CONSTITUTIONAL PRESIDENT OF THE PLURINATIONAL STATE OF BOLIVIA

For the Plurinational Legislative Assembly, it has The following Act:

THE PLURINATIONAL LEGISLATIVE ASSEMBLY,

DECCRETA:

GRAPE PROMOTION LAW, SINGANI,

BOLIVIAN HIGH WINES AND BOLIVIAN WINES

CHAPTER I

GENERAL PROVISIONS

ARTICLE 1. this Law aims to promote and strengthen the development of the Complex

Productive of Uva, Singani, Wines of Bolivian Height and Bolivian Wines, in an integral way, articulated and coordinated with the set of actors the plural economy and with all levels of government of the Plurinational State of Bolivia, according to its competencies.

ARTICLE 2. (DECLARATION).

I. The Singani and the Bolivian Height Wines are declared as Cultural Heritage of the Plurinational State of Bolivia.

II. The Uva, Singani, Bolivian High Wines and Bolivian Wines, of strategic interest of the State

Plurinational of Bolivia.

ARTICLE 3. (AMBITO OF APPLICATION). This Law applies throughout the national territory,

prioritizing the producing regions and with productive potential of Uva, Singani, Bolivian High Wines and Bolivian Wines.

ARTICLE 4. (REACH). This Law covers all the activities and actors of the economy

plural: micro, small, medium and large producers, artisanal and industrial, linked to the Productive Complex of Uva, Singani, Wines of Height Bolivianos and Wines Bolivianos, in the framework of all levels of government of the Plurinational State of Bolivia, according to their competencies.

CHAPTER II

PROMOTION AND STRENGTHENING ACTIONS

ARTICLE 5. (ACTIONS OF THE CENTRAL LEVEL OF THE STATE). For the promotion and strengthening

of the Productive Complex of Uva, Singani, Wines of Bolivian Height and Bolivian Wines, in an integrated and complementary way, the Ministry of Foreign Affairs, the Ministry of Productive Development and Plural Economy, the Ministry of Rural Development and Lands, the Ministry of Environment and Water, the Ministry of Cultures and Tourism, and others, will coordinate the execution of the following tasks, in the framework of its attributions:

Promote the diffusion of production and Export of the Uva, Singani, Bolivian High Wines and Bolivian Wines, in external markets.

Promote financial and non-financial mechanisms for the integral development of the Uva Productive Complex, Singani, Wines of Height Bolivianos y Vinos Bolivianos, destined for investment for vine crops.

Formulate policies, plans and programs to promote the integral development of the Productive Complex of the Uva, Singani, Viños de Arise Bolivianos and Bolivian Wines, in aspects of transformation, industrialization and

Promote the designation of origin, distinctive marks and the quality of the Uva, Singani, Bolivian High Wines and Bolivian Wines, nationally and internationally.

Improve and strengthen conventional, organic and organic production and productivity, supporting in the integral strengthening of the Productive Complex.

Promote tourist circuits, related to the Complex Productive of the Uva, Singani, Bolivian High Wines and Bolivian Wines, including technical assistance.

Formulate appropriate practices for the management of natural resources and strengthen practices and technologies in management, maintenance and operation of the irrigation systems, promoting the technical irrigation and The operation of the systems of the technical irrigation and the efficient use of water, favoring the respect and conservation of the environment and the sustainable management of the ecosystems.

Promote actions of adaptation, generating Conditions for the resilience of productive systems to climate change, through the corresponding instances, within the framework of Law No. 300 of October 15, 2012, Framework of Mother Earth and Integral Development to Live Well.

ARTICLE 6. (AUTONOMOUS TERRITORIAL ENTITIES). The autonomous territorial entities, in the

framework of their competencies, will be able to finance, articulate and develop productive activities of promotion and integral strengthening of the Productive Complex of the Uva, Singani, Bolivian High Wines and Bolivian Wines, in accordance with the sectoral policies of the Plurinational State of Bolivia.

CHAPTER III

MULTIPURPOSE INNOVATION CENTER

WINE? CEMIVIT

ARTICLE 7. (CREATION OF THE MULTIPURPOSE WINE INNOVATION CENTRE?

CEMIVIT). The Multipurpose Wine Innovation Center is created? CEMIVIT, headquartered in the Department of Tarija, as a technical and operational instance under the National Institute of Agricultural and Forestry Innovation-INIAF.

ARTICLE 8. (OBJECTIVE). The CEMIVIT will aim to carry out research work to achieve

standards of productivity and quality, strengthening the processes of production and transformation of the Uva and its derivatives, Singani, Viños de Arise Bolivianos and Wines Bolivianos, on the domestic and international market.

ARTICLE 9. (FUNTIONS). CEMIVIT will have the following functions:

In scientific and participatory research, develop technological innovations for the wine sector in the primary and secondary phases, based on needs and demands. convergent productive between local actors and national entities.

In technology transfer and technical assistance, implement a system of technology transfer, technical assistance and support in the provision of for production, strengthening productive systems

Strengthening the capacities of producers to increase the levels of productivity and quality of the Uva, Singani, Bolivian High Wines and Bolivian Wines, according to current national and regional standards international.

