The Chambers adopted and We sanction the following:
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
Art. 2. The King is authorized to accede to the 1988 Protocol on the 1974 International Convention for the Protection of Human Life at Sea, made in London on 11 November 1988, which will bring out its full and full effect.
The amendments to the 1988 Protocol which are adopted on the basis of Article VI of the 1988 Protocol, without Belgium opposing their adoption, will come out their full and full effect.
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.

1988 PROTOCOL on the 1974 International Convention for the Protection of Human Life at Sea
THE PARTIES TO THE PROTOCOL,
STATES PARTIES to the 1974 International Convention for the Protection of Human Life at Sea, made in London on 1er November 1974,
RECOGNIZING the need to introduce in the above-mentioned convention provisions on visits and issuance of certificates that are harmonized with the corresponding provisions of other international instruments,
REQUESTS that the best way to deal with this need is to conclude a protocol on the 1974 International Convention for the Protection of Human Life at Sea,
AGAINST the following:
ARTICLE 1
General obligations
1. The Parties to this Protocol undertake to give effect to the provisions of this Protocol and its Annex, which is an integral part of this Protocol. Any reference to this Protocol shall at the same time be a reference to its Annex.
2. The provisions of the 1974 International Convention for the Protection of Human Life at Sea, as amended, (hereinafter referred to as "the Convention") apply between the Parties to this Protocol subject to the amendments and additions set out in this Protocol.
3. The Parties to this Protocol shall apply to vessels authorized to beat the flag of a State that is not a Party to the Convention and to this Protocol the requirements of the Convention and this Protocol to the extent that this is necessary to avoid the benefit of such vessels under more favourable conditions.
ARTICLE II
Prior treaties
1. The present Protocol replaces and repeals the 1978 Protocol on the Convention between the Parties to this Protocol.
2. Notwithstanding any other provisions of this Protocol, any certificate issued under and in conformity with the provisions of the Convention and any supplement to such certificate issued under and in accordance with the provisions of the 1978 Protocol relating to the Convention, which is valid at the time this Protocol enters into force with respect to the Party which has issued the certificate or supplement, shall remain valid until it expires under the Convention or the 1978 Protocol relating to the Convention.
3. A Party to this Protocol shall not issue a certificate in accordance with and in conformity with the requirements of the 1974 International Convention for the Protection of Human Life at Sea, as adopted on 1er November 1974.
ARTICLE III
Disclosure of information
The Parties to this Protocol undertake to communicate to the Secretary-General of the International Maritime Organization (hereinafter referred to as the "Organization") and to deposit with him:
(a) the text of laws, decrees, orders, regulations and other instruments promulgated on the various issues that fall within the scope of this Protocol;
(b) a list of designated inspectors or recognized bodies that are authorized to act on their behalf in the application of measures for the protection of human life at sea, with a view to its dissemination to the Parties that will bring it to the knowledge of their officials, and a description of the specific responsibilities entrusted to designated inspectors or recognized bodies and the conditions of such authorization; and
(c) a sufficient number of models of certificates issued by them in accordance with the provisions of this Protocol.
ARTICLE IV
Signature, ratification, acceptance, approval and accession
1. This Protocol shall be open for signature at United Nations Headquarters of 1er March 1989 to 28 February 1990 and then remains open to membership. Subject to paragraph 3, States may express their consent to be bound by this Protocol by:
(a) unconditional signature of ratification, acceptance or approval; or
(b) signature subject to ratification, acceptance or approval followed by ratification, acceptance or approval; or
(c) accession.
2. Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General of the Organization.
3. This Protocol shall not be subject to full signature, ratification, acceptance, approval or accession by any State that has signed, ratified, accepted or approved the Convention or acceded to it.
ARTICLE V
Entry into force
1. This Protocol comes into force twelve months after the date on which the following two conditions are met:
(a) at least fifteen States whose merchant fleets total at least 50% of the gross tonnage of the world fleet of trade ships expressed their consent to be bound by this protocol in accordance with the provisions of Article IV, and
(b) the conditions of entry into force of the 1988 Protocol relating to the 1966 International Convention on Load Lines are met, provided that this Protocol does not enter into force before 1er February 1992.
2. ÷ in respect of States that have deposited an instrument of ratification, acceptance of approval or accession relating to this Protocol after the conditions of its entry into force have been met but before the date of its entry into force, ratification, acceptance, approval or accession shall take effect on the date of entry into force of this Protocol or three months after the date of deposit of the instrument, if that date is later.
