DECREE NO 4,628, DE March 21, 2003.

Approves the Regimental Framework and the Demonstrative Framework of the Cargos in Commission and the Gratified Functions of the Superintendence of the Franca Zone of Manaus-SUFRAMA, and gives other providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, paragraph "a", of the Constitution, and in view of the provisions of the art. 50 of Provisional Measure No. 103, from 1º January 2003,

DECRETA:

Art. 1 ° Ficam approved the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and the Gratified Functions of the Superintendence of the Franca Zone of Manaus-SUFRAMA, in the form of the Annexes I and II to this Decree.

Art. 2 ° In due process of the art. 1 °, stay remanded from SUFRAMA to the Office of Management, Ministry of Planning, Budget and Management, in the form of Annex III to this Decree, eight posts in Committee of the Group-Direction and Superior-DAS, thus distributed: a DAS 101.5 ; three DAS 101.4 ; two DAS 101.2 ; a DAS 102.4 ; and a DAS 102.2.

Art. 3 The apostillations arising from the approval of the Regimental Structure of which it treats the art. 1º should occur within the period of twenty days, counted from the date of publication of this Decree.

Single Paragraph. After the apostillations provided for in the caput, the Superintendent of SUFRAMA will be publishing, in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, the nominal relationship of the holders of the posts in committee of the Group-Direction and Superior-DAS, as referred to in Annex II, indicating, inclusive, the number of vacant posts, their denomination and their level.

Art. 4 The internal regiment of SUFRAMA will be approved by the Minister of State for Development, Industry and Foreign Trade and published in the Official Journal of the Union, within ninety days, counted from the date of publishing of this Decree.

Art. 5 ° This Decree comes into force on the date of its publication.

Art. 6 ° shall be repealed Decree No. 2,566 of April 28, 1998.

ANNEX I

REGIMENTAL STRUCTURE OF THE

SUPERINTENDENCY OF THE FRANK ZONE OF MANAUS-SUFRAMA

CHAPTER I

OF NATURE AND PURPOSE

Art. 1º The Superintendency of the Franca Zone of Manaus-SUFRAMA, municipality created by Decree-Law No. 288 of February 28, 1967, and linked to the Ministry of Development, Industry and Foreign Trade, aims to promote development socio-economic, sustainably, in its acting area, upon generation, attraction and consolidation of investments, supported in technological empowerment, aiming at competitive international insertion, from the following actions:

I-identify opportunities with views the attraction of endeavors for the region ;

II-identify and stimulate public and private investments in infra-structuring ;

III-stimulate and strengthen investments in the formation of intellectual capital and in science, technology and innovation by the public and private sectors ;

IV-intensifying the process of articulation and partnership with public and private bodies and entities ;

V-stimulates foreign trade actions ; and

VI-administer the granting of tax incentives.

CHAPTER II

DA ORGANIZATIONAL STRUCTURE

Art. 2º The Superintendency of the Franca Zone of Manaus-SUFRAMA has the following organizational structure:

I-superior body of deliberation: Board of Directors of SUFRAMA ;

II-organs of direct and immediate assistance to the Superintendent:

a) Cabinet ;

b) Legal Prosecution ;

c) Coordination-General for Economic and Business Studies ;

d) Coordination-General of the Board of Directors of SUFRAMA ;

e) Coordination-General of Institutional Representation ;

f) Coordination-General of Social Communication ; and

g) Coordination-General Trade Exterior ;

III-sectional bodies:

a) Internal Audit ; and

b) Assistant Superintention of Administration ;

IV-singular specific organs:

a) Adjoint Superintention of Planning and Regional Development ;

b) Adjoint Superintention of Projects ; and

c) Additional Superintention of Operations ;

V-decentralized units:

a) Coordination-General of the Western Amazonian Portal ;

b) Free Trade Areas ; and

c) Regional Coordinations.

CHAPTER III

DA DIRECTION AND APPOINTMENT

Art. 3º The SUFRAMA will be run by a Superintendent and four Adjoined Superintendents.

§ 1º The Superintendent and Adton Superintendents will be appointed by the President of the Republic.

§ 2º The appointment of the Legal Prosecutor should be preceded by the Advocate's annuity?General of the Union.

§ 3º The nomination and exoneration of the Auditor-Chief should be approved by the Board of Directors of SUFRAMA and the Union Controller-General.

CHAPTER IV

DA COMPETENCY OF ORGANS

I Section

The Superior Body of Deliberation

Art. 4º To the Board of Directors of SUFRAMA competes:

I-approver:

a) the general guidelines for drawing up annual and multiannual work plans ;

b) its internal regiment ;

c) the projects of companies that have objected to the tax benefits provided for in the arts. 7º and 9º of Decree-Law No. 288 of 1967, with the modifications to Law No. 8,387 of December 30, 1991 specifying the incentives to be earned by the Company, as well as laying down standards, requirements, limitations and conditions for approval, monitoring and monitoring of the said projects ;

d) the nomination and exoneration of the Internal Audit holder ;

e) the Annual Plan for Internal Audit Activities ;

f) the general standards and criteria for the execution of plans, programs, projects, works and services to be charged to the entity, in particular:

1. the arrangements, agreements and contracts ; and

2. the credit and financing operations, including for the cost of studies, services and works ;

II-suggest the formation of technical teams for analysis of specific content matter.

