Law No. 366 law of 29 April 2013 EVO MORALES AYMA President constitutional of the PLURINATIONAL State of BOLIVIA, by how much, the plurinational Legislative Assembly, has sanctioned the following law: the Assembly Legislative PLURINATIONAL, D E C R E T A: law of book and reading? OSCAR ALFARO?
CHAPTER I PROVISIONS GENERAL ARTICLE 1. (OBJECT). This law aims to promote the exercise of the right to read and write in conditions of freedom, equity and respect for the diversity of cultural expressions, and generating public policies, plans, and actions to promote the writing, reading and access to the book, the cultural, literary, academic and scientific creation.
ARTICLE 2. (OBJECTIVES). This Act aims to: generate policies, plans, and actions aimed at the formation of readers and writers.
To promote the habit of reading and writing in the population, through the implementation and strengthening of libraries and other public and private spaces for reading and diffusion of the book.
Promote the editing and production of books in languages of the plurinational State and its translation.
Promote and support the editing of bibliographic material in appropriate formats, for consultation by persons with different abilities.
Promote bibliographic production and publishing State and private industry.
Promote citizen participation through activities to promote reading, writing, and free access to libraries and other interactive areas.
Promote the use of new information and communication technology tools.
Promote the development of writing and reading in official languages recognized by the political Constitution of the State.
Implement the multinational system of archives and libraries.
Create the background publishing of the book.
Create the multinational Committee of the book and reading.
ARTICLE 3. (PRINCIPLES). The book, reading and writing are essential to improve the educational, technical, academic and scientific qualifications of the population, and support the creation and transmission of knowledge, the cultural development of the plurinational State and the circulation of information within the framework of a descolonizada, diverse, equitable and prosperous society.
The principles governing this law are the following: interculturality. Interaction between cultures, which is constituted by instrument for cohesion and harmonious and balanced coexistence between Nations and peoples indigenous native farmers, for the construction of relations of equality and equity in a respectful manner.
Diversity. Intellectual creation, expressed in the works of literary, artistic, scientific, it is essential in the development of culture, education, science and communications that it embodies freedom of expression and creativity.
Decolonization. The book, in its different supports and formats, is central to the culture, is the bearer of the diversity of cultural expressions and indispensable tool for the preservation and transmission of the cultural heritage of the nation.
Equality. The promotion of the book, reading and writing must ensure the access of the entire population, without financial constraints, or discrimination of any kind, the book and the multiple forms of reading.
ARTICLE 4. (DEFINITIONS). For the purposes of this law, the following definitions are adopted: file. Organized set of information. Cultural institution where they gather, retain, sorted and diffuse the organic sets of documents for the administrative management, information, research and culture.
Literary agent. Natural person or legal responsible for representing the author in legal, contractual aspects and in the promotion of his work.
Library. Cultural institution, whose essential function is to give people broad access and without discrimination to books, publications and documents published or broadcast in any media. They may be specialized, University, public and school libraries.
Public library. Meeting place for the community, website access to information and technologies Center for the promotion of culture and reading, which has as its primary function, offer readers a wide access and without discrimination, the bibliographical, audio-visual collections and multimedia or any other support, updated on an ongoing basis. Public libraries can be State, private, or community.

Virtual Library. Library that are available in digital format (pdf, doc, microform, etc.), a significant proportion of information resources accessible through the computer, through the Internet and other accesses.
Legal deposit. It is a mechanism of asset protection of the National bibliographic production and is not an instrument to improve the collections of public libraries.
Autonomous territorial entities. Institutions that administers and governs the jurisdiction of a territorial unit, departmental, municipal or rural native indigenous, according to the powers and competences conferred the political Constitution of the State and the law N ° 031, law framework of autonomy and decentralization "Andrés Ibáñez".
ISBN? International Standard Book Number (in English). It is the number standardised international book, which serves to identify the country, Publisher and title of each book, unless this number is repeated.
