Approves the Regimental Structure and the framework Statement of Positions and Functions functions of the Ministry of tourism, and other matters.
The PRESIDENT of the REPUBLIC, in the use of the powers conferred. 84, subparagraphs IV and VI) (? the?, of the Constitution, and in view of provisions in art. 50 of law No. 10683 of 28 May 2003, DECREES: Art. 1 Are approved, in the form of annexes I and II to this Decree, the Regimental Structure and the framework Statement of Positions and Functions functions of the Ministry of tourism.
Art. 2 as a result of the provisions of art. 1st, are redeployed, in the form set out in annex III to this Decree, the Department of management, the Ministry of planning, budget and management, to the Ministry of tourism the following positions in the Group's Commission-direction and Advice above: three of the 101.5; eight of the twenty six of 101.4 101.3; one of 101.2; two of 102.4; one of the 102.3; eight of the 102.2; and two of 102.1.
Art. 3 The apostilamentos arising from the adoption of the Regimental Structure of the art. 1 shall occur within 20 days, counted of the date of publication of this Decree.
Sole paragraph. After the apostilamentos referred to in the caput, the State Minister of tourism shall publish in the Official Gazette, within thirty days, counted of the date of publication of this Decree, a nominal relationship of holders of positions in the Group's Commission-direction and Advice of the Premium referred to in annex II, indicating even the number of vacant positions, their name and their level.
Art. 4 the internal regulations of the Ministry of tourism shall be approved by the Minister of State for tourism and published in the Official Gazette, within 60 days, counted of the date of publication of this Decree.
Art. 5 this Decree shall enter into force on the date of its publication.
Art. 6 Is repealed Decree No. 5203, September 3 2004.

LUIZ INACIO LULA DA SILVA Paulo Bernardo Silva Marta Suplicy this text does not replace that published in the REGIMENTAL STRUCTURE 23.7.2007 annex I the MINISTRY of TOURISM chapter I of the NATURE and JURISDICTION Art. 1 the Ministry of tourism, direct Federal Administration Agency, area of competence the following subjects: (I)-national policy for sustainable tourism development, in its economic, social, cultural, environmental and ethics;
II. promotion and dissemination of the domestic tourism in the country and abroad;
III-stimulating public and private initiatives related to tourist activities;
IV-planning, coordination, supervision, implementation and evaluation of plans, programs, actions and projects related to tourism;
V-classification of services and tourist resorts;
I saw stimulating people, certification activities, projects and equipment within the Brazilian System of certification;
VII-supporting the development of necessary infrastructure to tourism in the country; and VIII-General Tourism Fund management-FUNGETUR.
CHAPTER II ORGANIZATIONAL STRUCTURE Art. 2 the Ministry of tourism has the following Organizational Structure: I-direct and immediate assistance agencies when Minister of State: a) Office;
b) Executive Secretariat: 1. Directorate of strategic management; and 2. Internal management board;
c) legal advice;
II-specific natural bodies: the National Secretariat of Policies) tourism: 1. Planning and Evaluation Department of tourism;
2. Department of studies and research;
3. Department of Structuring, articulation and Tourist Classification;
4. International Relations Department of tourism; and 5. National Marketing and Promotion Department;
b) National Secretariat of tourism development programs: 1. Department of Regional Tourism Development Programs;
2. Department of Tourist infrastructure;
3. Department of financing and promotion of investment in tourism; and 4. Qualification and Certification Department and production associated with tourism;
III-collegial body: National Tourism Council-CNT; and IV-linked entity: local authority EMBRATUR-Instituto Brasileiro de Turismo.
