22 MARCH 1999. - An Act to amend the municipal electoral law, coordinated on 4 August 1932 and the Act of 8 July 1976 of the public social welfare centres (1)



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. Article 75 of the communal electoral law, as amended by the laws of 5 July 1976 and 7 July 1994, is supplemented by a paragraph 3, which reads as follows:
“§3. When making a decision pursuant to paragraphs 1er and 2, the permanent deputation is an administrative court, whether or not it has been seized of a claim. »
Art. 3. In Article 18, paragraph 3, of the Act of 8 July 1976 of the State Social Welfare Centres, the first sentence is replaced by the following text:
"Whether or not a claim has been filed, the permanent deputation shall, as an administrative court, decide on the validity of the election within thirty days of the receipt of the file and, if so, correct the errors that have been made in the establishment of the result of the election. »
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
