Resolution CDNI 2016-I-4
Application of Article 7.04, paragraph 2, for tank-mounted vessels
in accordance with national provisions (Part B)
The Conference of the Contracting Parties,
in view of the Convention on the Collection, Deposit and Receipt of Wastes in Rhine and Inland Navigation (CDNI) and, in particular, article 14,
Considering that the prevention of waste is a necessity for environmental protection, as well as for the safety and health of inland navigation personnel and users, as well as for related sectors of the economy,
Considering that the new wording of Article 7.04, paragraph 2, introduced by Resolution CDNI 2015-II-3, is intended exclusively to clarify, without substantive amendments,
notices that a tank vessel degassed in accordance with national requirements may receive a new load without pre-washing provided that the next charterer confirms in writing to the carrier that it is not necessary that the vessel be made available in a washed state.
This interpretation shall apply immediately until the relevant requirements of the CDNI come into force.

Amendment of sections 5.01, 7.04 and Appendix IV of the Regulations
The Conference of the Contracting Parties,
- in view of the Convention on the Collection, Deposit and Receipt of Wastes in Rhine and Inland Navigation (CDNI) and, in particular, Articles 10, 14 and 19,
- considering that the prevention of waste is a necessity for the protection of the environment as well as for the safety and health of personnel and users of inland navigation and for the sectors of the economy associated with it,
- noting that the introduction of compatible transport in the CDNI allows in particular to avoid unnecessary washing,
- on the proposal of the CDNI/G working group,
- decides to amend sections 5.01, 7.04 and Appendix IV of the rules of application of the CDNI as set out in the schedule.
This resolution will come into force no later than 1er July 2017. Unloading certificates in accordance with Appendix IV of the regulations in effect until June 30, 2017 may be used until June 30, 2018 and submitted as evidence within the meaning of section 6.03, paragraph 1, of the schedule until December 31, 2018 inclusive.

Annex CDNI 2016-I-5
Amendments to sections 5.01 and 7.04, paragraph 3, of Schedule 2 to the CDNI
1. Section 5.01 is amended to read:
(a) The letter (a) is as follows:
(a) "exclusive transport": successive transport in which the same cargo or other cargo whose delivery does not require the prior cleaning of the holds or tanks is transported into the hold or tank of the building, provided that this can be proved;
(b) After the letter (a) is inserted the following letter (a):
"aa) "compatible transport": successive transport in which the same cargo or other cargo whose carriage does not require the prior washing of the holds or tanks is transported in the hold or tank of the building, provided that this can be proved; »
2. Article 7.04, paragraph 3, is as follows:
"(3)(a) Paragraphs 1 and 2 above do not apply to cargo tanks and tanks of exclusive transport vessels. The carrier must be able to provide written evidence.
(b) Subsection 2 does not apply to cargo holds and tanks of compatible vessels. The carrier must be able to provide written evidence. In this case, check box 6(b) of the discharge certificate. The proof must be kept on board until the next compatible cargo is unloaded.
(c) If the following cargo is not yet known at the time of unloading, but it will be based on any likelihood of a compatible cargo, the application of paragraph 2 may be deferred. The charterer (in case of liquid cargo) or the consignee of the cargo (in case of dry cargo) must temporarily designate a receiving station for washing water, which must be registered in the discharge certificate. In addition, check box 6c of the discharge certificate. The indication of the number 9 quantity is not necessary.
If the compatibility of the following cargo is established and can be demonstrated before the carrier gains the receiving station indicated in the unloading certificate, this must be indicated in the unloading certificate number 13. In this case, washing is not necessary. If not, the washing provisions are fully applicable.
The proof for the following compatible cargo shall be retained on board until the next compatible cargo is unloaded.
3. The models of Appendix IV Unloading attestations for dry-mounted navigation and tank-mounted navigation are modified as follows:
(a) The number 6 is as follows:
"6. The boat
(a) conduct exclusive transport - section 7.04, (3) (a).
(b) carry as the following cargo a compatible cargo - section 7.04, (3) (b)
(c) will not be washed until the determination of compatibility of the following cargo - section 7.04, (3) (c) »
(b) After the number 12 is inserted the following number 13:
« 13. The following cargo is compatible with the washing - section 7.04, (3) (c) »
(c) The old numbers 13 to 17 become numbers 14 to 18.
(d) The information on number 9 is supplemented as follows:
"In the event of application of section 7.04, paragraph 3, letter (c), "uncertainty regarding the compatibility of the following cargo", the quantity shall not be indicated.
