ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The House of Representatives adopted and sanctioned the following:
CHAPTER 1er. - General provisions
Art. 1-01-1
This Act regulates a matter referred to in Article 74, 3° of the Constitution.
Art. 1-01-2
The General Estimates for fiscal year 1999 are adjusted:
1° - in respect of the appropriations provided for the holdings, in accordance with the table annexed to this Act;
2° - in respect of appropriations by programme, in accordance with the totals of the programmes in adjusted departmental budgets annexed to this Act.
Art. 1-01-3
By derogation from Article 15 of the State Accounting Laws, coordinated on 17 July 1991, and in the event that the Balkan events are taking a development of an unforeseeable magnitude to date, the Council of Ministers is authorized to carry out a further breakdown of all the credits listed in the General Estimates of the year 1999, in order to identify the means strictly necessary for emergency humanitarian assistance.
CHAPTER 2. - Special provisions of departments
Section 11. - Services of the Prime Minister
Art. 2.11.1
In section 2.11.3 of the Act of 23 December 1998 containing the General Estimates for the 1999 Budget Year is included in the NATIONAL FRAMEWORK PROGRAMME 60/1 - RESEARCH AND DEVELOPMENT:
“16. Grant to finance the purchase of equipment for Parkinson's disease research. »
Section 13. - Ministry of the Interior
Art. 2.13.1
Section 2.13.3 of the Act of 23 December 1998 containing the General Estimates for the 1999 fiscal year is supplemented as follows:
« PROGRAMME 54/5 FONDS FOR NUCLEAR ACCIDENT RISKS
Financial contribution to the European Bank for Reconstruction and Development for the renovation of the sarcophagus around the Chernobyl plant. »
Section 14 Ministry of Foreign Affairs and Foreign Trade
Art. 2.14.1
Section 2.14.6 of the Act of 23 December 1998 containing the General Estimates for the 1999 Budget Year is supplemented as follows:
« PROGRAMME 53/1 - AND POLICY
3) Western European Union (WEU) programmes related to the acquisition of military observation satellites for security purposes. »
Section 15. - International cooperation
Art. 2.15.1
The text of section 2.15.5 of the Act of 23 December 1998 containing the General Estimates for the 1999 Budget Year is supplemented as follows:
PROGRAMME 54/3 - MULTILATERAL COOPERATION
« 4) Granting senior expertise. »
Art. 2.15.2
The text of section 2.15.10 of the Act is replaced by the following text:
54.01.11.06, 54.03.35.50, 54.03.35.51, 54.03.35.52, 54.03.35.53, 54.03.74.10, 54.03.74.22, 54.04.12.27, 54.11.35.10, 54.11.35.11, 54.12.35.20, 54.12.35.21, 54.12.35.22, 54.12.35.23, 54.35.54.
- for expenses of any kind as provided for in the language, explanatory note and the legal basis of the basic allowance;
- either for payments due to the Belgian Technical Cooperation (CTB), in accordance with the allocation agreements between the Member of the Government who has the International Cooperation in its responsibilities and the CTB and/or as a cover of the charges arising from the public service tasks. In this case, the necessary financial means provided for in the basic allowances that do not fall within program 1 - Government cooperation, may be transferred by way of a royal transfer order and by agreement of the Minister of Budget, to the following three specific basic allocations, intended for the execution of the payments to the CTB: 54.10.31.22 - Coverage of the management costs of the CTB (cnd), 54.10.35cr.01 - Tasks
However, the above applies only to new initiatives. The allocation agreements with the CTB, relating to initiatives already under way, must not result in new commitments. Payments may be carried out directly to the CTB, dependant on the basic allowances listed in the second paragraph of this article. »
Section 16. - Ministry of National Defence
Art. 2.16.1
In section 2.16.10 of the Act of 23 December 1998 containing the General Estimates for the fiscal year 1999, the second paragraph is replaced by the following paragraph:
PROGRAMME 90/3 SOCIAL, LOG AND CULTURAL
1. Civil Social Service;
2. Office Central d'Action Sociale et Culturelle (OCASC).
Art. 2.16.2
In section 2.16.14 of the Act, the amount of authorities of 1,379 million francs for infrastructure work is replaced by the amount of 600 million francs and the amount of 200 million francs for payments is replaced by the amount of 100 million francs.
Art. 2.16.3
Section 2.16.17 of the Act is repealed.
Art. 2.16.4
Section 2.16.18 of the Act is replaced by the following:
"The Central Office for Social and Cultural Action for the benefit of members of the military community (OCASC) is authorized to carry out missions as provided for in Article 1er of the Royal Decree of 10 January 1978, as amended by the Royal Decree of 7 December 1998, determining the mission and regulating the organization and operation of that body for the benefit of the personnel of the Force. »
Art. 2.16.5
In section 2.16.20, second paragraph of the Act, the amount of 661 million francs for the commitments is replaced by the amount of 908 million francs and the amount of 3,100 million francs for the payments is replaced by the amount of 2,050 million francs.
Art. 2.16.6
Section 2.16.22, last paragraph of the Act is replaced by the following text:
"For 1999 obligations and expenditures are limited to 100 million francs. »
Art. 2.16.7
In section 2.16.26 of the Act the following paragraph shall be inserted after the first paragraph:
"For 1999 obligations and expenditures are limited to 30 million francs. »
Section 17. - General Police Support Service and Gendarmerie
Art. 2.17.1
The text of section 2.17.4 of the Act of 23 December 1998 containing the General Estimates for the fiscal year 1999 is replaced by the following text:
" Within the limits of the basic allowance concerned, the following subsidy may be granted:
PROGRAMME 50/0 - SUBSISTANCE
- to the Central Office of Social and Cultural Action for the benefit of members of the military community (OCASC): the dependant share of the Force for staff costs, general operating expenses and expenses for intervention of the social service. »
Section 18. - Ministry of Finance
Art. 2.18.1
The Minister of Finance is authorized to:
- a contribution, in the form of a donation, to the World Bank's Trust Fund of 295 million BEF and a
- deposit of 300 million BEF with the International Monetary Fund (IMF).
