry of Justice, by means of National Public Security Secretary, the Police Intelligence Directorate of the Federal Police Department, the Federal Highway Police Department, the National Penitentiary Department and the Asset Recovery Department and International Legal Cooperation, the National Bureau of Justice ;

Art. 2^o Decree n^o 4,376, of 2002, passes the vigorous addition of the following art. 6^o-A:

?Art. 6^o-A. ABIN will be able to maintain, in permanent character, representatives of the components of the components of the Brazilian System of Intelligence in the Department of Integration of the Brazilian Intelligence System.

§ 1^o For the purposes of the caput, the ABIN may require the integral organs of the Brazilian System of Intelligence to designate representatives to act in the Department of Integration of the Brazilian Intelligence System.

§ 2^o The Department of Integration of the Brazilian Intelligence System will have for attribution to coordinate the articulation of the flow of data and timely information and interest in the State Intelligence activity, with the purpose of subsidizing the President of the Republic in his / her process decision.

§ 3^o The representatives that treats the caput will greet expedient in the Integration Center of the Department of Integration of the ABIN Brazilian System of Intelligence, staying waived from the exercise of the usual assignments in the home organ and working in regime permanent availability, in the form of the provisions of the internal regiment of ABIN, to be proposed by its Director-General and approved by the Chief Minister Head of the Office of Institutional Security of the Presidency of the Republic.

§ 4^o The mentioned representatives in the caput will be able to access, by means of electronic, the databases of their organs of origin, respected the standards and limits of each institution and the legal standards pertinent to security, professional secrecy and safeguarding of subjects Sigilous.? Art. 3^o This Decree goes into effect on the date of its publication.

Art. 4^o Stay revoked the Decrees n^the 5,388, of March 7, 2005, and 5,525, of August 25, 2005.