Single Paragraph. The composition of the Board of Directors of SUFRAMA is set out in the Supplementary Law No. 68 of June 13, 1991.

Section II

of the Direct and Immediate Care Bodies to the Superintendent

Art. 5º The Cabinet competes:

I-attend the Superintendent of SUFRAMA in its political and social representation and to be entrusted with the preparation of its personal expedient ;

II-distribute and monitor the progress of documentation and processes of interest of the Superintendent, in tramway in SUFRAMA ; and

III-exerting other activities committed by the Superintendent.

Art. 6º To The Legal Procuratorate, as the executor body of the Federal Prosecutor's Office, it competes:

I-represent judicially and extrajudicially to SUFRAMA ;

II-provide advice and legal advice to the Superintendent and the units of SUFRAMA, applying, in what couber, the provisions of the Supplementary Law No. 73 of February 10, 1993 ;

III-watch the Superintendent in the internal control of the administrative legality of the acts to be carried out by him or already effectivated ;

IV-set, for the units of SUFRAMA, the interpretation of the legal order, when there is no normative orientation of the Advocacy-General of the Union and the Legal Consulting of the Ministry of Development, Industry and Foreign Trade ; and

V-ascertain the liquidity and certainty of the claims of any nature, inherent in the activities of SUFRAMA, by enrolling them in active debt, for administrative or judicial collection purposes.

Art. 7º The Coordination-General for Economic and Business Studies competes to advise the Superintendent on the elaboration of studies in the economic areas and tax incentives.

Art. 8º To the Coordination-General of the Board of Directors of SUFRAMA competes secretariar and provide administrative support to the meetings of the Board of Directors of SUFRAMA, sector chambers, committees, working groups and other meetings, to be held by the Board of Directors designated by the Superintendent.

Art. 9º The Coordination-General of Institutional Representation competes:

I-represent SUFRAMA in Brasilia and provide support to the Superintendent and other servers when the service in that locality ;

II-promote and monitor the progress of materials of interest of SUFRAMA ; and

III-run other activities that the interest of the municipality demand.

Art. 10. To the Coordination-General of Social Communication competes to plan, coordinate and supervise the activities of social communication, publication, institutional dissemination, public relations, events, and follow-up of matters of interest of SUFRAMA.

Art. 11. To the Coordination-General Trade Exterior competes:

I-formulate proposals for exterior trade programs, aimed at the acting area of SUFRAMA ;

II-attend SUFRAMA in matters of cooperation, technical assistance, arrangements and international agreements, business rounds, commercial missions, seminars, export platforms, product distribution centres, promotion of fairs and exhibitions ;

III-represent SUFRAMA in the Federal Government's discussions forums, pertinent to the negotiations of international agreements, treaties and cooperations ; and

IV-orient and accompany the exporter on issues pertinent to foreign trade activities.

Section III

Of Sectional Organs

Art. 12. The Internal Audit competes:

I-check compliance with accounting, financial and administrative standards within SUFRAMA ;

II-follow up the work of the internal and external control bodies ;

III-monitor the elaboration and issue prior opinion on the provision of annual accounts, as well as special account taken ;

IV-propose actions in such a way as to ensure the legality of the acts and the scope of the results, contributing to the improvement of management ;

V-subsidarily guide SUFRAMA leaders as to the principles and standards of internal control, including on how to account ;

VI-check the consistency and fidedignity of the data and information that will bear the accounts of the President of the Republic in the Union General Balance Sheet ; and

VII-give prior and periodic guidance to the sectors of Autarquia regarding the execution of their activities.

Single Paragraph. In the exercise of their competencies, the Internal Audit links administratively to the Board of Directors, in accordance with the Art. 15 of Decree No 3,591 of September 6, 2000.

Art.13. The Adjoining Superintendent of Administration competes to plan, coordinate and supervise the execution of the activities concerning:

I-federal systems of organization and administrative modernization, accounting, budget and financial implementation, administration of information and informatics resources, human resources and genera

II-carry out takeover of expense payers and other persons responsible for public goods and values and of all that der the loss, extraction or other irregularity that results in damage to the eryary ; and

III-adopt preventive and repressive actions on the functional and disciplinary ethics of the servers.

Section IV

Of The Natural Specific Organs

Art. 14. The Adjoining Supervision of Regional Planning and Development competes to plan, coordinate and supervise the execution of activities concerning:

I-management of the entity's budget planning and programming system ;

II-formulation, implementation and evaluation of plans and programmes aimed at regional development, in line with national policies ;

III-celebration and follow-up of the arrangements made by SUFRAMA, as well as analysis of the accountability of the transferred resources ; and

IV-formulation, implementation and evaluation of programs and projects aimed at the development of science, technology and innovation, in the acting area of SUFRAMA, in articulation with the Ministry of Science and Technology and other entities public and private.

