The House of Representatives adopted and sanctioned the following:
Section 1er
General provisions
Article 1.01.1
This Act regulates a matter referred to in Article 74 of the Constitution.
Art. 1.01.2
The General Estimates for the 2016 Budget Year are adjusted in accordance with the appropriate totals of the programs in the departmental tables annexed to this Act.

Section 02
SPF Chancellery of the Prime Minister
Art. 2.02.1
By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the Federal State, the means available as of 31 December 2015 of the Fund 02-1 - Fund for the financing of the information and communication missions developed by the General Directorate External Communication (Deleted Fund) are disaffected and, by derogation from Article 11 of the Royal Decree of 7 January 2002 on the composition and competence of the organs, and the financial management of the International Press Centre as a separate management State service, added to the means of the separate management State service IPC."

SPF Information and Communication Technology
Art. 2.05.1
The text of section 2.05.2 of the Act of 18 December 2015 containing the General Estimates for the fiscal year 2016, is supplemented as follows:
"In the limits of the basic allowances concerned, the following subsidies may be granted:
PROGRAMME 31/1 - TECHNOLOGY
AND COMMUNICATION
- Subside for international ICT projects on basic allocation 05.31.10.35.40.01
Grants through collaboration between FEDICT and national and international organizations for projects of general interest in ITC relating to citizens.
PROGRAMME 31/3 - DEPENSES
LUTTE CONTRE LA RADICALISATION
-Subside deradicalisation asbl MolenGeek on basic allowance 05.31.30.33.00.01;
-Subsides deradicalisation Digital Belgium skills fund.
Subsidies as part of a collaboration between FEDICT and asbl or organizations for projects related to ITC for the citizen and/or the general interest.
Art. 2.05.2
The credits of the base allowance 05.31.30.01.00.01 may be transferred, by way of redistributions of basic allowances, to specific basic allocations that may be created by redistributions of basic allowances in the same program, in order to cover expenses related to the project "Digital Belgium skills fund".

Art. 2.12.2
By derogation from Article 20, 2° of the Act of 22 May 2003 on the organization of the budget and accounting of the federal State, the obligations arising or contracted during the years prior to the current fiscal year dependant on the credits of the basic allowances 12-51-02-12.11.01, 12-51-31-12.11.01, 12-51-32-12.11.31, 12-56-02-12.11.01 and 12-56-03-12.11.

Section 2.12.7 of the Act of 18 December 2015 containing the General Estimates for the 2016 Budget Year is replaced as follows:
By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Fonds de la Commission des jeux de chance (program 12-62-5) are disaffected, up to a maximum of 15,618.000 euros, and are added to the general resources of the Treasury.
Art. 2.12.4
"By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Special Support Fund for Victims of Intentional Acts of Violence and Occasional Rescuers (Program 12-62-4) are disaffected, up to 84.592.000 euros, and are added to the general resources of the Consolidated Revenue Fund.

Art. 2.13.1
The text of Article 2.13.2, PROGRAMME 54/8 - FINANCING OF SECOURS AND SERVICES INACENDIA, 2°, of the Act of 18 December 2015 containing the Budget General of Expenditures for the 2016 fiscal year is replaced as follows:
"2° Subsides to Brandweervereniging Vlaanderen, the Royal Federation of Firefighters of Belgium, French-speaking and German-speaking wings, the National Fund for the Assistance of Firefighters, the Vlaamse Vereniging Brandweervrijwilligers and the Association of French-speaking and German-speaking Volunteers of Belgium. »
Art. 2.13.2
The text of section 2.13.9 of the Act of 18 December 2015 containing the General Estimates for the 2016 fiscal year is replaced as follows:
Ҥ1. The Fund's commitment authority 13-15 "Federal European Fund for Asylum and Migration and for Homeland Security - Program 2014-2020" 13-71-1 is EUR 41,429,000.
Any commitment to be made under this article is subject to the visa of the contract controller.
§ 2. By derogation from Article 62 of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, Fund 13-15 "Federal European Fund for Asylum and Migration and for Homeland Security - Programmation 2014-2020" of programme 13-71-1, is authorized to present a wind-up debit position whose amount cannot exceed 14 599 000 EUR. »
Art. 2.13.3
The text of section 2.13.10 of the Act of 18 December 2015 containing the General Estimates for the 2016 fiscal year is replaced as follows:
"By derogation from article 52, paragraph 1st, 2nd of the law of 22 May 2003 on the organization of the budget and accounting of the federal state and by derogation from article 1-01-3 § 2 of this Law, the credits of commitment and liquidation of the basic allowances relating to remuneration and allowances generally of any kind (basic allowances 11xxxx) as well as the basic allowances 12.21.48 and 12.11.99 »

