DECREE OF January 13, 2000.

Declares of social interest, for the purposes of land reform, the rural real estate named?Utinga Farm?, situated in the Municipality of Xique-Xique, State of Bahia, and gives other providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 18 and 20 of Law No. 4,504 of November 30, 1964, 2º of Law No. 8,629 of February 25, 1993, and 2º of Supplementary Law No. 76 of July 6, 1993,

DECRETA:

Art. 1º It is declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters ?a?,?b?,?c? and ?d?, and 20, inciso VI, of Law No. 4,504 of November 30, 1964, and 2º of Law No 8,629 of February 25, 1993 ,the rural real estate named?Utinga Farm?, with area of five thousand, eight hundred and forty hectares, ninety-nine airs and eleven centiars, situated in the Municipality of Xique-Xique, object of Registration No 6,854, fls. 30, Book 3-E and of Registration No. 6,564, fls. 08, Book 2-AM, of the Estate Registration Office and Mortgages of the Xique-Xique Comarca, State of Bahia.

Art. 2º Excludes from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in the preceding article and belonging to those who will be benefaced with their intended purpose.

Single Paragraph. It is still excluded from the effects of this Decree the marginal land owned by the Union, by virtue of art. 20, inciso III, of the Federal Constitution.

Art. 3º The National Institute of Colonization and Agrarian Reform -INCRA is hereby authorized to promote the dispossession of the rural real estate of which it treats this Decree, in the manner provided for in Supplementary Act No. 76 of July 6, 1993, and to maintain the Reservation area Legal provision in Law No. 4,771 of September 15, 1965 preferentially in single gleba, so as to reconcile the settlement with preservation of the environment.

Art. 4º This Decree shall enter into force on the date of its publication.
