Law N ° 774 law of 4 of January of 2016 EVO MORALES AYMA President constitutional of the State PLURINATIONAL of BOLIVIA as, the Assembly Legislative plurinational, has sanctioned the following law: the Assembly Legislative PLURINATIONAL, DECREED: law of promotion of the grape, SINGANI, wines of height BOLIVIAN and wines BOLIVIAN chapter I provisions general article 1. (OBJECT). This Act aims to promote and strengthen the development of the productive complex of grape, Singani, height Bolivian wines and wines Bolivianos, comprehensively, articulated and coordinated with the set of actors of the plural economy and all levels of Government of the plurinational State of Bolivia, according to their competencies.
ARTICLE 2. (DECLARATION).

ARTICLE 3. (SCOPE OF APPLICATION). This law applies throughout the country, giving priority to regions producing and productive potential of grape, Singani, height Bolivian wines and wines Bolivianos.
ARTICLE 4. (SCOPE). This law comprises the set of activities and actors of the plural economy: micro, small, medium and large producers, artisanal and industrial, linked to the productive complex of grape, Singani, height Bolivian wines and wines Bolivianos, within the framework of all levels of Government of the plurinational State of Bolivia, according to their competencies.
CHAPTER II PROMOTION AND STRENGTHENING ARTICLE 5. (THE CENTRAL STATE LEVEL ACTIONS). For the promotion and strengthening of the productive complex of grape, Singani, height Bolivian wines and wines Bolivianos, of integrated and complementary way, the Ministry of Foreign Affairs, the Ministry of productive development and Plural economy, the Ministry of Rural development and land, the Ministry of environment and water, Ministry of culture and tourism, and others, will coordinate the execution of the following tasks , within the framework of its powers: to promote the dissemination of production and the exportable offer of the grape, Singani, height Bolivian wines and wines Bolivians, in external markets.
Promote mechanisms financial and not financial for the development integral of the complex production of the grape, Singani, wines of height Bolivian and wines Bolivian, with destination to investment for crops of the vine.
To formulate policies, plans and programmes to promote the integral development of the production complex of the grape, Singani, height Bolivian wines and wines Bolivians, in aspects of transformation, industrialization and commercialization.
Promote the denomination of origin, distinguishing marks and the quality of the grape, Singani, height Bolivian wines and wines Bolivianos, at national and international level.
Improve and strengthen the production and productivity wine conventional, organic and ecological, supporting in the strengthening comprehensive of the complex production.
Promote tourist circuits, related to the production complex of the grape, Singani, height Bolivian wines and wines Bolivians, including technical assistance.
Formulate appropriate natural resource management practices and strengthen practices and technologies in the management, maintenance and operation of irrigation systems, promoting irrigation professionalism and the operation of systems of modernized irrigation and efficient use of water, favoring the respect and preservation of the environment and sustainable management of ecosystems.
Promoting adaptation actions, creating conditions for the resilience of production systems to climate change, through the instances that correspond, in the framework of the law N ° 300 October 15, 2012, framework of mother earth and Integral Development for living well.
ARTICLE 6. (AUTONOMOUS TERRITORIAL ENTITIES). The autonomous territorial entities, within the framework of its powers, may finance, articulate and develop productive activities of promotion and comprehensive strengthening of the productive complex of the grape, Singani, height Bolivian wines and wines Bolivians, in accordance with the sectoral policies of the plurinational State of Bolivia.
CHAPTER III CENTER MULTIPURPOSE WINE INNOVATION? CEMIVIT ARTICLE 7. (CREATION OF THE MULTIPURPOSE WINE INNOVATION CENTER?
CEMIVIT). To create the Center multipurpose innovation wine? CEMIVIT, based in the Department of Tarija, as a dependent of the National Institute of agricultural and forestry - innovation INIAF technical and operational.
ARTICLE 8. (OBJECTIVE). The CEMIVIT will aim to carry out research work to meet standards of productivity and quality, strengthening processes of production and transformation of grape and its derivatives, Singani, height Bolivian wines and wines Bolivianos, at the national and international market.
ARTICLE 9. (FUNCTIONS). The CEMIVIT will have the following functions: in scientific and participative research, develop technological innovations for the wine sector in the primary and secondary phases based on the needs and converging productive demands among local actors and national institutions.
In transfer of technology and technical assistance, to implement a system of technology transfer, technical assistance and support in the provision of goods for the production and strengthening sustainable productive systems.
Strengthen the capacities of producers to increase the levels of productivity and quality of the grape, Singani, height Bolivian wines and wines Bolivians, according to current standards at national and international level.
Developing a system of statistical information of the wine sector, in coordination with the competent authorities.
