DECREE NO 3,370, DE February 23, 2000.

Approves the Regimental Framework and the Demonstrative Framework of the Cargos in Commission and Gratified Functions of the National Institute of Metrology, Normalization and Industrial Quality-INMETRO, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, of the Constitution,

Decreta:

Art. 1º Stay approved the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and Gratified Functions of the National Institute of Metrology, Normalization and Industrial Quality-INMETRO, in the form of Annexes I and II to this Decree.

Art. 2º As a result of the provisions of the preceding article, the following posts shall be remanded in Committee of the Group-Direction and Superiors-DAS and Gratified Functions-FG:

I-from the Office of Management, Ministry of Planning, Budget and Management, coming from extinct organs of the Federal Public Administration, to INMETRO, a DAS 101.5 and a DAS 102.4 ; and

II-from the INMETRO to the Management Registry, Ministry of Planning, Budget and Management, a DAS 101.4 ; two FG-1 ; thirteen FG-2 ; and six FG-3.

Art. 3º The apostillations arising from the approval of the Regimental Structure of which it treats the art. 1º should occur within twenty days, counted from the date of publication of this Decree.

Single Paragraph. After the apostillations provided for in the caput of this article, the INMETRE shall publish, in the JournalOfficial of the Union, within thirty days, counted from the date of publication of this Decree, the nominal relationship of the holders of the posts in Committee of the Group-Direction and Superiors-DAS referred to in Annex II, indicating, inclusive, the number of vacant posts, their denomination and the respective level.

Art. 4º The Internal Rules of the INMETER shall be approved by the Minister of State for Development, Industry and Foreign Trade and published in the JournalOfficial of the Union, within ninety days, counted from the date of publication of this Decree.

Art. 5º This Decree shall enter into force on the date of its publication.

Art. 6º Stay revoked the Decree No. 10 of January 16, 1991 ; the Annex?L? to Decree No 1,351 of December 28, 1994 ; and Annex II to Decree No 2,600 of May 19, 1998.

ANNEX I

REGIMENTAL STRUCTURE OF THE NATIONAL INSTITUTE OF METROLOGY, STANDARDIZATION AND INDUSTRIAL QUALITY-INMETRO

Chapter I

OF NATURE AND COMPETENCE

Art. 1º The National Institute of Metrology, Normalization and Industrial Quality INMETRE, federal municipality created by art. 4º of Law No. 5,966 of December 11, 1973, based in Brasilia-DF, linked to the Ministry of Development, Industry and Foreign Trade, is the central executive body of the National System of Metrology, Normalization and Industrial Quality- SINMETER, and has for purposes:

I-run national metrology and quality policies ;

II-check compliance with technical and legal standards, with regard to medium units, measurement methods, materialized measures, measuring instruments and pre-medidal products ;

III-maintain and conserve the standards of the units of measurement, as well as deploy and maintain the traceability chain of the standards of the measurement units in the Country, so as to make them harmonic internally and compatible in the plan international, targeting, at a primary level, its universal acceptance and, at secondary level, its use as a support for the productive sector, with views on the quality of goods and services ;

IV-strengthen Country participation in international activities related to metrology and quality, in addition to promoting the exchange with foreign and international entities and bodies ;

V-provide technical and administrative support to the National Council of Metrology, Normalization and Industrial Quality-CONMETRO, as well as to its advisory committees, acting as its Secretariat-Executiva;

VI-fomenting the use of quality management technique in Brazilian companies ;

VII-plan and execute the accreditation activities of calibration and testing labs, proficiency testing providers, certification, inspection, training, and other required testing bodies. development of the technological services infrastructure in the Country ; and

VIII-coordinate, within the framework of SINMETRO, compulsory and voluntary certification of products, processes, services, and voluntary personnel certification.

Chapter II

DA ORGANIZATIONAL STRUCTURE

Art. 2º INMETRO has the following Organizational Framework:

I-bodies of direct and immediate assistance to the President:

a) Director-Executiva;

b) Cabinet ;

c) Legal Prosecutor's Office ; and

d) Coordination-General of International Articulation ;

II-sectional bodies:

a) Coordination-General Planning ;

b) Directorate of Administration and Finance ; and

c) Auditing ;

III-singular specific organs:

a) Credential and Quality Directorate ;

b) Directorate of Scientific and Industrial Metrology ; and

c) Directorate of Legal Metrology ; and

IV-decentralized bodies: Superintendencies.

Single Paragraph. The President of the INMETRO shall be appointed by the President of the Republic.