The proceeds for order made under the calamities pursuant to the Act of 17 July 1976 to be paid to the National Fund of Calamities are carried out on account 13.80.04.00.49C.
Art. 2.13.8
The proceeds for order carried out following the organization of seminars and study days under the Security and Prevention Policy are carried out using account 13.83.02.10.80C. They may be used to cover all management costs arising from these activities.
Art. 2.13.9
The proceeds of the peacekeepers ' order revenue are carried out using account 13.83.03.21.94C. They may be used to cover all management costs arising from these activities.
Art. 2.13.10
The proceeds for order under the Argo programme are carried out on account 13.83.02.08.78C. They may be used to cover all project costs arising from these activities.
Art. 2.13.11
The proceeds of receipts for order made under the services provided by the public servants responsible for emergency planning to the municipalities are carried out using account 13.83.03.41.17B. They may be used to cover all management costs arising from these activities.
Art. 2.13.12
The proceeds for order carried out under the Higher Institute for Emergency Planning are carried out using account 13.83.02.02.72C. They can be used to cover the costs of carrying out the tasks of this institute, as resumed in art. 2 of the AR of 5 December 2011.
Art. 2.13
Order revenue operations carried out in the context of coordination and supra-local actions in the areas covered by art. 69 of the Act of 30 March 1994 shall be carried out by account 13.83.03.23.96C. They may be used to cover all management costs arising from these activities.
Art. 2.13.14
The proceeds of receipts for order under the European mechanism for international emergency relief are carried out using account 13.83.03.18.91C. They may be used to cover all management costs arising from these activities.
Art. 2.13.15
The proceeds of receipts for order carried out under the EUCPN European project on crime prevention and control are carried out on account 13.83.03.15.88C.
They may be used to cover all management costs arising from these activities.
Art. 2.13.16
The proceeds for order carried out under the European STRESAVIORA project on the prevention and control of radicalization are carried out on account 13.83.03.24.97C.
They may be used to cover all management costs arising from these activities.
Art. 2.13.17
The proceeds of receipts for order carried out under the EUCPN operating fund consisting of the transfer of the funds managed by the Centrum voor Criminaliteitspreventie en Veiligheid in the Netherlands as well as voluntary donations from the European Member States are carried out on account 13.83.03.25.98C. They may be used to cover all expenses incurred in the implementation of the EUCPN's operating fund.
Art. 2.13.18
The proceeds of receipts for order made under European subsidies as well as third-party funding for the AMIF-ISF organic fund (programme 13.71.1) to be paid to the Flemish Region are carried out on account 13.83.03.42.18 B.
Art. 2.13.19
The proceeds of receipts for order carried out under European subsidies as well as third-party funding for the AMIF-ISF organic fund (programme 13.71.1) to be paid to the Walloon Region are carried out on account 13.83.03.43.19B.
These revenues can be used to cover payments to the Walloon Region.
Art. 2.13.20
By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Nuclear Accident Risk Fund (Program 50/70) are disbursed to a maximum of Euro2,848,000 and are added to the general resources of the Treasury.
Art. 2.13.21
By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Fire and Explosion Safety Fund (Program 54/22) are disaffected and added to the general resources of the Treasury.
Art. 2.13.22
By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Equipment and Equipment Acquisition Fund on behalf of municipalities, intercommunal groups, prezones, emergency relief zones and fire and emergency medical assistance of the Brussels Capital Region (Program 54/30) are disaffected and added to the general resources of the Treasury.
Art. 2.13.23
By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the treasury management fund (Program 59/03) are disaffected and added to the general resources of the Treasury.
Art. 2.13.24
By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the special fund for integrated emergency appeal centres (program 63/0) are disaffected and added to the general resources of the Treasury.
Art. 2.13.25
The text of section 2.13.14 of the Act of 18 December 2015 containing the General Estimates for the 2016 Budget Year as follows:
"The budget of the Federal Agency for the reception of asylum seekers for the year 2016 is approved, annexed to this Act.
This budget is for revenues of 307 656 222 EUR and for expenditures of 307 656 222 EUR. »
Art. 2.13.26
In accordance with Article 7, § 2bis, 2°, paragraph 1 (a) of the Act of 21 January 1987 on the feeding of the fund for the risks of major accidents and the fund for the prevention of major accidents and by derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Fund for the Risk of Major Accidents,

