Decree No. 4628, of 21 MARCH 2003.
Approves the Regimental Structure and the framework Statement of Positions and Functions functions of the Superintendency of the Manaus free trade zone-SUFRAMA, and other matters.
The PRESIDENT of the REPUBLIC, in the use of the powers conferred. 84, subparagraphs IV and VI, paragraph a, of the Constitution, and in view of the provisions of art. 50 of the provisional measure no. 103, January 1, 2003, DECREES: Art. 1° Are adopted the Regimental Structure and the framework Statement of Positions and Functions functions of the Superintendency of the Manaus free trade zone-SUFRAMA, in the form of annexes I and II to this Decree.
Art. 2° due to the provisions of art. 1°, are redeployed to the Office of SUFRAMA, management of the Ministry of planning, budget and management, in the form set out in annex III to this Decree, eight positions in the Group's Commission-direction and Advice-DAS, distributed as follows: one of the 101.5; three of 101.4; two of 101.2; one of 102.4; and one of the 102.2.
Art. 3° The apostilamentos arising from the adoption of the Regimental Structure of the art. 1 shall occur within 20 days, counted of the date of publication of this Decree.
Sole paragraph. After the apostilamentos referred to in the caput, the Superintendent of SUFRAMA shall publish, in the Official Gazette, within thirty days, counted of the date of publication of this Decree, the relationship of the nominal holders of positions in the Group's Commission-direction and Advice-of, referred to in annex II, indicating even the number of vacant positions, their name and their level.
Art. 4° the internal regulations of SUFRAMA is approved by the Minister of development, industry and foreign trade, and published in the Official Gazette, within 90 days, counted of the date of publication of this Decree.
Art. 5° this Decree shall enter into force on the date of its publication.
Art. 6° Is revoked the Decree No. 2566, 28 April 1998.

LUIZ INACIO LULA DA SILVA Luiz Fernando Furlan Guido Mantega annex I REGIMENTAL STRUCTURE of the SUPERINTENDENCY of the MANAUS FREE TRADE ZONE-SUFRAMA chapter I of the NATURE and PURPOSE of Art. 1st the Superintendency of the Manaus free trade zone-SUFRAMA, municipality created by Decree-Law No. 288 of 28 February 1967, and linked to the Ministry of development, industry and foreign trade, aims to promote the socio-economic development in a sustainable way, in its area of operation, by generation, attraction and consolidation of investments, based on technological training, aimed at the competitive international insertion from the following actions: i. identify opportunities with a view to attracting enterprises to the region;
II. identify and stimulate public and private investment in infrastructure;
III-encourage and strengthen investments in intellectual capital formation and in science, technology and innovation for the public and private sectors;
IV-to intensify the process of articulation and partnership with public and private agencies and entities;
V-stimulating actions of foreign trade; and administer the granting of tax incentives.
CHAPTER II ORGANIZATIONAL STRUCTURE Art. 2nd the Superintendency of the Manaus free trade zone-SUFRAMA has the following organizational structure: I-top organ of deliberation: Board of Directors of SUFRAMA;
II. organs of direct and immediate assistance to the Superintendent: a) Office;
b) Attorney;
c) general coordination of Economic and Business Studies;
d) general coordination of the Board of Directors of SUFRAMA;
and) general coordination of Institutional Representation;
f) general coordination of Social Communication; and g) general coordination of foreign trade;
III-sectional bodies: a) internal audit; and (b)) Deputy Superintendent of administration;
IV-specific natural organs: the Deputy of planning and Oversight) Regional development;
b) Supervision Assistant projects; and (c)) Deputy Superintendent of operations;
V-decentralised units: a) general coordination of the Portal of the Western Amazon;
b) free trade Areas; and (c) Regional Coordination).
CHAPTER III of the Art direction and the APPOINTMENT. 3rd SUFRAMA is administered by a Superintendent and four Assistant Superintendents.
(1) the Superintendent and Deputy superintendents are appointed by the President of the Republic.
§ 2 the appointment of attorney should be preceded by Legal Counsel's consent? General of the Union.
(3) the appointment and dismissal of the Chief Auditor must be approved by the Board of Directors of SUFRAMA and by the Office of the Comptroller General.
