23 JUNE 2004. - An Act to amend the Protection and Welfare of Animals Act of August 14, 1986, with respect to the accreditation of commercial animal establishments



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. Article 5, § 4, of the Law of 14 August 1986 on the Protection and Welfare of Animals, repealed by the Law of 4 May 1995, is reinstated in the following wording:
“§4. Where one of the measures referred to in section 42 is taken in an establishment referred to in § 1er, the Animal Welfare Service of the Federal Public Service Public Health, Food Chain Safety and Environment reports promptly to the Minister who has the well-being of animals in his or her duties. This report should not be done if the Federal Public Service Animal Welfare Service Public Health, Food and Environment Safety decides to return on bail.
The Minister may withdraw the approval granted to the establishment. This withdrawal shall, for the owner or holder who manages the establishment concerned and shall exercise direct supervision of the animals, prohibit the application of a new approval for a specified, indefinite or definitive period. In addition, the latter may not, during the period in question, manage an institution referred to in Article 5, § 1er, or exercise direct animal surveillance. "
Art. 3. Section 35 of the Act is supplemented by a 7° and 8°, as follows:
"7° shall apply for the operation of an establishment referred to in Article 5, § 1er, whereas it is subject to a prohibition referred to in § 4 of the same article;
8° manages an establishment referred to in Article 5, § 1er, and exercises direct supervision over the animals while it is subject to a prohibition referred to in § 4 of the same article. »
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