ISMN? International Standard music Number (in English). It is the international number that identifies music written publications, either for sale, for rent, free broadcasting or for the purpose of copyright.
ISSN? International Standard Serial Number (in English). Alphanumeric code used to normalize the registration and identification of serial or periodical publications internationally.
Book. All unit work published in any format, consisting of text or graphic material, with a beginning and an end, produced by an author or authors, of any nature, capable of reading.
E-book. Book in proper format to read and/or heard on any electronic device, as in a computer, mobile phone or other similar device.
Bolivian book. All unitary non-periodical publication, whose registration record in the Bolivian Legal deposit.
Magazine. Publication of non-daily frequency, usually illustrated, bound, with writings on various subjects or specialized.
Magazines shall enjoy the same privileges that are designated for the book.
Bolivian magazine. Publication of non daily periodicity, which registration will be recorded in the Bolivian Legal deposit.
Promotion plan. Instrument that defines actions to protect, promote, promote the production and distribution of books, through programs and activities as well as encourage the habit of reading.
Multinational system of archives and libraries. Group of organized services and library files are public or private, established through the coordination and mutual cooperation, to be able to articulate plans, programmes and projects aimed at the development of the same, allowing democratic access to goods and services cultural, educational, informational and recreational, to which all the citizens, and the citizens are entitled.
Oral tradition. Means of transmission of knowledge, knowledge, values, spirituality and worldview from generation to generation, for the preservation of our cultural identities.
Narrative Transmedia. It is a story told in a different way which goes beyond the traditional formats, on different platforms and has the participation of readers.
A story transmedia expands through the different platforms and media, incorporating new contents, characters and plots. Each medium or support is part of the history and the whole of the editorial product, providing a different reading experience.
21 reading. Instrument of the cognitive process of certain kinds of information or ideas contained in a stand and transmitted through some kind of code, usually a visual, tactile or auditory, language that allows to interpret and decode the audio unit value of a series of written signs, either mentally or out loud.
CHAPTER II PLAN MULTINATIONAL OF PROMOTION OF THE BOOK AND READING ARTICLE 5. (PLURINATIONAL PLAN OF PROMOTION OF THE BOOK AND READING).
The ministries of culture and tourism, and education, will define and implement the multinational Plan of promotion of the book and reading, in a coordinated and participatory with all organizations and institutions linked to the sector, which will contain programmes, projects, strategies and instruments relating to the promotion, dissemination, promotion and awareness.

Organization and calls to contests and other initiatives of promotion of reading comprehension.
Creation of public libraries, without prejudice to the obligations established in the present law by municipal self-governments.
Editing and publication of books intended for the students of the educational system of the plurinational State.
Acquisition of assets and real estate, earmarked for the strengthening of the publishing Fund of the Bolivian book? FONDOLIBRO.
To promote the reading and writing in official languages of the plurinational State.
Promote research, preservation and dissemination of the oral tradition of the Nations and peoples indigenous native peasants.
Award honors, awards and incentives to the editing and publication of books in languages.
Educational and informational campaigns of promotion, dissemination and other promotion measures.
CHAPTER III PROMOTION OF THE BOOK AND READING ARTICLE 7. (PUBLISHING INDUSTRY AND BOOK TRADE).
I. the Central Government within their public policies, establish programmes of support to industry and trade in the book to guarantee pluralism, cultural diversity and access to reading, in consideration to the cultural values that the book represents and its industrial and economic importance.
II. contribute to the international expansion of the Bolivian book industry, promoting their participation in the main national and international fairs and opening new markets abroad.
ARTICLE 8. (IMPORT AND SALE OF BOOKS AND PUBLICATIONS).
I. the import of books, newspapers and magazines, in print, is exempt from the value added - VAT tax.
II. the sale of books of national and imported production, and official publications made by institutions of the plurinational State of Bolivia, in printed version, is subject to a zero (0) rate VAT - VAT tax.
ARTICLE 9. (IDENTIFICATION OF THE BOOK).