CHAPTER IV of the COMPETENCE of the ORGANS of the Upper Body section I of Resolution Art. 4 The Board of Directors of SUFRAMA competes: I-approve: a) the General guidelines for the preparation of annual and multi-annual work plans;
b) its rules of procedure;
c) projects of companies that target can take advantage of the tax benefits provided for in arts. 7 and 9 of Decree-Law No. 288, 1967, with the modifications of law No. 8387, dated 30 December 1991, specifying incentives to be received by the company as well as establish standards, requirements, limitations and conditions for approval, supervision and monitoring of these projects;
d) the appointment and dismissal of holder of internal audit;
and) the annual plan of internal audit activities;
f) rules and general criteria for the implementation of plans, programs, projects, works and services in charge of the organisation, in particular: 1. the Covenants, agreements and contracts; e
2. credit operations and financing, including funding of studies, works and services;
II-suggest the formation of technical teams to review specific content matter.
Sole paragraph. The composition of the Board of Directors of SUFRAMA is set on complementary law No. 68 of 13 June 1991.
Section II of the Direct and immediate Assistance to Superintendent Art. 5 the Office shall: (I)-watch the Superintendent of SUFRAMA in its political and social representation and task-if the preparation of your personal office hours;
II-distribute and track the progress of processes and documentation of interest to the Superintendent, in proceedings on SUFRAMA; and III-exercise other activities committed by the Superintendent.
Art. 6 the Legal Attorney, acting as executing agency of the Federal Public Prosecutor's Office shall: (I) legally and extrajudicially represent SUFRAMA;
II-provide advice and legal advice to the Superintendent and to the units of SUFRAMA, applying, in that fit, with complementary law No. 73, of 10 February 1993;
III-watch the Superintendent in the internal control of the legality of administrative acts to be performed by him or already in place;
IV-fix, for units of SUFRAMA, the interpretation of the legal system, when there is no normative guidance of law General and legal counsel of the Ministry of development, industry and foreign trade; and V-measuring the liquidity and certainty of claims of any nature, inherent to the activities of SUFRAMA, enlisting them in debt for purposes of administrative or judicial collection.
Art. 7 the general coordination of Economic and Business Studies advise the Superintendent shall be responsible with regard to the elaboration of studies in the areas of economic and tax incentives.
Art. 8 the general coordination of the Board of Directors of SUFRAMA competes Act and provide administrative support to meetings of the Board of Directors of SUFRAMA, industry Chambers, committees, working groups and other meetings, which are designated by the Superintendent.

Art. 10. The general coordination of Media competes planning, coordinate and supervise the activities of media, publication, dissemination, institutional public relations, events and matters of interest to the SUFRAMA.
Art. 11. The general coordination of foreign trade shall: i. formulate proposals of foreign trade programs, focused on the area of expertise of SUFRAMA;

II-watch the SUFRAMA in matters of cooperation, technical assistance, international agreements, business rounds, trade missions, seminars, export platforms, product distribution centers, promotion of trade fairs and exhibitions;
III-represent the SUFRAMA in the forums of discussions of the Federal Government, relevant to the negotiations of agreements, treaties and international cooperation; and IV-Guide and accompany the exporter on issues relevant to the activities of foreign trade.
Section III Sectional Bodies Art. 12. The Internal Audit shall: i. verify compliance with accounting, financial and administrative standards within the SUFRAMA;
II-follow the work of the internal and external control bodies;
III-monitoring the preparation and issue a prior opinion on the provision of annual accounts, as well as the special accounts;
IV-propose actions to ensure the legality of the acts and the achievement of results, contributing to the improvement of management;
V-guide in the leadership of SUFRAMA principles and internal control standards, including on how to answer;
I saw him check the consistency and reliability of the data and information that will make up the accounts of the President of the Republic in the General Balance of the Union; and VII-prior and periodic guidance to sectors of the municipality in respect of the implementation of its activities.
Sole paragraph. In the exercise of its powers, the internal audit linked administratively to the Board of Directors, pursuant to art. 15 of Decree No. 3591, of 6 September 2000.
Art. 13. The Deputy Superintendency of Administration competes planning, coordinate and supervise the execution of activities relating to: (I)-federal systems of organization and administrative modernization, accounting, budgetary and financial administration of the resources of information and Informatics, human resources and General Services;
II-conduct taken of authorizing expenditure accounts and other account for goods and public values and all that I can about the loss, loss or other irregularity resulting in damage to the Exchequer; and III-adopt preventive and repressive actions on the ethics and discipline of the servers.
Section IV of the Specific Natural Bodies Art. 14. The Deputy Superintendency of planning and Regional Development Plan, coordinate and supervise competes the execution of activities relating to: (I)-management of budget planning and scheduling system of the entity;
II-formulation, implementation and evaluation of plans and programmes aimed at regional development, in line with national policies;
III-conclusion and follow-up of the agreements signed by SUFRAMA, as well as analysis of the accountability of the resources transferred; and IV-formulation, implementation and evaluation of programs and projects aimed at the development of science, technology and innovation in the area of action of SUFRAMA, in conjunction with the Ministry of science and technology and other public and private entities.