CHAPTER III the POWERS of section I of the Direct and immediate Assistance to the Minister of State Art. 3 the Office shall: (I)-watch the Minister of State in its political and social representation, take care of the public relations and the preparation and dispatch of your mail room personnel;
II-promoting the articulation between the Ministry and the organs that make up the Presidency of the Republic;
III-provide customer service queries and requirements formulated by the National Congress and follow the progress of the projects, in proceedings, of interest to the Ministry;
IV-provide the official publication and disclosure of matters relating to the area of activity of the Ministry;
V-plan, coordinate and supervise the development of social communication activities of the Ministry;
VI-watch the Minister of State in their offsets within the national territory and abroad;
VII-receive, register, respond to and resolve complaints, suggestions, compliments and complaints in defence of the rights and interests of users of tourist services;
VIII-coordinate and develop activities, internationally, to aid the institutional performance of the Ministry, in conjunction with the Ministry of Foreign Affairs and other agencies of the public administration; and IX-exercise other powers are committed by the Minister of State.
Art. 4 the Executive Secretariat shall: I-watch the Minister of State in supervising and coordinating the activities of the secretariats of the structure of the Ministry and of the authority he bound;
II-supervise and coordinate activities of organization and administrative modernization, as well as those relating to the federal systems of planning and budget, financial administration, accounting, administration of information and Informatics capabilities, civilian personnel and general services within the Ministry;
III. assist the Minister of State in defining the guidelines and the implementation of policies and actions in the area of competence of the Ministry; and IV-exercise other powers are committed by the Minister of State.
Sole paragraph. The Executive Secretariat shall exercise, yet, through the Directors of strategic management and Governance, her subordinate, the function of organ systems sector of civilian personnel of Federal Administration-SIPEC, information resources management and Informatics-SISP, General Services-SISG, and Federal budget planning, Financial Administration and Federal accounting.
Art. 5 the Board shall: (I) strategic management-plan, coordinate and supervise, within the Ministry and its linked entity, the implementation of activities related to the federal systems of planning and budget, financial management, federal accounting and organisational and administrative modernization;
II-establish guidelines for the preparation and implementation of the multi-annual plan and its component programs, translating technical ministerial guidelines for the actions of competence of the Ministry;
III-to coordinate the preparation and consolidation of annual and multiannual plans and programmes of the Ministry and its related entities and submit it to top decision;
IV-supervise and coordinate the preparation of the budget proposal and the budget and financial programming of the Ministry and its related entities;
V-to formulate and monitor the implementation of the instruments necessary for the implementation of the programmes and projects of the Ministry, establishing the model for the management, funding and monitoring of such implementation;
VI-monitor the implementation of the annual budget of the Ministry and its related entities;
VII-develop follow-up accounting activities of the Ministry and its related entities;
VIII-taken from accounts of expenditure and other computers responsible for goods and public values and all that I can about the loss, loss or other irregularity resulting in damage to the Exchequer;
IX-promote the articulation with the organs responsible for the central coordination of the activities of the Organization and administrative modernization and systems referred to in paragraph VII, and inform and guide the agencies of the Ministry regarding the compliance with administrative rules established;
X-monitor the performance of the agencies of the Ministry and its related entities, with a view to the fulfilment of goals and established projects;
XI-to formulate and implement strategies and mechanisms of integration and institutional strengthening of the Ministry and its related entities; and XII-develop and provide management information and analysis, in order to support the decision-making process, the ministerial supervision and increase transparency of actions implemented.
Art. 6 the Board of internal management shall: I-plan, coordinate and supervise, within the Ministry, the implementation of activities related to federal systems, information resources management and computer science, civilian personnel and General Services;

II. promote liaison with the central agencies of the federal systems, referred to in item (I) and inform and guide the organs and the Ministry entity regarding administrative standards established;
III-to promote the record, treatment, control and implementation of operations concerning the budget, financial management, accounting and assets managed resources by the Ministry;
IV-operating budget execution activities, financial and accounting within the Ministry;
V-formalize the celebration of covenants, agreements and other similar instruments that involve transfer of resources of the general budget of the Union;
VI-analyze the performance of covenants, agreements and other similar instruments concluded with funds from the general budget of the Union;
VII-to analyze and evaluate the benefits of partial or final accounts, as to its technical and financial aspects, proposing the establishment of special accounts and other measures within their competence when accountability isn't approved, after exhausted all appropriate arrangements;
VIII-taken from accounts of expenditure and other computers responsible for goods and public values and all that I can about the loss, loss or other irregularity resulting in damage to the Exchequer;
IX-to plan, coordinate and monitor the implementation of the activities relating to internal administrative management systems of the Ministry;
X-coordinate and supervise the actions related to the strategic planning of information technology and its implementation within the Ministry and its related entities;
XI-set standards for the collection and transfer of information, targeting the operational integration of databases and systems developed and deployed within the Ministry; and XII-coordinate and oversee the development and maintenance of the information systems of the Ministry.
