DECREE OF April 19, 2005

Declaration of social interest, for the purposes of agrarian reform, rural real estate that mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of Supplementary Law No. 76 of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964 and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law no 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"St. Anthony", with area of two hundred and eleven hectares, situated in the Municipality of Altinho, Registration object No. 522, fls. 75, Book 2-E, of the Real Estate Registration Office of the Arctic Comarca, State of Pernambuco (Process INCRA/SR-03/nº 54140.002127 /2003-49) ;

II-"Farm of Gold-Part II", with area of four hundred and fifty hectares, situated in the Municipalities of Belo Jardim and St. Benedict of the Una, object of the Matricles in the 20,608, fls. 03, Book 3-BF and 6,121, fls. 63v, Book 2-AI, of the Estate Registration Card of the Comarca of Belo Garden, State of Pernambuco (Process INCRA/SR-03/nº 54140.000450 /2002-05) ;

III-"Olinda Engineer", with area of one hundred and eighty-eight hectares and seventy-two airs, situated in the Municipality of Cabo de Santo Augustine, object of Registration No 1,888, fls. 88, Book 2-G, of the Estate Registration Card of the Cape Comarch of St. Augustine, State of Pernambuco (Process INCRA/SR-03/nº 54140.001500 /2003-44) ;

IV-"Engineering Altinho", with seven-seven area and fifty five hectares and eighty-nine ares, situated in the Municipalities of Gameleira and Water Preta, object of the Records in the R-5-112, fls. 92, Book 2-A, of the General Registration Office of Real estate of the Gameleira Comarch and R-1-318, fls. 55, Book 2-D, of the Real Estate Registration Office of the Black Water Comarca, State of Pernambuco (Process INCRA/SR-03/nº 54140.001575 /2003-25) ;

V-"Mata Dark", with area of three hundred and sixty and one hectares, situated in the Municipality of Beautiful Waters, the object of the Registration in the R-1-1.930, fls. 130, Book 2-P, of the General Registration Card of Real Estate of the Comarca of Fine Waters, State of Pernambuco (Process INCRA/SR-03/nº 54140.002117 /2003-11) ;

VI-"Farm Garden I and Jatobá", with area of two thousand, seishundred and seventy six hectares and twenty-five airs, situated in the Municipality of Pforget, object of the Registrars in the AV-4-8.327, fls. 179, Book 2-BZ and R-1-8.695, fls. 166, Book 2-CB, of the Real Estate Registration Office of the Comarch of Pforget, State of Pernambuco (Process INCRA/SR-03/nº 54140.000552 /2003-39) ; and

VII-"Umburana and Beldroega", with area of one thousand and twenty-three hectares, situated in the Municipalities of Beautiful Waters and Itaíba, object of the Records in the R-1-1.628, fls. 05, Book 2-H, of the Estate Registration Card of the Itaiba Comarch and R-1-2.946, fls. 176, Book 2-U, of the Real Estate Registration Office of the Comarca of Fine Waters, State of Pernambuco (Process INCRA/SR-03/nº 54140.000054 /2004-31).

Art. 2º Delete from the effects of this Decree the semovents, machinery and agricultural implements as well as the existing benefits in the real estate referred to in art. First and belonging to those who will be beneficiaries with their destination.

Art. 3º The National Institute for Colonization and Agrarian Reform-INCRA is authorized to promote the dispossession of rural real estate that it treats this Decree, in the manner provided for in the Supplementary Act No. 76 of July 6, 1993, and to maintain the areas of Legal reservation and permanent preservation provided for in Law No. 4,771 of September 15, 1965, preferably in single gleba, in order to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree shall enter into force on the date of its publication.