Promote the commercialization and create conditions to improve the practices and processes of commercialization of grape, Singani, height Bolivian wines and wines Bolivians, in national and international markets.
Control the use of the appellation of origin for Singani, height Bolivian wines and wines Bolivians, in coordination with the SENAPI.
ARTICLE 10. (COORDINATION). For the fulfilment of its functions, the CEMIVIT will coordinate and articulate with public and private entities, as well as with universities and related international bodies, as appropriate.
ARTICLE 11. (PLURINATIONAL COMMITTEE OF INNOVATION OF GRAPE, WINE AND SINGANI).
I. the INIAF constitute innovation of grape, Singani and wines, multinational Committee as a mechanism of coordination and articulation for the promotion of the productive complex of grape, Singani, height Bolivian wines and wines Bolivians.
II. the multinational Committee of Singani innovation of grapes and wines, will be formed by State entities related to the sector and the representative organizations of vine growers and winemakers, through its delegates.
III. structure and functioning of the multinational Committee of Singani innovation of grapes and wines, will be regulated by the Ministry of Rural development and Lands, in coordination with the INIAF, by Ministerial resolution.
ARTICLE 12. (FINANCING). The infrastructure, the equipment and the operation of the CEMIVIT, will be financed by the INIAF, and through this the autonomous territorial entities may provide the media and financing within the framework of its competences.
CHAPTER IV PROMOTION OF THE GRAPE, SINGANI, BOLIVIAN HEIGHT WINE AND BOLIVIAN WINES ARTICLE 13. (COMPREHENSIVE DEVELOPMENT). The integral promotion of the productive complex of the grape, Singani, height Bolivian wines and wines Bolivians, including: promotion of the season of the harvest as a tourist destination of national priority, enhancing the cultural aspects of wine production, with emphasis on the vineyards.
Recovery and dissemination of historical, traditional and cultural aspects of the wine and Bolivian Singani.
Broadcasting and promotion of the grape, Singani, wines of height Bolivian and wines Bolivian in the alien, through all those media that have them entities involved.
Other actions in the context of the responsibilities of the competent entities, established in this law and in the specific legal framework.
ARTICLE 14. (ACCESS TO DOMESTIC MARKET). The competent authorities of the central level of the State, in coordination with the autonomous territorial entities and other relevant institutions, are in charge of: promote the commercialization of products in the domestic market.
Promote training and technical assistance for access to national markets.
Promote the geographical indication, the designation of origin or brand country.
Promote the expansion of the internal market related to the grape, Singani, height Bolivian wines and wines Bolivianos.
ARTICLE 15. (SUPPORT FOR EXPORT).
I. the plurinational State of Bolivia, through the competent entities, will participate in the design of strategies and the implementation of actions that promote the opening of export markets for the grape, Singani, height Bolivian wines and wines Bolivianos.
II. the Ministry of Foreign Affairs will manage adherence to international agreements and the participation of the sector in specialized institutions of the outside of the country, with the contribution of productive players.
ARTICLE 16. (JOINT WITH TOURIST ACTIVITY).
I. the entities of the central State level in coordination with the competent bodies of the sector tourism and culture, will incorporate activities of the productive complex of grape, Singani, height Bolivian wines and wines Bolivians, in the design and implementation of priority tourist products or circuits.
II. sets the promotion and strengthening of national and international wine and Singani, and wine tourism routes.
ARTICLE 17. (PROTECTIVE MEASURES). The entities competent must implement measures to protect it production national of the grape, Singani, wines of height Bolivian and wines Bolivian, applying the sense of reciprocity between countries and respecting them treated current.
ADDITIONAL PROVISIONS FIRST. Amending article 35 of the law N ° 259 July 11, 2012, control the sale and consumption of alcoholic beverages, in the following way:? Article 35. (SANCTIONS IN THE MANUFACTURE, IMPORT AND MARKETING). Natural and legal persons engaged in the activity of production, import and marketing of alcoholic beverages, shall be punished the first time with confiscation of the merchandise and a fine of 10,000 UFV? s, in case of repeated offence shall be punished with a fine of 20,000 UFV? s and the permanent closure of the establishment, when they engage in the following conduct : Renege on health records.

FINAL PROVISIONS FIRST. The CEMIVIT will start its operations gradually, within a period of one hundred twenty (120) days from the publication of this law.
THE SECOND. The present law shall be regulated by Decree Supreme, in the term of cent twenty (120) days calendar to splitting your publication.
SOLE ABROGATION AND REPEAL PROVISION.
I. is abrogating the law N ° 591 of 30 October 2014, declared Cultural patrimony of the State multinational of Bolivia, to the? Bolivian singani?.
