DECREE OF December 12, 2008.

Abre to the Social Security Budget of the Union, in favor of the Ministry of Health, supplemental credit worth R$ 2,441,174,771.00, for reinforcement of appropriations in the current Budget Act.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution conferring you the art. 84, inciso IV, of the Constitution, and in view of the authorisation contained in art. 4^o, incisos I, points?a?,?c? e?d?, II and XXIII, and § 1^o, inciso I, of Law n^o 11,647, of March 24, 2008,

DECRETA:

Art. 1^o Stay open to the Union Social Security Budget (Law n^o 11,647, March 24, 2008), in favor of the Ministry of Health, supplemental credit worth R$ 2,441,174,771.00 (two billion, four hundred and forty-one million, one hundred and seventy-four thousand, seven hundred and seventy-one real), to meet the constant programming of Annex I of this Decree.

Art. 2^o The resources required to open the credit that it treats art. 1^the stem from:

I-excess collection, worth R$ 2,139,730,130.00 (two billion, one hundred and thirty-nine million, seven hundred and thirty thousand, one hundred and thirty reais), being:

a) R$ 1,624,746,772.00 (one billion, seishundred and twenty-four million, seven hundred and forty-six thousand, seven hundred and seventy and two reais) of Contribution for Social Security Financing-COFINS ;

b) R$ 409,551,780.00 (four hundred and nine million, five hundred and fifty-one thousand, seven hundred and eighty reais) of Non-Financial Own Resources ;

c) R$ 5,000,000.00 (five million reais) of Rates and Multes by the Exercise of Police Power ; and

d) R$ 100,431,578.00 (one hundred million, four hundred and thirty-one thousand, five hundred and seventus and eight actual) Restitution of Resources of Convêns and Congenneres ; and

II-partial cancellation of budget appropriations, worth R$ 301,444,641.00 (three hundred and one millions, four hundred and forty-four thousand, six hundred and forty and a real one), as indicated in Annex II of this Decree.

Art. 3^o This Decree goes into effect on the date of its publication.
