DECREE NO 6,163, DE July 20, 2007.

Approves the Regimental Framework and the Demonstrative Framework of the Posts in Commission and Gratified Functions of the Ministry of Tourism, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments conferring you the art. 84, incisos IV and VI, point?a?, of the Constitution, and having in view of the art. 50 of Law No 10,683 of May 28, 2003,

DECRETA:

Art. 1st Ficam approved, in the form of the Annexes I and II to this Decree, the Regimental Framework and the Framework Demonstrative of the Cargos in Commission and the Gratified Functions of the Ministry of Tourism.

Art. 2nd In consequence of the provisions of art. 1st, stay remanded, in the form of Annex III to this Decree, of the Office of Management, the Ministry of Planning, Budget and Management, to the Ministry of Tourism the following posts in committee of the Group-Direction and Superior aides: three DAS 101.5 ; eight DAS 101.4, twenty-six DAS 101.3 ; a DAS 101.2 ; two DAS 102.4 ; a DAS 102.3 ; eight DAS 102.2 ; and two DAS 102.1.

Art. 3rd The apostillations arising from the approval of the Regimental Structure of which it treats the art. 1st shall occur within the period of twenty days, counted from the date of publication of this Decree.

Single Paragraph. After the apostillations provided for in the caput, the Minister of State for Tourism will make publication in the Official Journal of the Union within thirty days of the date of publication of this Decree, nominal relationship of the holders of the posts in committee of the Group-Direction and Advisor Superior-DAS referred to in Annex II, indicating, inclusive, the number of vacant posts, their denomination and their level.

Art. 4th the internal regiment of the Ministry of Tourism will be approved by the Minister of State for Tourism and published in the Official Journal of the Union, within sixty days, counted from the date of publication of this Decree.

Art. 5th This Decree goes into effect on the date of its publication.

Art. 6th Stay revoked Decree no 5,203, September 3, 2004.

ANNEX I

REGIMENTAL STRUCTURE OF THE MINISTRY OF TOURISM

CHAPTER I

OF NATURE AND COMPETENCE

Art. 1st The Ministry of Tourism, the body of the direct Federal Administration, has as a area of competence the following subjects:

I-national policy of sustainable development of tourism, in its dimensions economic, social, cultural, environmental and ethical ;

II-promotion and dissemination of national tourism, in the Country and abroad ;

III-stimulus to public and private initiatives related to activities touristic ;

IV-planning, coordination, supervision, execution and assessment of plans, programs, actions and projects related to tourism ;

V-classification of services and tourism ventures ;

VI-stimulation of the certification of people, activities, endeavors and equipment in the scope of the Brazilian Certification System ;

VII-support for the development of the infrastructure needed for country tourism ; and

VIII-management of the General Tourism Fund-FUNGETUR.

CHAPTER II

DA ORGANIZATIONAL STRUCTURE

Art. 2nd The Ministry of Tourism has the following Organizational Framework:

I-bodies of direct and immediate assistance to the Minister of State:

a) Cabinet ;

b) General Secretariat:

1. Directorate of Strategic Management ; and

2. Directorate of Internal Management ;

c) Legal Consulting ;

II-singular specific organs:

a) National Office of Tourism Policies:

1. Department of Planning and Assessment of Tourism ;

2. Department of Studies and Research ;

3. Department of Structuring, Articulation and Touristic Classification ;

4. Department of International Relations of Tourism ; and

5. Department of Promotion and National Marketing ;

b) National Secretariat of Tourism Development Programmes:

1. Department of Regional Tourism Development Programs ;

2. Department of Tourist Structure ;

3. Department of Financing and Promotion of Investments in Tourism ; and

4. Department of Qualification and Certification and Production Associated with Tourism ;

III-collegiate body: National Tourism Board-CNT ; and

IV-linked entity: EMBRATUR autarchy-Brazilian Institute of Tourism.