Art. 7 the legal advice, sectoral body of law General, shall: (I)-assist the Secretary of State on matters of legal nature;
II-exercise supervision of the activities of the legal organ of the linked entity;
III-set interpretation of the Constitution, treaties and laws, other normative acts to be uniformly followed in their areas of expertise and coordination, when there is no normative guidance of the Attorney-General's Office;
IV-prepare studies and prepare information, by request of the Minister of State;
V-watch the Minister of State in the internal control of the legality of administrative acts performed by him or already in place and those from organs or entity under its coordination;
SAW-review, preview and conclusively, under the Ministry: a) the texts of notices of bidding, as well as those of the corresponding contracts and similar instruments, to be published and concluded;
b) acts by which go to recognize the enforceability or decide the bid waiver;
(c)) the conditions and necessary documentation to the conclusion of agreements, terms of partnership and similar instruments, as well as their respective texts; and d) proposals, studies, projects, drafts and drafts of normative acts of the Ministry's interest.
Section II Specific Natural Bodies Art. 8. The National Secretariat of Tourism policies shall: (I) formulate, prepare and monitor-the national tourism Policy, according to the proposed guidelines and the subsidies provided by the National Council of tourism;
II-to analyze and evaluate the implementation of the national tourism Policy;
III-devise instruments and proposing rules for the implementation of the national tourism Policy;
IV-to coordinate the preparation and monitoring the implementation of the national plan for tourism;
V-to elaborate and assess the plans, programs, activities and projects of the Ministry, as well as to subsidize the elaboration of these instruments by other units;
VI-devise guidelines for formulation of studies, research, analyses and surveys of national and international data intended for the formulation, implementation and evaluation of national tourism Policy;
VII-to carry out the functions of Executive Secretariat of the National Council for tourism;
VIII-to guide, monitor and supervise the implementation of programmes, activities and projects, structuring and diversification of the tourism offer;
IX-guide the survey and the structuring of the tourism-related indicators, for the purpose of monitoring the dynamics of national and international tourist market and support the evaluation of the implementation of the national tourism Policy;
X-articulate and participate in national and international bodies and organizations, aimed at the development of national tourism;
XI-to promote cooperation and coordination with the agencies of the Federal, State, Municipal and Federal District, with the productive sector and the third sector, in its programs, activities and projects that interact with this Registry or to contribute to the strengthening and development of tourism;
XII-to promote cooperation and coordination with the forums, advice, consortiums and entities and related tourism in the international, national, State, regional and municipal levels; and XIII-promote and encourage the conduct of events of interest for tourism, as well as publicize and support the marketing of Brazilian tourist products on the domestic market.
Art. 9 planning and Evaluation Department of tourism shall: (I)-to plan, coordinate, monitor and evaluate the national tourism Policy;
II-to coordinate the preparation and evaluation of the national plan for tourism;
III-to elaborate the instruments and regulations intended for the implementation of the national tourism Policy;
IV-provide technical and administrative support to the National Council for tourism; and V-follow the decentralised management of the national plan for Tourism in the actions of the Board and State, regional and local forums.
Art. 10. The Department of studies and research shall: I-conduct studies, research, analysis and surveys of necessary data and indicators for the formulation, implementation and evaluation of national tourism Policy;
II-follow the dynamics of national and international tourism market with a view to subsidizing the formulation and evaluation of the national tourism Policy;
III-propose, coordinate, supervise and support the realization of studies, research, analyses, surveys and systematic statistical data on the tourism sector, with the goal of guiding public policy;
IV-create management information base on tourist supply and demand to support decision-making; and V-interact with national and international institutions, which may contribute to the improvement in the area of research and tourist information.