Chapter III

DAS ATTRIBUTIONS OF ORGANS

I Section

of the Direct and Immediate Care Bodies to the President

Art. 3º The Cabinet rests:

I-watch the President in his social and political representation ;

II-to be entrusted with the preparation and dispatching of your personal expedient ;

III-to monitor the tramway of the legal acts of interest of Autarquia ;

IV-coordinate social communication and technical cooperation activities ;

V-arrange for the publication and dissemination of the subjects of interest of the INMETRE ; and

VI-provide technical-administrative support to the President of INMETRO, in the capacity of Executive Secretary of the National Council of Metrology, Normalization and Industrial Quality-CONMETRO.

Art. 4º To The Legal Procuratorate, the body linked to the Advocacy-General of the Union, it is up to:

I-exercise the judicial and extrajudicial representation of Autarquia, acting in the processes in which the same is author, ré, opponent or assistant ;

II-comply with and ensure compliance with the normative guidelines emanating from the central and sectoral bodies of the Advocacy-General of the Union ;

III-provide direct and immediate advice to the President and the member bodies of the INMETRE Regimental Structure, in the matters of a legal nature, applying, in what couber, the provisions of the art. 11 of Supplementary Law No. 73 of February 10, 1993 ;

IV-examine, approve and draw up minutes of tender editions, contract instruments, arrangements and other acts creators of rights and obligations, which should be concluded by Autarquia ;

V-analyse and present solutions on issues raised by the application of the laws and regulations concerning the activities developed by INMETRO ;

VI-examine and issue opinions on projects of normative acts to be exclaims or proposed by Autarquia when they contain legal matters ; and

VII-the ascertaining of the liquidity and certainty of the credits of any nature, inherent in the activities of the INMETRE, enrolling them into active debt, for the purposes of amicable or judicial collection.

Art. 5º The Coordination-General of International Articulation rests:

I-coordinate, plan, articulate, and promote the activities aimed at the international relationship of INMETRO ;

II-coordinate, promote and monitor negotiations for celebration of arrangements, agreements and contracts, in addition to INMETRE participation in international events ;

III-supervise and monitor the realization of technical and exchange cooperation programmes, with international and foreign organizations, in the areas of metrology, standardization and industrial quality, including for development of human resources ;

IV-propose, coordinate and monitor, in articulation with the various areas of INMETRO, the allocation of the resources indispensable to the fulfilment of international commitments ; and

V-coordinate, within the framework of Autarquia, international, technical-commercial negotiations involving the areas of metrology, standardization and industrial quality.

Section II

Of Sectional Organs

Art. 6º To the Coordination-General Planning is to coordinate, direct, supervise, promote, monitor and evaluate the execution of planning activities, budget, informatics, administrative modernization, realization of nature works statistical and, specifically:

I-provide the Autarquia of the means necessary to achieve the efficiency, effectiveness and effectiveness of its services ;

II-coordinate the process of strategic planning and unfolding of the Autarquia mission, in guidelines, objectives, goals and plans ;

III-subsidizing INMETRE Directors in the planning of the actions and in the execution of programming ;

IV-follow up and evaluate the performance of INMETRO activities ; and

V-coordinate the drafting of the budget of the Autarquia.

Art. 7º The Board of Directors and Finance shall be to plan, coordinate, direct, supervise, monitor, monitor and evaluate the execution of the actions inherent in human resources activities, material, heritage, surveillance, transport, finance, accounting, engineering, maintenance, purchasing, and implementing the adoption of procedures, objecting to streamline and enhance the quality of the services it provides.

Art. 8º The Audit is to verify compliance, current standards, budgetary, accounting, financial, equity and human resources procedures, as well as, where determined by the President, verification of compatibility between the means employed and the results achieved and, specifically:

I-create indispensable conditions to ensure effectiveness in internal and external controls, seeking to ensure regularity in the realization of revenue and expenditure ;

II-examine specific legislation and correlates standards, orienting them as to their observance ;

III-promote regular inspections in the areas of INMETRO acting, to verify the physical and financial execution of the projects and activities, including those performed by third parties ;

IV-carry out financial, accounting and administrative audits for the purpose of assessing and certifying the accuracy and regularity of accounts and proving the efficiency and effectiveness in the application of Autarquia's resources ; and

V-perform extraordinary audits, of specific draft, which, in the interest of the Administration, will come to be determined by the President.

Section III

Of The Natural Specific Organs

Art. 9º To the Directorate of Credential and Quality It is up to plan, drive, guide, coordinate, and perform compliance and compliance assessment activities and, specifically:

I-act as the accreditation organ of certification, inspection and training bodies, as well as calibration and testing labs and proficiency testing providers ;

II-coordinate, within the framework of SINMETRO, certification of conformity, declaration of compliance by the supplier, inspection and other forms of compulsory assessment of products, services and personnel ;

III-encourage the development of national standardization and voluntary certification of products, processes, services and personnel ;

IV-elaborating technical regulations in the area of quality ;

V-coordinate the international recognition actions related to accreditation activities ;

VI-promote actions to monitor compliance of products, processes and services to relevant technical standards and regulations ; and

VII-orientee and clarify the consumer in the issues concerning quality.