CHAPTER III

DAS COMPETENCIES OF ORGANS

I Section

of the Direct and Immediate Care Bodies to the Minister of State

Art. 3rd To the Cabinet competes:

I-attend the Minister of State in his political and social representation, occupy himself of public relations and the preparation and dispatch of their personal expedient ;

II-promote the articulation between the Ministry and the bodies that make up the Presidency of Republic ;

III-arrange for the consultation to be attended and for applications formulated by the National Congress and monitor the progress of the projects, in tramway, of interest of the Ministry ;

IV-arrange for the official publication and dissemination of the matters relating to the acting area of the Ministry ;

V-plan, coordinate, and supervise the development of the activities of social communication of the Ministry ;

VI-to attend the Minister of State in his displacements within the territory national and overseas ;

VII-receive, register, answer and troubleshoot complaints, suggestions, praise and denunciations in the defence of the rights and interests of the users of the tourist services ;

VIII-to coordinate and develop activities, within the international framework, to assist with institutional acting of the Ministry, in articulation with the Ministry of Foreign Affairs and other bodies of Public Administration ; and

IX-exercise other competences that are committed to it by the Minister of State.

Art. 4th To the Executive Officer competes:

I-attend the Minister of State in the supervision and coordination of activities of Member secretaries of the structure of the Ministry and the municipality to be linked to it ;

II-supervise and coordinate the execution of organization and modernization activities administrative, as well as those related to federal planning and budget systems, financial administration, accounting, administration of information and computer resources, civil and general services, in the scope of the Ministry ;

III-assisting the Minister of State in the definition of the guidelines and implementation of the policies and actions of the Ministry's area of competence ; and

IV-exercise other competences that are committed to it by the Minister of State.

Single Paragraph. The Executive Officer also exercises through the Directors of Strategic Management and Internal Management, to it subordinate, the function of the sector organ of the Civil Personnel Systems of the Federal Administration-SIPEC, of the Administration of Resources of Informatics and Informatics-SISP, General Services-SISG, Planning and Federal Budget Office, Federal Financial Administration and Federal Accounting.

Art. 5th To the Directorate of Strategic Management competes:

I-plan, coordinate and supervise, within the Ministry and its entity linked, the execution of the activities related to the federal planning and budget, financial administration, federal accounting and organizational systems, and administrative modernization ;

II-establish guidelines for the elaboration and implementation of the multiannual plan and the programs that comprise it, translating in technical terms the ministerial guidelines for the Ministry's actions of competence ;

III-co-ordinating the elaboration and consolidation of annual plans and programmes and multiannual from the Ministry and its linked entities and subject them to the higher decision ;

IV-supervising and coordinating the drafting of the budget proposal and programming fiscal and financial management of the Ministry and its linked entities ;

V-formulate and monitor the implementation of the instruments required for the execution of the Ministry's programmes and projects, establishing the model of management, financing and monitoring of the said implementation ;

VI-monitor the implementation of the annual budget of the Ministry and its entities linked ;

VII-develop the accounting follow-up activities of the Ministry and its linked entities ;

VIII-realizing account outlets of the expense and other responsible payers by public goods and values and of any one that gives cause for loss, extraction or other irregularity that results in damage to the erary ;

IX-promote the articulation with the bodies responsible for central coordination of the activities of organization and administrative modernization and the Systems mentioned in the inciso VII, and inform and guide the organs of the Ministry as to compliance with established administrative standards ;

X-follow up on the acting of the organs of the Ministry and its linked entities, with seen in meeting established goals and projects ;

XI-formulating and implementing strategies and mechanisms of integration and strengthening institutional of the Ministry and its linked entities ; and

XII-elaborate and make information and managerial analysis available, aiming to give support to decision-making, to ministerial supervision and to broaden the transparency of the implemented actions.

Art. 6th To the Directorate of Internal Management competes:

I-plan, coordinate and supervise, within the Ministry, the execution of the activities related to federal systems, administration of information and information resources, civilian personnel and general services ;

II-promote the articulation with the central bodies of the federal systems, referred to in the inciso I and inform and guide the organs and entity of the Ministry as to compliance with the established administrative standards ;

III-promote the registration, treatment, control and execution of operations concerning the budget, financial, accounting and heritage administration of resources managed by the Ministry ;

IV-operationalize the budget, financial and accounting execution activities in the scope of the Ministry ;

V-formalize the celebration of arrangements, agreements and other congenial instruments that involve transfer of resources from the General Budget of the Union ;

VI-analyze the installments of accounts of arrangements, agreements and other instruments congeners celebrated with resources from the Union General Budget ;

VII-analyse and evaluate the installments of accounts, partial or final, as to their technical and financial aspects, proposing the introduction of special account takeover and other measures of its competence when the accountability is not approved, after exauctions of the cableable arrangements ;

VIII-realizing account outlets of the expense and other responsible payers by public goods and values and of any one that gives cause for loss, extraction or other irregularity that results in damage to the erary ;

IX-plan, coordinate, and supervise the execution of the activities related to the internal administrative management systems of the Ministry ;

X-coordinate and supervise the actions regarding the strategic planning of the information technology and its respective implementation within the Ministry and its linked entities ;

XI-set standards for the caption and transfer of information, targeting the operational integration of the databases and systems developed and deployed within the Ministry ; and

XII-coordinate and supervise the development, maintenance and operation of the systems of information from Ministry.

