4 MAI 1999. - An Act to amend the Act of April 13, 1995 relating to the commercial agency contract (1)

ALBERT II, King of the Belgians,

The Chambers adopted and We sanction the following:
Article 1^er
This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2
Section 3 of the Act of April 13, 1995 relating to the contract of a commercial agency on 2° and 3° are repealed.
Art. 3
Section 15 of the Act is supplemented by the following paragraphs:
"In the insurance, credit institutions and regulated securities markets, by derogation from the pre-determined subparagraphs, the contractor and its agents may conclude, within the framework of a parity consultation body, a convention to change the amount of the commissions or their method of calculation. The agreement entered into within the parity consultation body engages all agents and commits it, but the resulting amendments cannot result in the breach of the commercial agency contract.
After consultation with the representative organizations of the sectors concerned, the King may set out the modalities for the creation, organization and operation of this consultation. "
Art. 4
This Act does not apply to obligations whose enforcement has been sought before the date of its entry into force.
With respect to insurance, credit and regulated securities markets, section 16 of the Commercial Agency Contract Act of 13 April 1995 comes into force on 30 June 2000.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