Art. 11. The Department of Structuring, articulation and Tourist Classification shall: I-coordinate, monitor and supervise and coordinate policies, plans, programs, activities and projects for the structuring and diversification of the tourism offer;
II-exercise planning activities of the sector, comprising legislation, classifying, registering and supervising services and tourist resorts;
III-support planning of programmes and projects under the administration of the States, Federal District, Municipalities and micro-regions that contribute to the strengthening and sustainable development of tourism;
IV-subsidizing the formulation and management of policies, plans, programs, activities and projects for the planning and development of tourism and other industries at the local, regional, State and national, promoting the integration of social, environmental and cultural thematic;
V-support to policy-making, normative acts, regulations and supervision for the management of the touristic services and touristic activity in General; and I saw him create and manage communication instruments and mechanisms, establishing information networks and relationships to support the implementation of the national tourism Plan and strengthen tourism activities.
Art. 12. The Department of international relations of tourism shall: i. support, plan, coordinate and monitor the conclusion of agreements and instruments of international technical cooperation;
II-support, plan, coordinate, develop and monitor the activities and participation of the Ministry of tourism in forums and international bodies of national tourism interest and in line with the country's foreign policy;
III-support, plan, coordinate, monitor and promote studies and initiatives with a view to subsidizing the activities of the Ministry and the Brazilian Government in the negotiations of bilateral, regional trade agreements and multilateral agreements dealing with tourism products and services;
IV-support, plan, coordinate and monitor the articulation with the other agencies and Government institutions with expertise in the international arena; and V-search, identify, analyze, and disseminate new practices of development and management of Tourism held internationally, in order to improve the quality and competitiveness of Brazilian tourism.
Art. 13. The Department of Promotion and Marketing shall: (I) National-propose, support, plan, coordinate, monitor and perform the actions and projects of marketing, promotion, advertising, marketing support and dissemination of Brazilian tourism in national market;

II-support, plan, coordinate and monitor the programmes of promotion and dissemination of events and of Brazilian tourist products in the domestic market; and III-support, plan, coordinate and monitor the promotion and dissemination of tourism-related products in the domestic market.
Art. 14. The National Secretariat of tourism development programmes shall: i. support the formulation of plans, programmes and actions for the development and strengthening of national tourism, in accordance with the guidelines of the national tourism Policy;
II-to support and accompany the formulation of regional tourism development programs and promote the technical, institutional and financial support necessary for the strengthening of implementation and participation of States, the Federal District and the Municipalities, in such programmes;
III-support and monitor programs, actions and projects to attract and stimulate the achievement of national and international private investments, in accordance with the guidelines of the national tourism Policy;
IV-promoting cooperation and coordination of the instruments of public administration for funding, support and development of tourist activity;
V-to regulate and support the certification of activities, projects and equipment service providers and establish the criteria for the evaluation of conformity certification bodies;
VI-to support the business and vocational qualification and improvement of the quality of the provision of services for the tourist;
VII-support and address associated to tourism production;
VIII-the General Fund management of Tourism-FUNGETUR;
IX-run and support the deployment, expansion, recovery and modernization of the necessary infrastructure to tourism, including heritage and tourist signage; and X-to promote cooperation and coordination with the agencies of the Federal, State, Municipal and Federal District, with the productive sector and organised civil society, in its programs, activities and projects that interact with this Registry or to contribute to the strengthening and development of domestic tourism, in its areas of competence.
Art. 15. The Department of regional development of tourism shall: I-coordinating the formulation, support, monitor and evaluate the regional development of tourism programs, which target benefit local populations and the increase of income generated by national and international tourism;
II-to subsidize the formulation, coordination, support and accompany the promotion of technical, institutional and financial support necessary for the strengthening of implementation and participation of States, the Federal District and the Municipalities, in these programs;
III. coordinate the development, support and accompany the institutional and financial framework for implementation of the regional development of tourism; and IV-coordinating the formulation, support and monitor the amount of responsibility of the Ministry, in accordance with the guidelines and the array of funding for each program.
