DECREE OF January 29, 2009.

Declaration of social interest, for the purposes of agrarian reform, the rural real estate named?Farm Reshot Our Lady of Soliety?, situated in the Municipality of São Sebastião do Passé, State of Bahia, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2^o of the Supplementary Law n^o 76, July 6, 1993, 18 and 20 of Law n^o 4,504, November 30, 1964, and 2^o of Law n^o 8,629, February 25, 1993,

DECRETA:

Art. 1º It is declared of social interest, for the purposes of land reform, the rural real estate named "Shooting Our Lady of Soliety", with registered area of one thousand, one hundred and eighty-one hectares and forty airs, and area measure of one thousand, one hundred and sixty-two hectares, thirty airs and seventy-six centiars, situated in the Municipality of Are Sebastian of the Passé, object of the Registration in the R-1-3.068, fls. 62, Book 2-AG, of the Real Estate Registration Office of the San Sebastian Comarch of the Passé, State of Bahia (Process INCRA/SR-05/no 54160.005523 /2006-32).

Art. 2º This Decree, regardless of discrimination or collection, does not outwise effects compensation in particular, in respect of areas of public domain constituted by law or registration and to areas of private domain harvested by nullity, prescription, common or ineffectiveness operated exclusively for the benefit of any legal person in public law, in exception of good faith benfectures in them previously to the science of the commencement of the administrative procedure, further excluding their effects the semovents, the machines and the agricultural implements and any benefactor introduced by whoever comes to benefit with their destination.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA, attested to private dominial legitimacy of the mentioned planimeter area, is permitted to promote the dispossession of the rural real estate of which it treats this Decree, in the manner provided for in Supplementary Law No. 76 of July 6, 1993, and to keep the areas of Reservation Legal and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication.
