DECREE OF October 5, 2004

Declares of social interest, for agrarian reform purposes, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of Supplementary Law No. 76 of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964 and 2º of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Fazenda 20 Mil", with area of a thousand, fifty-five hectares, eighteen airs and seventy-eight centiars, situated in the Municipality of Augustinopolis, object of the Registries n the R-1-66, fls. 69, Book 2A and R-1-43, fls. 46, Book 2-A, of the Estate Registration Office of the Comarca of Augustinopolis, State of the Tocantins (Process INCRA/SR-26/nº 54400.001130 /2003-37) ;

II-"Farm Bar Mansa", with area of six thousand, two hundred and twenty-six hectares, ninety and seven airs and nine centiars, situated in the Municipality of Recursoland, object of the Registries n the R-3108, fls. 56v, Book 2-A ; R-4-115, fls. 60, Book 2-A ; R-4-114, fls. 59v, Book 2-A and R-1-179, fls. 103, Book 2-A, of the Estate Registration Office, District of Recursoland, Comarca of Itacajá, State of the Tocantins (Process INCRA/SR-26/nº 54400.001088/200354) ;

III-"Fazenda Serrinha" part, with area of a thousand, two hundred and five hectares, situated in the Municipality of Miracema do To cantins, object of the Registrars n the R-1-2.874, fls. 213, Book 2-J and R-13.723, fls. 114, Book 2-M, of the Real Estate Registration of the Miracema Comarch of the Tocantins, State of the Tocantins (Case INCRA/SR-26/n the 54400.000930 /2003-31) ; and

IV-"Gold Key", with area of four hundred and forty-two hectares, eighty-six airs and thirty centiars, situated in the Municipality of Augustinopolis, object of Registration No. 210 (remainder), fls. 210, Book 2, of the Estate Registration Office of the Comarca of Augustinopolis, State of the Tocantins (Process INCRA/SR-26/nº 54400.001642 /2003-01).

Art. 2º Delete from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in art. 1º and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute for Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Act No. 76 of July 6, 1993, and to maintain the areas of Legal reservation and permanent preservation, provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree shall enter into force on the date of its publication.