SPF Foreign Affairs,

Art. 2.14.1
In the text of Article 2.14.9 of the Act of 18 December 2015, the amount of "16,500,000 euros" is replaced by "270,000 euros".
Art. 2.14.2

Subsidies as part of international financing for climate policy. "
Art. 2.14.4
§ 1. By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Buildings Fund (Program 14.42.1) are disbursed to a maximum of 283,272 thousand euros and are added to the general resources of the Consolidated Revenue Fund.
§ 2. By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Belgian Food Security Fund (Program 14.54.1) are disbursed to a maximum of 17,262 thousand euros in means of liquidation and are added to the general resources of the Treasury.
Section 16
Ministry of Defence
Art 2.16.1.
In the French text of section 2.16.21 of the Act of 18 December 2015 containing the general budget of expenditures for the fiscal year 2016, the words "Art. 2.16.21" are replaced by the words "Art. 2.16.20".
In section 2.16.22 of the Act of 18 December 2015 containing the General Estimates for the fiscal year 2016, the words "Art. 2.16.22" are replaced by the words "Art. 2.16.21".
In section 2.16.23 of the Act of 18 December 2015 containing the general expenditure budget for the fiscal year 2016, the words "Art. 2.16.23" are replaced by the words "Art. 2.16.22" and the words "SHAPE expenditures" by the words "SHAPE and NCIA construction expenditures on the SHAPE site".
In section 2.16.24 of the Act of 18 December 2015 containing the General Estimates for the fiscal year 2016, the words "Art. 2.16.24" are replaced by the words "Art. 2.16.23".

