The Chambers adopted and We sanction the following:
CHAPTER Ier. - General provision
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
CHAPTER II. - Amendment of the Act of 4 August 1996 on the welfare of workers during the execution of their work and the judicial code
Art. 2. Article 79, § 1er, of the Act of 4 August 1996 on the welfare of workers during the performance of their work, replaced by the Act of 28 February 1999, is replaced by the following provisions: "Without prejudice to the provisions of Article 32duodecies, employers, workers and representative organizations of workers may introduce to labour courts an action to settle any dispute relating to this Act or its enforcement orders. »
Art. 3. Section 81, paragraph 5, of the Judicial Code, replaced by the Act of 7 May 1999, is replaced by the following provision:
"In disputes relating to matters set out in sections 578, 4°, 5°, 6°, 8°, 10° and 11°, 579, 580, 582, 3° and 4°, and for the application to employers of administrative penalties provided for in section 583, one of the social judges must be appointed as an employer, the other as a worker. »
Art. 4. Section 104, paragraph 4, of the Judicial Code, replaced by the Act of 7 May 1999, is replaced by the following paragraph: "The Chambers who know of the appeal of a judgment rendered in a dispute relating to the matters set out in sections 578, 4°, 5°, 6°, 8°, 10° and 11°, 579, 580, 582, 3° and 4° respectively, or concerning the application to employers of administrative penalties set out in »
Art. 5. Article 578 of the Judicial Code, amended by the laws of 5 December 1968, 4 August 1978, 17 July 1997, 13 February 1998 and 7 May 1999, is supplemented as follows:
"11° of the disputes concerning violence and moral or sexual harassment at work, which are based on chapter Vbis of the Act of 4 August 1996 on the welfare of workers during the execution of their work. »
Art. 6. Article 764, paragraph 1er, 10° of the Judicial Code, replaced by the law of 23 April 1998, is replaced by the following provision: "10° requests under articles 578, 11°, 580, 581, 582, 1°, 2° and 6° and 583; »
Art. 7. This Act comes into force on the first day of the first month following the one in which it was published in the Belgian Monitor.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
