To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. Section 43 of the Acts on the Use of Languages in Administrative Matters, coordinated on 18 July 1966, amended by the Acts of 19 October 1998, 27 December 2004 and 20 July 2005, are amended as follows:
1° in § 2, paragraph 1er, the words "holders of a management function or a managerial or coated function" are inserted between the words "public servants" and the words "of a rank of rank 13";
2° in § 3, paragraph 1er, the words "for management functions and for managerial functions as well as" are inserted between the word "However," and the words "for ranks 13";
3° in the Dutch text of § 3, paragraph 4, the word "rangen" is replaced by the word "graden";
4° in § 3, paragraph 4, the words "or management functions or supervision functions" are inserted between the words "or classes" and the words "constituting the same degree of hierarchy";
5° § 3, paragraph 6, is replaced by the following paragraph:
"After consultation with the same Commission, the King may, by a reasoned and deliberate order in the Council of Ministers, derogate from the distribution rule referred to in paragraph 1er, second sentence, in favour of central services whose functions or activities are of unequal interest to the French-language region and the Dutch-language region. ";
6° § 6 is replaced by the following provision:
"When the head of an administration is unilingual, he is placed alongside him, in order to maintain the unity of jurisprudence, a bilingual deputy. The deputy may not belong to the same role as the chief. It is precluded in the same grade or grade immediately below or in the same class immediately below.
If the Chief Administrative Officer holds a management position, the Bilingual Assistant retains its rank or class and receives an allowance fixed by the King by order deliberately in Council of Ministers.
The appointment of the bilingual deputy ends at the same time as the mandate assigned to the unilingual chief of the administration to which he is placed."
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