Art. 7th To Legal Consultancy, the sector's sector of the Advocacy-General of the Union, competes:

I-advising the Minister of State on matters of a legal nature ;

II-exercise supervision of the activities of the legal body of the linked entity ;

III-fixing the interpretation of the Constitution, of the laws, of treaties and of the other acts normative to be uniformly followed in their areas of acting and coordination, when there is no normative guidance of the Union Advocate-General ;

IV-draw up studies and prepare information, on request of the Minister of State ;

V-attend the Minister of State in the internal control of administrative legality, of the acts by him practiced or already effective and of those coming from organs or entity under his coordination ;

VI-to examine, prior and conclusively, within the Ministry:

a) the texts of tender editions, as well as those of the respective contracts and congenial instruments, to be published and celebrated ;

b) the acts for which it is going to recognize the inchargeability or decide the dispensation of bidding ;

c) the conditions and documentation required for the celebration of arrangements, terms of partnership and congenial instruments, as well as their respective texts ; and

d) proposals, studies, projects, former projects and minutes of normative acts of interest of the Ministry.

Section II

Of The Natural Specific Organs

Art. 8th To National Office of Tourism Policies competes:

I-formulate, elaborate and monitor the National Tourism Policy, according to the proposed guidelines and the subsidies provided by the National Tourism Board ;

II-analyse and evaluate the execution of the National Tourism Policy ;

III-design instruments and propose standards for the implementation of National Policy of Tourism ;

IV-coordinate the elaboration and monitor the implementation of the National Tourism Plan ;

V-elaborate and evaluate the plans, programs, actions and projects of the Ministry, as also subsidise the elaboration of these instruments by the other units ;

VI-design the guidelines for the formulation of studies, research, analysis and surveys within national and international scope intended for the formulation, implementation and evaluation of National Tourism Policy ;

VII-perform the functions of General Secretariat of the National Council of Tourism ;

VIII-orientar, follow up and supervise the execution of the programs, actions and projects classification, structuring and diversification of tourism offer ;

IX-guide the surveying and structuring of the indicators concerning tourism, for the purpose of monitoring the dynamics of the national and international tourism market and subsidizing the evaluation of the implementation of the National Tourism Policy ;

X-articular and participate in national and international bodies and bodies, aiming at the development of national tourism ;

XI-promote cooperation and articulation with the organs of the Federal Administration, State, from the Federal and Municipal District, with the productive sector and the third sector, in their programs, actions and projects that interact with those of this Secretariat or that can contribute to the strengthening and development of national tourism ;

XII-promote cooperation and articulation with the forums, councils, consortia and tourism and related entities in international, national, state, regional and municipal level ; and

XIII-promote and encourage the holding of events of interest of tourism, such as also disseminate and support the marketing of Brazilian tourism products in the domestic market.

Art. 9th The Department of Tourism Planning and Evaluation competes:

I-plan, coordinate, monitor and evaluate the National Tourism Policy ;

II-coordinate the elaboration and evaluation of the National Tourism Plan ;

III-elaborating the instruments and standards aimed at the implementation of the Policy National Tourism ;

IV-provide technical and administrative support to the National Tourism Board ; and

V-monitor the decentralised management of the National Tourism Plan in the actions of the state, regional and municipal councils and forums.

Art. 10. To the Department of Studies and Research competes:

I-carry out studies, surveys, analyses and surveys and indicators necessary to the formulation, implementation and evaluation of National Tourism Policy ;

II-follow up on the dynamics of the national and international tourism market with views to subsidizing the formulation and evaluation of the National Tourism Policy ;

III-propose, coordinate, supervise and support the conduct of studies, research, analyses, surveys, and systematization of statistical data on the tourism sector, with the aim of guiding public policies ;

IV-create information database of managerial information on tourism supply and demand to support public decision making ; and

V-interacting with institutions within national and international terms, which can collaborate with the enhancement in the area of research and tourism information.