Art. 15. The Deputy Superintendency of projects plan, coordinate and supervise competes the execution of activities relating to: (I) analysis of agricultural and industrial projects to provide services with a view to granting tax incentive administered by SUFRAMA;
II-analysis and approval of the listing of imported inputs intended for industrialization of products in the Manaus free trade zone;
III-monitoring, supervision and evaluation of industrial projects, agriculture and livestock and the provision of services;
IV-administration of the occupation of areas of industrial and agricultural districts; and V-analysis and monitoring of projects of engineering and architecture related to works in areas of Industrial District Marshal Castelo Branco.
Art. 16. The Deputy Superintendent of operations plan, coordinate and supervise competes the execution of activities relating to: (I)-physical and documentary entry control of national goods and foreign goods documentary, encouraged, in the area of action of SUFRAMA;
II-registration and registration of companies that may claim the tax incentive administered by SUFRAMA;
III-administration of the related operations of decentralized units, in conjunction with the other units of SUFRAMA;
IV-follow-up of the implementation of the entrepostagem activities in the field of SUFRAMA; and V-analysis, control, monitoring and evaluation of the implementation of the procedures for the special export programs.
Section V of the Decentralised Units Art. 17. The general coordination of the Portal of the Western Amazon, free trade areas and Regional Coordinators compete to manage the instruments of relevant tax incentives, operationalize the import mechanisms and relocation of domestic and foreign goods, as well as represent the SUFRAMA in its area of jurisdiction.
Chapter V of the POWERS of the DIRECTORS section I Art Superintendent. 18. The Superintendent shall: I-fix performance guidelines and exercise the general direction of SUFRAMA;
II-propose the annual plan and budget, and after its adoption give knowledge to the Board of Directors of SUFRAMA, as well as partial and annual reports of activities;
III-to submit to the approval of the Ministry of development, industry and foreign trade, the internal regulations of SUFRAMA;
IV-provide for the operation of the units, as well as on the performance of special activities;
V-to propose changes in the operational structure in the light of the regional development plans or new programs of the Federal Government for the Western Amazonia and other areas, in compliance with the regulations in force;
I saw sign agreements, contracts and agreements with national and international entities, observed the legislation in force;
VII-providing positions and functions, admit, order and dismiss personnel, as well as perform all the acts of personal administration observed the legislation in force;
VIII-represent the SUFRAMA in court or out of court;
IX-to submit, within the period prescribed, the accountability of the management of the previous year;
X-authorizing the provision of financial and material resources necessary for the execution of programs, projects and activities;
XI-hire technical services with individuals or legal entities, in the form of relevant legislation, to perform specialized functions;
XII-practice all acts pertaining to financial, accounting, administration and general services, in accordance with the legislation in force, as well as determine audits and periodic checks in those areas;
XIII-determine the establishment of surveys as relevant legislation and standards;
XIV-submit to the Administrative Board of SUFRAMA materials depend on the assessment or approval of that Board;
XV-to propose to the Board of Directors of SUFRAMA the disposal of movable and immovable property belonging to the company;
XVI-to fulfill and to enforce the decisions of the Board of Directors of SUFRAMA; and XVII-promote, dismiss and approve bids, as well as enter into contracts for the acquisition of material, execution of works and services and rental of real estate, in accordance with the legislation in force.
Section II of the Deputy Superintendents Art. 19. The Deputy Superintendents is up to plan, direct, coordinate and guide the evaluation and implementation of the activities of their respective units and perform other tasks that they are assigned by the Superintendent of SUFRAMA.
Section III of the Art Directors. 20. The Chief of staff to the Attorney, the Chief Auditor, coordinators-General and others lies with managers plan, direct and coordinate the implementation of the activities affected the respective units and perform other duties assigned to them.
CHAPTER VI GENERAL PROVISIONS Art. 21. The internal regulations shall define the details of the members of the Regimental Structure, the powers of the respective units, assignments of their leaders and areas of jurisdiction of Regional Coordination.
Art. 22. free trade Areas administered by SUFRAMA are three in number and are located in Tabatinga-AM, Macapá/Santana-AP and Guajará-Mirim-ro.
Art. 23. The omissive cases and doubts raised in the application of this Procedural Structure will be resolved by the Superintendent of SUFRAMA, ad referendum of the State Minister of development, industry and foreign trade.