Section 17
Federal police and integrated operation
Art. 2.17.1
By derogation from sections 11, 12, 19, 20, 23, 60 and 61 of the Act of 22 May 2003 on the organization of federal budget and accounting, the Minister of Security and the Interior is authorized to make compensation for the basic federal staffing of 2016, the recovery of undue payments to police areas in 2015 in respect of federal holdings to municipalities and multi-communal police areas.
Art. 2.17.2
§ 1. By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Fund 17-2 (Program 90/5) are disaffected, up to a maximum of 4.629.071.64 euros in commitment and 7.349.510.52 euro in liquidation, and are added to the available resources of the Fund 17-1 (Program 90/4).
§ 2. By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Fund 17-3 (Program 90/6) are disaffected, up to a maximum of 10,469,644,98 euros in commitment and liquidation, and are added to the available resources of the Fund 17-1 (Program 90/4).
§ 3. By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Fund 17-2 (Program 90/5) are disaffected, up to a maximum of Euro4.518.831.74 in commitment and liquidation, and are added to the general resources of the Treasury.
Art. 2.17.3
The text of section 2.17.8 of the Act of November 13, 2015 containing the General Estimates for the 2016 fiscal year is replaced as follows:
"For the fiscal year 2016, the organic budget fund 17-4 referred to in section 11 of the Act of 21 December 2007 on various provisions (I) has a commitment authority of EUR 1,109 000.
Any undertaking to be made under this article is subject to the visa of the contract controller.
Prior to the 10th of each month, the Comptroller of Commitments shall forward to the Court of Auditors, together with supporting documents, a statement in three copies, on the one hand, the amount of the commitments covered in the past month and, on the other hand, the amount of commitments that have been covered since the beginning of the year.
By derogation from Article 62, § 2, paragraph 4, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal state, during the fiscal year 2016, on the same organic budget fund, is authorized a debiting position in liquidation that cannot exceed EUR 815 000."
Section 19
Buildings
Art. 2.19.1
The adjusted budget of the Buildings Board for the fiscal year 2016, annexed to this Act, is approved.
This budget amounts to 932 247 975 euros in total and for expenditures to 890 599 633 euros in total.
Revenue includes grants from the federal state for a total amount of Euro755,583 000, of which Euro411,000 is recorded in Section 01 and Euro751,472,000 in Section 19 of the General Estimates.
This budget includes, in expenditure, commitment credits (divided credits) for an amount of Euro273,741,422.
Revenue and expenditure on order are estimated at Euro22,510 000.
Art. 2.19.2
In section 2.19.2 of the Act of 18 December 2015 containing the general budget of expenditures for the fiscal year 2016, the amount of 4,079,692 euros is replaced by 9,252,186 euros.
Of this sum, 7,952,186 euros are allocated for renovation work in the Royal Museum of Central Africa in Tervueren and 1,300,000 euros are intended for the construction of a Legal Psychiatry Center in Ghent.
Section 21
Pensions
Art. 2.21.1
The text of section 2.21.1 of the Act of 18 December 2015 containing the General Estimates for the 2016 Budget Year is replaced as follows:
"The adjusted Public Sector Pension Service budget for 2016, annexed to this Act, is approved.
This budget amounts to 14 998 779 000 euros, including 14 953 949 000 euros for revenue related to legal missions and 44,830,000 euros for service management revenues. It amounts to 14 998 779 000 euros, of which 14 953 949 000 euros for expenses relating to legal missions, and 44,830,000 euros for expenses relating to the management of the service. »

SPF Employment, Labour and Social Concertation
Art. 2.23.1
The recovery of advances in the form of loans granted to employees may, if any, be made in accordance with Article 23, 4°, of the Protection of Compensation for Workers Act of 12 April 1965.
Art. 2.23.2
Within the limits of the applicable basic allowance, the following grants may be granted:

Art. 2.25.1
Section 2.25.2 of the Act of 18 December 2015 containing the General Estimates for 2016 is amended as follows:
The PROGRAMME 51/4 - PSYCHOSOCIAL HEALTH SOINS is completed as follows:
- Subsidies to the pilot project "Study Care Program" in three penitentiary institutions.
Integration of PROGRAMME 51/6 - SUBSIDES A DES ASSOCIATIONS
- Subsidies to various associations for the supervision and support of the citizen in his patient capacity.
- Subsidies to ASBL Medical errors.
- Subsidies to the associations "LEIF" and "EOL" with the aim of supporting doctors and informing the public about the legal provisions on euthanasia
Art. 2.25.2
By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the "Belgian Red Cross Fund" Fund (Prog 25 51/3) are disaffected and are added to the general resources of the Treasury.
Art. 2.25.3
In section 2.25.3 of the Act of 18 December 2015 containing the General Estimates for the fiscal year 2016, the amount of EUR 189,424,101 for revenues is replaced by an amount of EUR 190,073,319 and the amount of EUR 188,527,914 for expenditures is replaced by an amount of EUR 189,086,826.
Art. 2.25.4
In section 2.25.5 of the Act of 18 December 2015 containing the General Estimates for the fiscal year 2016 the amount of EUR 74,746,108 for revenues is replaced by an amount of EUR 74,722,166 and the amount of EUR 74,746,108 for expenditures is replaced by an amount of EUR 74,722,166.