Art. 11. To the Department of Structuring, Articulation and Tourist Classification competes:

I-coordinate, monitor supervising and articulating policies, plans, programs, actions and projects for the structuring and diversification of tourism offer ;

II-exercise the planning activities of the sector, which comprise legislation, classify, cadastrar and scrutinize services and tourism ventures ;

III-support the planning of programs and projects within the framework of the Administration of States, Federal District, Municipalities and micro-regions that contribute to the strengthening and sustainable development of tourism activity ;

IV-subsidizing the formulation and management of policies, plans, programs, actions and projects for the planning and development of tourism and its segments within the local, regional, state and national scope, promoting the insertion of social, environmental and cultural themed ;

V-subsidizing the formulation of policies, normative acts, regulations and of supervision for the planning of tourist services and tourism activity in general ; and

VI-create and manage communication tools and mechanisms, establishing networks of information and relationships to subsidize the deployment of the National Tourism Plan and to strengthen the tourism activity.

Art. 12. To the Department of International Relations of Tourism competes:

I-support, plan, coordinate and monitor the celebration of agreements and instruments of international technical cooperation

II-support, plan, coordinate, develop activities and follow up on acting and participation of the Ministry of Tourism in international forums and bodies of interest in national tourism and in line with the foreign policy of the Country ;

III-support, plan, coordinate, monitor, and promote studies and initiatives with seen to subsidize the performance of the Brazilian Ministry and Government in the negotiations of bilateral, regional and multilateral trade agreements that deal with tourism products and services ;

IV-support, plan, coordinate and monitor the articulation with the other organs and governmental institutions with acting on the international stage ; and

V-researching, identifying, analyzing and disseminating new development practices and tourism management carried out within the international framework, aiming to enhance the quality and competitiveness of Brazilian tourism.

Art. 13. To the Department of Promotion and National Marketing competes:

I-propose, support, plan, coordinate, monitor, and execute the actions and projects of marketing, promotion, propaganda, support for the marketing and dissemination of Brazilian tourism on the national market

II-support, plan, coordinate and monitor the promotion and dissemination programs of Brazilian events and tourism products in the national market ; and

III-support, plan, coordinate and monitor the promotion and dissemination of products associated with tourism in the national market.

Art. 14. The National Secretary of Tourism Development Programs competes:

I-subsidise the formulation of the plans, programs and actions aimed at development and strengthening of national tourism, in compliance with the guidelines of the National Tourism Policy ;

II-support and monitor the formulation of regional development programmes of tourism and to promote the technical, institutional and financial support necessary to strengthen the execution and participation of States, the Federal District and the Municipalities, in these programs ;

III-support and follow up programs, actions and projects for caption and stimulus to realisation of national and international private investments, in accordance with the guidelines of the National Tourism Policy ;

IV-promote the cooperation and articulation of the instruments of the Public Administrati for funding, support and development of tourist activity ;

V-regulation and support the certification of activities, endeavors and equipment of service providers and to fix the evaluation criteria of compliance certification bodies ;

VI-supporting professional and business qualification and improvement of the quality of proviso of services for the tourist ;

VII-support and incentivize production associated with tourism ;

VIII-realizing the management of the General Tourism Fund-FUNGETUR ;

IX-to implement and support the deployment, extension, recovery and modernization of infrastructure needed for tourism, included in historical heritage and tourist signaling ; and

X-promote cooperation and articulation with the organs of the Federal Administration, State, the Federal and Municipal District, with the productive sector and organised civil society, in its programs, actions and projects that interact with those of this Secretariat or that can contribute to the strengthening and development of tourism national, in its areas of competence.

Art. 15. To the Department of Regional Tourism Development Programs competes:

I-co-ordinate the formulation, support, monitor and evaluate regional programmes of development of tourism, which aims to benefit local populations and the increment of income generated by national and international tourism ;

II-subsidise the formulation, coordinate, support and monitor the promotion of support technical, institutional and financial necessary to strengthen the execution and participation of States, the Federal District and the Municipalities, in these programmes ;

III-coordinate the formulation, support and monitor the institutional structure and adequate financial for the implementation of the regional tourism development programmes ; and

IV-coordinate the formulation, support, and track the port of resources of responsibility of the Ministry, in accordance with the guidelines and the funding matrix of each program.