Art. 10. To the Directorate of Scientific and Industrial Metrology it is up to planning, directing, coordinating and supervising the execution of activities within the framework of basic metrology and, specifically:

I-carry out, reproduce, maintain, conserve and track the national standards of the units of measurement ;

II-referencing, directly or indirectly, national standards to international ones ;

III-disseminating the units of the International System of Units-SI, their multiple and submultiples, through suitable metrological metodolomics ;

IV-tracking the patterns of the various laboratories in the Country, verifying their compliance with national standards ;

V-develop scientific and technological research relating to metrology ;

VI-provide services of metrological nature, in addition to coordinating and supervising the provision of these services, when executed by other entities ;

VII-to provide support to the areas of legal metrology, standardization, quality and productivity, within the framework of basic metrology ;

VIII-participate in the implementation of agreements and arrangements concluded between Brazil and other countries, within the framework of basic metrology ;

IX-coordinate the international recognition actions related to standardization of SI units ; and

X-disseminate the knowledge of metrological science to society.

Art. 11. To the Directorate of Legal Metrology it is up to orient, plan, drive, coordinate, control and promote the execution of activities within the framework of legal metrology, propose projects of technical regulations and, specifically:

I-interacting, in conjunction with the Directorate of Scientific and Industrial Metrology, in the proceedings of the International Bureau of Weights and Measures-BIPM and with other notorious entities featured in the metrological context, and participate in the proceedings of the International Organization of Legal Metrology-OIML ;

II-specify the requirements that models of materialized measures and measuring instruments should fill, by examining them, defining them and approving-os;

III-specify the requirements to which pre-measured products are expected to meet ;

IV-propose programs for training and improvement of human resources in legal metrology ;

V-approve the programming of the activities to be developed by executor bodies of the operational activities of metrology ; and

VI-establish the specifications of equipment, standards and facilities to be used by the executors of the operational activities of metrology.

Section IV

Of The Decentralized Organs

Art. 12. To Superintendencies it is up to performing the INMETRO activities assigned to you in accordance with the relevant legislation, criteria and procedures, reporting to the President and, specifically:

I-supervise the activities developed by the accredited organs ; and

II-support the development of metrology, standardization, conformity assessment and technological information, in accordance with the guidelines downloaded by the President of Autarquia.

Chapter IV

OF THE ALLOCATIONS OF LEADERS

I Section

From the President

Art. 13. To the President of the INMETRO it is incumbent:

I-administer the INMETRE and practice all acts of operational, budgetary and financial management, authorizing expenses and ordering the respective payments ;

II-represent the INMETRE in judgment or outside it ;

III-supervise and coordinate the activities of the integral organs of the INMETRO Regimental Structure ;

IV-render accounts of its management to the Union's Court of Auditors ;

V-regulate the matters pertinent to the competencies and activities of the Autarquia ;

VI-nominating effective office holders ;

VII-appoint holders and designate replacements of occupiers of positions in commission and trust functions, observed the ministerial delegation and the respective level of competence ;

VIII-avocar, for decision or review, matters inherent in the integral organs of the Regimental Structure of Autarquia, without prejudice to the continuity of the tasks provided therein ;

IX-firmar, as the legal representative of the INMETRO, contracts, arrangements, agreements, adjustments and other similar trading acts, and may delegate this allocation ; and

X-delegate any of its assignments, except those that, by their very nature or by legal sealant, can only be implemented by him privately.

Section II

The Executive Director

Art. 14. INMETRO Executive Director is incumbent:

I-replace the President of Autarquia in their impediments and legal and regulatory hindrances ;

II-coordinate the INMETRE Quality System ;

III-coordinate, plan, drive, promote, and execute technological information activities ; and

IV-exercise other tasks assigned to it by the President of Autarquia.

Section III

Of The Remaining Leaders

Art. 15. The Directors, the Attorney General, the Chief Auditor, the Chief of the Cabinet, the Coordinators-General and the other INMETRE leaders, shall be responsible for:

I-plan, drive, and coordinate the execution of the activities affected to their respective organizational units ; and

II-exercise other activities that are committed to them by the President.

Chapter V

DAS GENERAL AND TRANSITIONAL PROVISIONS

Art. 16. The INMETRE should observe the technical guidelines emanating from the Federal Administration Systems Central bodies.