Art. 15. The Adjoining Superintendency of Projects competes to plan, coordinate and supervise the execution of activities concerning:

I-analysis of industrial, agrolivestock and service projects with a view to granting tax incentives run by SUFRAMA ;

II-analysis and approval of the listing of imported inputs intended for the industrialization of products in the Franca Zone of Manaus ;

III-monitoring, supervision and evaluation of industrial, agri-livestock and service projects ;

IV-administration of the occupation of areas of industrial and agrolivestock districts ; and

V-analysis and surveillance of engineering and architectural projects concerning works in areas of the Marshal Marshal White Castle District.

Art. 16. The Adjoining Oversight of Operations competes to plan, coordinate and supervise the execution of activities relating to:

I-control of the physical and documentary input of domestic and documentary goods of foreign goods, encouraged, in the area of acting SUFRAMA ;

II-cadaster and habilitation of companies that come to plead the tax incentives administered by SUFRAMA ;

III-administration of the finalistic operations of the decentralized units, in articulation with the other units of SUFRAMA ;

IV-monitoring of the operationalisation of the goods entertaining activities in the acting area of SUFRAMA ; and

V-analysis, control, monitoring and evaluation of the operationalization of processes for special export programs.

V Section

Of Decentralized Units

Art. 17. To the Coordination-General of the Western Amazon Portal, the Free Trade Area and Regional Coordinations competes to administer the relevant fiscal incentive instruments, operationalize the import and internship mechanisms of domestic and foreign goods, as well as representing SUFRAMA in the respective area of jurisdiction.

CHAPTER V

OF THE ALLOCATIONS OF LEADERS

I Section

The Superintendent

Art. 18. To Superintendent it is incumbent:

I-set the acting guidelines and exercise the general direction of SUFRAMA units ;

II-propose the annual plan and the budget, and after its approval to give knowledge to the Board of Directors of SUFRAMA, as well as the partial and annual reports of the activities developed ;

III-submit to the approval of the Ministry of Development, Industry and Exterior Trade, the internal regiment of SUFRAMA ;

IV-dispower on the functioning of the units as well as on the performance of special activities ;

V-propose changes in the operational structure depending on the regional development plans or new programs of the Federal Government for the Western Amazon and other areas of comprehension, observed the prevailing standards ;

VI-firming agreements, contracts and arrangements with national and international entities, observed the current legislation ;

VII-provide posts and functions, admit, requisition and dispense personnel, as well as practice all acts of personnel administration, observed legislation in force ;

VIII-represent SUFRAMA in judgment or outside it ;

IX-submit, within the prescribed time-limits, the provision of accounts corresponding to the management of the previous financial year ;

X-authorize the development of financial resources and materials necessary for the execution of programs, projects and activities ;

XI-hire the provision of technical services with physical or legal persons, in the form of relevant legislation, for the performance of specialized functions ;

XII-practice all acts pertinent to the financial, accounting, material and general services administration, in the form of the legislation in force, as well as to determine periodic audits and verifications in these areas ;

XIII-determine the initiation of inquiries as per the relevant standards and legislation ;

XIV-submit to the Board of Directors of SUFRAMA subjects that depend on the appreciation or approval of that collegiate ;

XV-propose to the Board of Directors of SUFRAMA the disposal of mobile and real estate to it belonging ;

XVI-comply and enforce the decisions of the Board of Directors of SUFRAMA ; and

XVII-promote, dispense and approve tenders, as well as firm contracts for material acquisition, execution of works and services and rental of real estate, in the form of the current legislation.

Section II

Of The Adjoining Superintendents

Art. 19. The Adjoined Superintendents is to plan, direct, coordinate and guide the evaluation and execution of the activities of their respective units and to exercise other assignments that are committed to them by the Superintendent of SUFRAMA.

Section III

Of The Remaining Leaders

Art. 20. To the Chief of Staff, the Legal Officer, the Auditor-Chief, the Coordinators-General and the other leaders is to plan, direct and coordinate the execution of the activities affected to the respective units and to exercise other assignments which they are committed.

CHAPTER VI

DAS GENERAL PROVISIONS

Art. 21. The internal regiment will define the detailing of the integral bodies of the Regimental Structure, the competencies of the respective units, the assignments of their leaders and the areas of jurisdiction of the Regional Coordinations.

Art. 22. The Free Trade Areas run by SUFRAMA are in number of three and are located in Tabatinga-AM, Macapá / Santana-AP and Guajr-Mirim-RO.

Art. 23. The missing cases and the doubts raised in the application of the present Regimental Structure will be directed by the Superintendent of SUFRAMA, ad referendum of the Minister of State for Development, Industry and Foreign Trade.