Art. 2.32.2
By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Funds:
- Fund for the exploration, exploration and exploitation of mineral and other non-living resources of the territorial sea, the continental shelf of Belgium and the seabed and their subsoil beyond the limits of national jurisdiction (Program 46-2),
- Debt Treatment Fund (programme 49-2),
- Random Games Fund (programme 46-3).
- Agricultural Fund (programme 44-2),
- Formal reductions for natural gas and electricity heating (Program 52-1),
- Flat-rate reductions in heating oil, lamping oil (Type C) and propane gas (programme 52-1),
- Bank-Carrefour des Entreprises (programme 21-3),
removed by the Program Act of December 26, 2015, are disaffected and are added to the general resources of the Treasury.
Art. 2.32.3
By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority, the available means of the Funds:
- Fund for accreditation and certification fees (Program 46-1), up to 814.000 euros
- Copyright Fund (Program 47-1), up to 1.072.000 euros
are disaffected and are added to Treasury's general resources.
Section 33
Mobiate and Transport
Art. 2.33.1
The text of section 2.33.4 of the Act of 18 December 2015 containing the General Estimates for the fiscal year 2016, is supplemented as follows:
" - those of the Fund relating to the operation of the Federal Organization for the Investigation of Navigational Accidents (Program 22/2) up to the balance available as at 31 December of the 2015 fiscal year, 30.115.91EUR, will be disassigned on 1er July of the 2016 fiscal year. »
Section 44
SPP Social integration
Poverty reduction and social economy
Art. 2.44.1
Section 2.44.6 of the Act of 18 December 2015 containing the General Estimates for 2016 is replaced as follows:
Ҥ1. Licensing authorities are granted for the following organic funds up to the amounts indicated:
European Fund for the Integration of Third Country Citizens (programme 56/5) : 17,000 EUR;
European Fund for Assistance to the Poor (programme 56/6, activity 1 and 2): 9 439 000 EUR.
Any undertaking to be made under this article is subject to the visa of the contract controller.
§ 2. By derogation from section 62 of the Act of 22 May 2003 on the organization of the federal budget and accounting, the following organic fund is authorized to present a debiting position in liquidation, which cannot exceed the amount mentioned:
European Fund for Assistance to the Poor (programme 56/6, activities 1 and 2): EUR 10,341,000. »
Art. 2.44.2
§ 1. By derogation from Article 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority and in accordance with Article 40, § 1, second sentence of the programme law of 26 December 2015, the available means of the European Fund of Refugees (formerly 26-7) (Program 55/3, Activity 6) deleted by the program law of 26 December 2015 are disaffected and are added to the general resources of the Treasury.
§ 2. By derogation from section 62, § 2, of the Act of 22 May 2003 on the organization of the budget and accounting of the federal authority and in accordance with section 42, § 1, second sentence of the program law of 26 December 2015, the available means of the Fund 44-5 for the computerization of the social heating fund (program 55/0, activity 9) deleted by the program law of 26 December 2015 are disaffected and are added to the general resources of the Treasury.
Chapter 3
Estimates of resources of organic budget funds
Art. 3-01-1
The means of the organic budget funds are re-estimated in accordance with the table annexed to this Act.
Chapter 4
Restitution and allocation funds
Art. 4.01.1
The transactions carried out on the restitution and allocation funds during the 2016 fiscal year are reassessed in accordance with the table annexed to this Act.
Section 5
Separate Management State Services
Art. 5.01.1
The budgets of the Separate Management State Services for the 2016 fiscal year are adjusted in accordance with the tables annexed to this Act.
Chapter 6
Public bodies
Art. 6.01.1
The budgets of the public interest bodies of Class A of the 2016 fiscal year are adjusted in accordance with the tables annexed to this Act.
Section 7
Final provisions
Art. 7.01.1
This Act comes into force on the day of its publication in the Belgian Monitor.