I all book or editorial product produced in the country and recognized by this law, must exhibit the following: title of the work.
Name or pseudonym of the author.
Name of the translator, adapter, or compiler if there is one.
Symbol of copyright (copyright) with indication of the name of the author and the year of first publication.
Identification of graphic artists who took part in the work.
Name and address of the Publisher, followed by the year and the print run of each issue.
Foot of the press, with the name and address of the player printer.
Register of ISBN or ISSN, ISMN, as appropriate.
Registered in the national service of intellectual property - SENAPI.
Certificate of Legal deposit.
The right of natural or legal persons who voluntarily wish to publish, in any format, books, or other products for your free access and circulation to the public, not subject to the directions set out in paragraph I of this article, without implying any disadvantage with regard to the protection and benefits that this law grants is saved.
CHAPTER IV OF ARCHIVES AND LIBRARIES, ARTICLE 10. (MULTINATIONAL SYSTEM OF ARCHIVES AND LIBRARIES).
I creates the multinational system of archives and libraries, under the Ministry of education, consisting of all the files and public libraries and private of the plurinational State, whose purpose is the national administrative register with the Ministry of education, which contains all data of the archives and libraries in all the national territory.

ARTICLE 11. (IMPLEMENTATION OF LIBRARIES).

CHAPTER V OF BOOK PUBLISHING BACKGROUND BOLIVIAN - FONDOLIBRO ARTICLE 12. (CREATION OF THE FONDOLIBRO).
I created the publishing Fund of the Bolivian book - FONDOLIBRO, which will be administered by the ministries of education and of culture and tourism, according to regulations issued by the Executive Body to the effect.
II. the object of the FONDOLIBRO, is to raise resources that will be used for the execution of public policies, the multinational Plan of promotion of the book and reading, and the edition of books declared of national interest.
ARTICLE 13. (SOURCE OF RESOURCES). The FONDOLIBRO will have a permanent nature and shall consist of the following sources of resources: resources that every year the ministries of culture and tourism, and education.
Bequests or donations from private individuals or public or private institutions.
Income that is question of the sale of the works or issues funded by the FONDOLIBRO.
And all income which is obtained at departmental, national and/or international level aimed at the objectives of this Act.
CHAPTER VI OF THE MULTINATIONAL COMMITTEE OF THE BOOK AND READING ARTICLE 14. (CREATION OF THE MULTINATIONAL COMMITTEE OF THE BOOK AND READING).
I created the multinational Committee of the book and reading, as advisory body of the plurinational State in the implementation of this law.
II. the powers and functioning of the multinational Committee of the book and reading, will be controlled through express regulation, issued by the executive body.
III. will be their competition declared of national interest books, cultural, historical, technological, scientific, academic and educational content are a great contribution to society. Publication shall be made through the FONDOLIBRO and in accordance with procedures established in the regulation to the effect.
ARTICLE 15. (CONFORMATION). The multinational Committee of the book and reading will be formed by representatives of the following institutions: A representative of the Ministry of culture and tourism;
A representative of the Ministry of education;
A representative of the national service of intellectual property? SENAPI;
One representative of each autonomous State Government;
A representative of the Federation of municipal associations? FAM;
A representative of the Executive Committee of the Bolivian University? CEUB;
A representative of the Bolivian book Chamber;
A representative of the indigenous Bolivian universities;
A representative of the archives and national library of Bolivia.
SOLE ADDITIONAL PROVISION. ((Se modifica el inciso h) of article 76 of the law N ° 843 (current ordered text), by the following:? h) sale of books, newspapers, informational publications in general, newspapers and magazines imported or domestic market, as well as official publications carried out by institutions of the plurinational State of Bolivia, in printed version?.
SOLE FINAL PROVISION. This law will be regulated by the Executive Body, within a period of ninety (90) calendar days from the enactment of this Act.
SOLE ABROGATION PROVISION. All provisions contrary to this law are repealed.
Refer to the Executive Branch, for constitutional purposes.