Develop a statistical information system for the wine sector, in coordination with competent entities.

Promote marketing and create conditions for improving practices and Processes of marketing of Uva, Singani, Tall Wines Bolivians and Wines Bolivianos, on national and international markets.

Control the use of the designation of origin for Singanis, Bolivian High Wines and Bolivian Wines, in coordination with the SENAPI.

ARTICLE 10. (COORDINATION). For the performance of its functions, CEMIVIT will coordinate and

articulate with public and private entities, as well as with related universities and international entities, as appropriate.

ARTICLE 11. (PLURINATIONAL COMMITTEE OF INNOVATION OF GRAPES, SINGANI AND WINES).

I. The INIAF will be the Plurinational Committee of Innovation of Uva, Singani and Wines, as a coordination mechanism

and articulation for the promotion of the Productive Complex of Uva, Singanis, Viños de Hrise Bolivianos and Bolivianos.

II. The Multi-National Committee of Innovation of Uva, Singani and Wines, will be made up of the entities of the State

linked to the sector and the representative organizations of vine producers and winegrowers, through their delegates.

III. The structure and functioning of the Plurinational Committee of Innovation of Uva, Singani and Wines, will be regulated

by the Ministry of Rural Development and Lands, in coordination with the INIAF, through Ministerial Resolution.

ARTICLE 12. infrastructure, equipment and functioning of CEMIVIT,

will be financed by INIAF, and through this Autonomous Territorial Entities will be able to provide the means and financing in the framework of its

CHAPTER IV

COMPREHENSIVE PROMOTION OF GRAPES, SINGANI,

BOLIVIAN HIGH WINES AND BOLIVIAN WINES

ARTICLE 13. (COMPREHENSIVE PROMOTION). The comprehensive promotion of the Uva Productive Complex,

Singani, Bolivian Height Wines and Bolivian Wines, includes:

Promotion of the vintage season as a priority tourist destination national, enhancing the cultural aspects of wine production, with emphasis on vineyards.

Recovery and dissemination of the historical, traditional and cultural aspects of Bolivian wines and singanis.

Dissemination and promotion of the Uva, Singani, Bolivian High Wines and Wines Bolivians abroad, through all the means available to the entities involved.

Other actions in the framework of the responsibilities of the competent entities, established in this Law and in the specific legal framework.

ARTICLE 14. (ACCESS TO INTERNAL MARKET). The competent entities of the central level of the

State, in coordination with the autonomous territorial entities and other competent institutions, are in charge of:

Driving the market

Promote training and technical assistance services for access to national markets.

Promote geographical indication, designation of origin or country mark.

To promote the expansion of the internal market related to the Uva, Singani, Bolivian High Wines and Bolivian Wines.

ARTICLE 15. (EXPORT SUPPORT).

I. The Plurinational State of Bolivia, through the competent entities, will participate in the design of strategies and in the

execution of actions that promote the opening of export markets for the Uva, Singani, Wines of Height Bolivians and Bolivian Wines.

II. The Ministry of Foreign Affairs will manage the accession to International Conventions and the participation of the sector

in specialized institutions of the country's exterior, with the contribution of the productive actors.

ARTICLE 16. (ARTICULATION WITH THE TOURIST ACTIVITY).

I. The central level entities of the State in coordination with the competent authorities of the tourism and culture sector, will incorporate activities of the Productive Complex of Uva, Singani, Wines of Bolivian Height and Bolivian Wines, in the design and implementation of prioritized tourism products or circuits.

II. The promotion and strengthening of the Wine and Singani routes, and of the Enoturismo at national and international level is established.

ARTICLE 17. (PROTECTION MEASURES). The competent entities must implement measures

to protect the national production of the Uva, Singani, Bolivian High Wines and Bolivian Wines, applying the sense of reciprocity between countries and respecting the current treaties.

ADDITIONAL provisions

FIRST. Article 35 of Law No 259 of 11 July 2012, of Control to the Expendium and Consumption of Alcoholic Drinks, is amended as follows:

? Article 35. (SANCTIONS IN THE MANUFACTURE, IMPORT AND MARKETING). Natural and legal persons engaged in the manufacture, import and marketing of alcoholic beverages shall be sanctioned the first time with Forfeiture of the merchandise and a fine of 10,000 UFV? s, in case of recidivism will be sanctioned with the fine of 20,000 UFV? s and the definitive closure of the establishment, when they incur the following behaviors:

Incompliance with health records.

SECOND. Is it instituted as?Day of the Uva, Singani, Wines of Bolivian Height and Bolivian Wines?, to the

last Friday of the month of February of each year, to be held from the year 2016.

FINAL PROVISIONS

. CEMIVIT will start its operations progressively, within one hundred and twenty (120) days

business as of the publication of this Law.

SECOND. This Law will be regulated by Supreme Decree, within one hundred and twenty (120) days

calendar from publication.

OPENING AND REPEALING PROVISION

ONLY.

I. Law No 591 of 30 October 2014, which declares the Cultural Heritage of the Plurinational State of Bolivia, is repealed,

al?Bolivian Singani?.

II. All the provisions contrary to this Laware repealed and repealed.

Remit to the Executive Body for constitutional purposes.