Art. 16. The Department of Tourist infrastructure shall: (I)-formulate, coordinate, support, monitoring and evaluating the plans, programs and actions of the Ministry aimed at implementation of tourist infrastructure projects, according to the national tourism Policy;
II-to coordinate, supervise, monitor and evaluate the implementation of the Ministry's responsibility in tourism infrastructure projects;
III-to support the formulation of proposals for the recovery of historical heritage in tourism product structured or in structuring; and IV-analyse investment in basic sanitation and an integral environmental tourist project or structuring, structured in accordance with the national tourism Policy.
Art. 17. The Department of financing and promotion of investment in tourism shall: I-coordinating the formulation, support, monitor and evaluate the actions to stimulate and promote the mobilisation of the private sector, national and international, for its active participation in the implementation of the national tourism Policy;
II-to coordinate, support and accompany the development of plans, projects, and events that are aimed at attracting and stimulating national and international investments in integrated actions with the guidelines and in the regions served by the programs of development of tourism;
III-to coordinate, support and monitor the development, maintenance and promotion of projects and investment opportunities;
IV-to coordinate, support and monitor the development, together with the financial institutions of lines of credit and other financial instruments to finance the tourist and tourism production chain; and V-to carry out the management of the General tourism Fund-FUNGETUR.
Art. 18. The Department for qualification and certification of Production associated with Tourism shall: I-format, implement and support programs, activities and projects aimed at the development of handicraft production and other products associated with tourism;
II-coordinate actions aimed at the promotion and marketing of handicrafts and other products associated with tourism;
III-propose actions of planning, coordination, implementation and evaluation of quality policies for tourism;
IV-format, implement and support programs, activities and projects aimed at the development of professional qualification, technical assistance for micro and small enterprises and tourism education;
V-articulate and establish partnerships between executors of governmental programs and desktop agents, professional associations, business, technical and technological institutions of education and research and other social sectors involved in thematic issues aimed at improving the quality of tourist products;
VI-format, implement, and support programs, activities and projects aimed at standardization and certification in tourism;
VII-coordinate programs, activities and projects aimed at business and professional qualification and to improve the quality of the services provided to tourists;
VIII-assist government institutions in formulating quality policies for tourism;
IX-to encourage private institutions to adopt practices of quality for tourism;
IX-develop, implement and support structuring projects in target regions to new investments generating tourist economic and social impacts;
X-articulate, support and accompany the promotion of technical, institutional and financial support needed for areas with tourism potential and low per capita income, in accordance with the national plan for tourism; and XI-coordinate the formulation, support, execute and monitor programs, actions and projects aimed at the generation of new alternatives for local development based on segments of interest and its productive chain.
Section III of the collegial body Art. 19. The National Council for Tourism behooves exercise the powers laid down in the specific regulation.
CHAPTER IV of the POWERS of the DIRECTORS Section 1 of Executive Secretary Art. 20. The Executive Secretary shall: (I)-to coordinate, consolidate and submit to the Minister of State planning for global action by the Ministry, in line with the guidelines of the Federal Government;
II-oversee and assess the implementation of the actions, projects and activities of the Ministry;
III-supervise and coordinate the articulation of the agencies of the Ministry with the central organs of the affections systems competence of the Executive Secretariat;
IV-supervise and coordinate the activities of the secretariats of the structure of the Ministry and of the authority he bound; and V-exercise other duties are assigned by the Minister of State.
Section II of the Secretaries and other Officers. 21. The Secretary, to plan, direct, coordinate, monitor and evaluate the implementation of the activities of the units that integrate their respective areas and perform other duties assigned to them.
Art. 22. The Chief of staff to the Minister, the General Counsel, the Board and the other leaders is up to plan, coordinate and direct the implementation of the activities of their units and perform other duties assigned to them.
Chapter V GENERAL PROVISIONS Art. 23. The rules of procedure shall lay down the details of the Regimental Structure members organs of the Ministry of tourism, the powers of the respective units and assignments of their leaders.
