The Chambers adopted and We sanction the following:
Single article. The Protocol amending Article 81 of the Treaty establishing the Benelux Economic Union of 3 February 1958, signed in Brussels on 16 February 1990, will come out its full and full effect.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.

Protocol Amending Article 81
of the Benelux Economic Union
The Government of the Kingdom of Belgium,
The Government of the Grand Duchy of Luxembourg,
The Government of the Kingdom of the Netherlands,
Considering that Article 81 of the Treaty establishing the Bénélux Economic Union was drafted under the empire of the Bretton Woods Agreements of July 1944,
Considering that a monetary system specific to the member states of the EEC was implemented on 13 March 1979, and that since then the realignment of monetary parities has been carried out by mutual agreement between the Member States,
Considering that at the present time there is no longer any unilateral change in the parity of its currency by one of the High Contracting Parties to which Article 81 refers,
In view of the opinion issued on 24 November 1989 by the Benelux Inter-Parliamentary Advisory Council,
The following agreed:
Article 1er.
Article 81 of the Treaty establishing the Benelux Economic Union signed at The Hague on 3 February 1958 is replaced by the following provision:
Article 81. 1. If the equivalence of the specific rates stipulated for the generally unified fees, taxes and levies is broken as a result of a realignment of the monetary parities within the European Monetary System, the rate(s) of the High Contracting Parties whose currency has decreased in value compared to that of the other High(s) Contracting Party(s) is less
The High(s) Contracting Party(s) will take/take the necessary national measures so that this increase comes into force within two months of the day of the decision to align the bets.
2. Derogation from paragraph 1er, the High Contracting Parties undertake to temporarily restore the equivalence between the excise rates on fruit fermented beverages by proceeding to a rapprochement on both sides, with respect to the total amount of the excise and the additional excise as well as to the additional excise, each for half of the difference resulting from the change in parity will be understood to be that the additional excise rate will be maintained
The High Contracting Parties shall take the necessary measures to ensure that these adjustments enter into force within two months from the date of the decision to align the bets.
3. The High Contracting Parties shall immediately agree from the date of the decision to realign the parity in the European Monetary System in order to finalize in each of their currencies the new common rates of duties, taxes, taxes and levies referred to in paragraphs 1 and 2 of this article.
Art. 2
1. This Protocol will be ratified. The instruments of ratification will be deposited with the Secretary-General of the Benelux Economic Union who will inform the Contracting Parties of the deposit of these instruments.
2. This Protocol shall enter into force on the first day of the month following the date of the deposit of the third instrument of ratification.

Done in Brussels on 16 February 1990, in triple copy, in French and Dutch languages, both texts being equally authentic.
(2) In accordance with Article 2.1, the Protocol entered into force on 1er September 1999 (international entry into force).
