12 AVRIL 2004. - Act in the Act of 24 February 1921 concerning the trafficking of poisonous, soporific, narcotic, psychotropic, disinfectant or antiseptic substances and substances that may be used for the illicit manufacture of narcotic and psychotropic substances a provision re-authorizing judicial police officers to enter and search any place during the night without prior authorization from the police court (1)

The House of Representatives adopted and sanctioned the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. Article 6bis, as follows, is included in the Act of 24 February 1921 on trafficking in poisonous, soporific, narcotic, psychotropic, disinfectant or antiseptic substances and substances that may be used for the illicit manufacture of substances that may be used for the illicit manufacture of narcotic and psychotropic substances:
“Article 6bis. Judicial police officers may, at any time, enter freely in all places where the substances mentioned in this Act are sold, disposed of as expensive or not, manufactured, prepared or interproceded, or other places subject to their control, and searched them even if they are not accessible to the public and more generally all places in which they may have a reasonable ground to assume that there are offences to the provisions »
Art. 3. In Article 7, § 3, of the same Act, as introduced by the Act of 22 December 2003, the following paragraph shall be inserted between paragraphs 1er and 2:
"the jurisdiction to give a warning is also limited to offences related to veneer, soporific, disinfectant and antiseptic substances. »
Art. 4. Article 12, § 1erParagraph 1erfrom the same law as set out in the Act of 22 December 2003, the words "with the exception of offences related to narcotic, psychotropic substances and substances that can be used in the illegal manufacture of narcotic substances and psychotropic substances" are inserted between the words "his enforcement orders" and the words "the grievor-lawyer".
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