Art. 16. To the Department of Tourist Structure competes:

I-formulate, coordinate, support, monitor, and evaluate the plans, programs and actions of the Ministry aimed at the implementation of tourism infrastructure projects, as per the National Tourism Policy ;

II-coordinate, scrutinize, monitor, and evaluate the application of resources from responsibility of the Ministry in touristic infrastructure projects ;

III-supporting the formulation of historical heritage recovery proposals structural or structural tourist product integral ; and

IV-analyzing investment in basic sanitation and environmental project integral structured or structural tourism, in accordance with the National Tourism Policy.

Art. 17. To the Department of Financing and Promotion of Investments in Tourism competes:

I-coordinate the formulation, support, monitor and evaluate the stimulus actions and fosters the mobilization of private, national and international initiative, for its active participation in the implementation of the National Tourism Policy ;

II-coordinate, support and monitor the development of plans, projects and events which objected to the caption and stimulus to national and international investments, in actions integrated with the guidelines and regions benefactor by tourism development programs ;

III-coordinate, support and monitor the development, maintenance and promotion of projects and investment opportunities ;

IV-coordinate, support and monitor development, together with institutions financial lines of credit lines and other financial instruments, aimed at financing the tourist and business chain companies from tourism ; and

V-realizing the management of the General Tourism Fund-FUNGETUR.

Art. 18. To the Department of Qualification and Certification and Production Associated with Tourism competes:

I-format, implement and support programs, actions and projects aimed at development of artisanal production and other products associated with tourism ;

II-coordinate the actions aimed at the promotion and commercialization of production artisanal and other products associated with tourism ;

III-propose actions of planning, coordination, implementation and evaluation of quality policies for tourism ;

IV-format, implement, and support programs, actions and projects aimed at development of professional qualification, technical assistance to micro and small businesses and tourist education ;

V-articulate and establish partnerships between program performers and area agents governmental, business class entities, workers, technical and technological institutions, teaching and research and other social sectors involved in the thematic issues aimed at improving the quality of products touristic ;

VI-format, implement, and support programs, actions and projects aimed at standards and certification in tourism ;

VII-coordinate programs, actions and projects aimed at qualification professional and business and the improvement of the quality of services provided to the tourist ;

VIII-assisting public institutions in the formulation of quality policies for the tourism ;

IX-stimulates private institutions to adopt quality practices for tourism ;

IX-develop, implement, and support structural projects, in target regions of new tourism investments generators of economic and social impacts ;

X-articular, support and monitor the promotion of technical, institutional support and financial needed for regions with tourism potential and low income per capita in accordance with the National Tourism Plan ; and

XI-coordinate the formulation, support, execute, and follow up programs, actions and projects aimed at the generation of new local development alternatives based on the tourist segments and their productive chain.

Section III

The Collegiate Body

Art. 19. The National Tourism Council is to exercise the skills set out in specific regulation.

CHAPTER IV

OF THE ALLOCATIONS OF LEADERS

I Section

From the Executive Secretary

Art. 20. To the Executive Secretary it is incumbent:

I-co-ordinate, consolidate and submit to the Minister of State the planning of the action global of the Ministry, in line with the Federal Government guidelines ;

II-supervise and evaluate the execution of the actions, projects and activities of the Ministry ;

III-supervising and coordinating the articulation of the organs of the Ministry with the organs central systems of the systems affected to the area of competence of the Secretariat-Executiva;

IV-supervise and coordinate the activities of the integral Secretaries of the structure of the Ministry and the municipality to it linked to ; and

V-exercise other assignments that are committed to it by the Minister of State.

Section II

Of Secretaries and Too Leaders

Art. 21. To Secretaries, it is incumbent on planning, directing, coordinating, guiding, and evaluating the execution of the activities of the units that integrate their respective areas and to exercise other assignments that are committed to them.

Art. 22. To the Chief Minister's Office, to the Legal Advisor, the Directors and the other leaders is to plan, coordinate and guide the implementation of the activities of the respective units and to exercise other assignments that are committed to them.

CHAPTER V

DAS GENERAL PROVISIONS

Art. 23. The internal regiment will define the detailing of the integral bodies of the Regimental Structure of the Ministry of Tourism, the competences of the respective units and the assignments of their leaders.