These amounts will be taken from the reimbursement to Belgium on its part in a IMF reserve account called "conditional special account 2".
Art. 2.18.2
The provision "to cover the costs necessary for the implementation of the 1999-2000 inter-professional agreement" under program 60/1 may, after agreement of the Minister of Budget, be transferred, by way of a royal decree deliberated in the Council of Ministers, to the appropriate programme of the budget of the Ministry of Social Affairs, Public Health and the Environment.
Art. 2.18.3
Within the limits of the relevant basic allowance, the following contribution may be granted:
PROGRAMME 61/1 INTERNATIONAL FINANCIAL RELATIONS
Financing Belgium's participation in the Chernobyl Shelter Implementation Plan (SIP).
Art. 2.18.4
The provision "for the payment of the expenses of any kind relating to the crisis in Kosovo" under programme 60/1 may, after agreement of the Minister of Budget, be distributed by means of a royal decree deliberated in the Council of Ministers between the appropriate programmes of the departments concerned.
Section 19. - Ministry of Public Service
Art. 2.19.1
Section 2.19.8 of the Act of 23 December 1998 containing the General Estimates for the 1999 fiscal year, the amount of CHF 11,670,000 is replaced by CHF 13,300,000, and the amounts of CHF 10,000 and CHF 1,400,000 for the Courtrai Justice Palace and the new Hasselt Prison are replaced respectively by CHF 800,000 and CHF 0. In addition, the article is supplemented as follows: "Brussels, Foreign Affairs - Egmont II: 1,500,000 francs; Louvain, centre des Finances : 740 000 000 de francs".
Art. 2.19.2
The Minister who has the Régie des Bâtiments in his responsibilities is authorized to enter into an acquired rent with emphytéotic lease for the realization of Tower 4 of the W.T.C. complex in Brussels.
Section 21. - Pensions
Art. 2.21.1
In section 2.21.3, second paragraph, of the Act of 23 December 1998 containing the General Estimates for the fiscal year 1999, the amount of 4,100.0 million is replaced by the amount of 4,800.0 million francs.
Section 23. - Ministry of Employment and Labour
Art. 2.23.1
Section 2.23.1 of the Act of December 23, 1998 containing the General Estimates for the fiscal year 1999 is supplemented as follows:
3) ... to the effect of paying "possibly by way of advances" claims not exceeding 100,000 francs...
5) a maximum amount of CHF 2,000 000 to the accountant of the bilateral social collaboration service that is authorized to pay the claims of debt for delegations staying in Belgium as part of bilateral social collaboration.
Art. 2.23.2
Section 2.23.3 of the Act is supplemented as follows:
PROGRAMME 40/1 - INTERNATIONAL COLLABORATION
- Grant to the International Labour Organization in.... for the program "Children's work, job promotion and social dialogue. »
and
« PROGRAMME 56/5 - TRANSPORT REGION MARITIMES
- Grant to the Maritime Transport Regime to cover the expenses inherent in the salary of the statutory staff employed by the O.N.Em. »
Section 32. - Ministry of Economic Affairs
Art. 2.32.1
Section 2.32.4 of the Act of 23 December 1998 on the General Estimates for the 1999 Budget Year is supplemented as follows:
PROGRAMME 61/2 - AMELIORATION OF THE CONDITIONS OF VIEW AND SECURITY OF POPULATION, INCLUDING THE TRANSPOSITION OF EUROPEAN DIRECTIVES
Population information on energy records and administrative management of energy records.
Section 33. - Ministry of Communications and Infrastructure
Art. 2.33.1
Section 2.33.4 of the Act of December 23, 1998 containing the General Estimates for the fiscal year 1999 is supplemented as follows:
PROGRAMME 57/0
Subsides at the ABL Social Service of the Ministry of Communications and Infrastructure.
CHAPTER 3. - Restitution and allocation funds
Art. 3-01-1
Table 3 annexed to this Act replaces Table 3 - Restitution and allocation funds, annexed to the Act of 23 December 1998 containing the General Estimates for the 1999 fiscal year.
CHAPTER 4. - Separate Management State Services
Art. 4-01-1
The transactions during the 1999 fiscal year of the Permanent Secretariat for Recruitment (Public Service) and the Monetary Fund (Finance) are re-estimated to the sums mentioned in the budget annexed to this Act.
CHAPTER 5. - State enterprises
Art. 5-01-1
The budget for the 1999 fiscal year of the State company "La Monnaie Royale de Belgique", annexed to this Act, is approved.
Revenue is estimated at CHF 1,657 million and expenditure at CHF 1,579,160,000.
Revenues for order are estimated at CHF 92,250,000 and expenditure for order at CHF 97,500,000.
Art. 5-01-2
By derogation from Article 112 of the Laws on State Accounting, coordinated on 17 July 1991, the expenses resulting from the provision of goods or services are charged to the budget of the year in which the invoice is dated.
Art. 5-01-3
By derogation from Article 114 of the Laws on State Accounting, coordinated on 17 July 1991, the budget of capital transactions may include non-limitative credits. In this case, the wording mentions it.
This is limited to refunds and payments (sections 91.11 to 94.11 of the budget of the Royal Belgian Mint).
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
