CONSTITUTIONAL PRESIDENT OF THE REPAsBLICA

For How Much: The Honorable National Congress has sanctioned the following Law:

THE NATIONAL CONGRESS

DECCRETA:

ArtA-cull lo.†" It is reputed to be a crime of speculation, contrary to the economy-to popular, any illegal increase in sales prices, the concealment, the hoarding, the agio, the re-export of articles of essential consumption, the use of sugar or molasses imported into the country in return In the case of the distribution of alcohol, in the distillation of alcohols and, in general, all infractions of the legal provisions governing the exercise of trade in the country.

ArtA-culo 2o.†" The crimes of speculation will be punished with the following sentences:

a) Freckles of a thousand Bolivians to five hundred thousand Bolivians, according to the seriousness of the crime, duplicables in case of recidivism;

b) Temporary or final closure of the establishment, business or brica;

c) Comiso or seizure of the merchandise-subject to the offence, the legal price of which shall be deposited in the respective Account;

d) of the Law of Residence, to the most of the pecuniary fine, in the case of elements foreign;

e) Suspense of the currency concession in the case of importers or industrial importers;

f) Reclusion from one month to two years in the public order.

ArtA-ass 3o.†" Is sanctioned with fines equivalent to the purchase value for all items that have been imported into the country for re-export. ArtA-ass 5o.â€" The Court of the Fight against Speculation, will be constituted by the following persons:

a) The Chief Officer of the Ministry of Economic Affairs-a or the Director General of Trade and Industry who will preside over the Committee;

b) A delegate from the Municipality, which will be rented by it;

c) A delegate of the Boards of Directors;

d) A delegate from the CA of Trade and Industry;

e) A delegate of the Workers ' Unions.

In the capitals of the Department, Comité will be served by the Inspector of Trade and Industry. The Court of Justice shall meet at least twice a week.

The Court shall hear of the complaints filed by the individuals or the Trade Inspectors, and shall be resolved in summary within the maximum period of time. Five dA-as, raising the ruling in consultation with the Ministry of Economic Affairs, for its confirmation or recall in the only instance. No recourse shall be admissible against the judgment, except for the declaration of nullity before the Supreme Court of Justice, prior to the amount of the fine imposed.

ArtA-ass 6o.†" The members of the Court referred to in the previous article, will be removed every three months.

ArtA-ass 7o.†" The cases of speculation with food items, in markets, hotels, mesons, grocery stores, shops and stalls, will be sanctioned by municipal police with fine, comiso or arrest, according to the respective regulations and in proportion to the penalties specified in the Article 2A °, according to the gravity of the offence.

ArtA-ass 8o.†" Speculative crime whistleblowers will benefit from 25% of the fines imposed. The value of the fines, deducted from the proportion corresponding to the complainants, will be deposited in the National Treasury for school buildings. The Ministry of Economic-to-National will set in the budget the sums necessary to cover the expenses that will demand the support of the Court of Struggle against the Speculation and those of the Body of Inspectors of Trade and Industry to be created in

ArtA-ass 9o.†" The costs, authors and concealers of the crimes of speculation will be punished with 50% of the fine imposed on the main offender, or with half of the penalty of arrest or detention, according to the cases. If public officials are those who, for the purposes of diva, bribery or direct or indirect charges, cover up the above crimes, they shall be immediately removed from their posts, without prejudice to the detention of six months to two years in the

Article 13.†" The national factories will open the warehouses for their own costs In order to prevent trade monopolies and selling commissions, they will be required, in departmental capitals, to deal with wholesale trade.

In the regulation of this law the Executive will set the amount of capital required to hold wholesale warehouses.

The small industries can sell directly the articles of their elaboration to the trade retailer.

Article 14.†" The traders of nationality will miss the retail trade, in each capital of the Department, only in the proportion of 20% in respect of the number of Bolivian merchants who are born in The respective Trade marks of Trade.

15.†"Complaints for speculation, are of popular action.

Article 16.â€" Please make the provisions contrary to this law.