3. Any instrument of ratification, acceptance, approval or accession deposited after the date of entry into force of this Protocol shall take effect three months after the date of deposit.
4. Any instrument of ratification, acceptance, approval or accession deposited after the date on which an amendment to this Protocol is deemed to have been accepted pursuant to Article VI applies to the Protocol in its amended form.
ARTICLE VI
Amendments
The procedures set out in Article VIII of the Convention shall apply to the amendments to this Protocol, provided that:
(a) the references of this Article to the Convention and to the Contracting Governments shall be as references to this Protocol and to the Parties to this Protocol respectively;
(b) amendments to articles and to the Annex to this Protocol shall be adopted and brought into force in accordance with the procedure applicable to amendments to articles of the Convention or Chapter I of the Annex to the Convention; and
(c) amendments to the Appendix to this Protocol may be adopted and brought into force in accordance with the procedure applicable to amendments to the Annex to the Convention, with the exception of Chapter I.
ARTICLE VII
Denunciation
1. This Protocol may be denounced by any of the Parties at any time after the expiry of a five-year period from the date on which this Protocol enters into force for that Party.
2. The denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary General of the Organization.
3. The denunciation takes effect one year after the date on which the Secretary-General of the Organization received notification of the denunciation, or at the expiry of another longer period specified in the denunciation instrument.
4. Any denunciation of the Convention by a Party constitutes a denunciation of this Protocol by that Party. Such denunciation shall take effect on the date on which the denunciation of the Convention takes effect in accordance with Article XI (c) of the Convention.
ARTICLE VIII
Depositary
1. This Protocol shall be deposited with the Secretary-General of the Organization (hereinafter referred to as "the depositary").
2. The depositary:
(a) inform the Governments of all States that have signed or acceded to this Protocol:
(i) any new signature or new deposit of instrument of ratification, acceptance, approval or accession and the date of such signature or deposit;
(ii) the effective date of this Protocol;
(iii) the deposit of any instrument denouncing this Protocol, the date on which that instrument was received and the date on which the denunciation takes effect;
(b) transmit certified copies of this Protocol to the Governments of all States that have signed or acceded to it.
3. Upon entry into force of this Protocol, the depositary shall transmit a certified copy thereof to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.
ARTICLE IX
Languages
This Protocol shall be established in a single original copy in the English, Arabic, Chinese, Spanish, French and Russian languages, each text being equally authentic. It is made an official translation in Italian language that is filed with the original copy coated with signatures.

Annex
Amendments and additions to the Annex to the 1974 International Convention for the Protection of Human Life at Sea
Chapter I
GENERAL PROVISIONS
PART A - APPLICATION DEFINITIONS, ETC.
Rule 2
Definitions
Replace the current text of paragraph (k) with the following:
“(k) New ship means a vessel whose keel is placed or whose construction is at an equivalent stage on or after May 25, 1980. »
Add the following paragraph to the current text:
"(n) Birthday date refers to the day and month of each year that corresponds to the expiry date of the relevant certificate. »
PART B - VISITES AND CERTIFICATES
Rule 6
Inspection and visits
Replace the current text with the following:
“(a) Inspection and inspection of vessels, with respect to the application of the provisions of these rules and the granting of exemptions that may be granted, shall be carried out by officials of the Authority. However, the Authority may entrust the inspection and inspection of its vessels, either to designated inspectors or to organizations recognized by it.
(b) Any administration designating inspectors or recognized bodies to conduct inspections and visits as provided for in paragraph (a) shall at least authorize any designated inspector or agency to:
(i) require that a vessel undergo repairs;
(ii) conduct inspections and visits if requested by the competent authorities of the port State.
The Administration shall notify the Organization of the specific responsibilities entrusted to the designated inspectors or recognized bodies and the conditions of the authority delegated to them.
(c) Where a designated inspector or a recognized body determines that the state of the vessel or its armament does not in substance correspond to the indications of the certificate or is such that the vessel cannot take the sea safely for the ship itself or the persons on board, the inspector or agency must immediately ensure that corrective actions are taken and must inform the Authority in due course. If these corrective actions are not taken, the relevant certificate should be withdrawn and the Administration must be informed immediately; if the vessel is in a port of another Party, the competent authorities of the port State must also be informed immediately. Where an officer of the Administration, a designated inspector or a recognized body has informed the competent authorities of the port State, the government of the port State concerned shall grant to the official, inspector or agency in question all the assistance necessary to enable him to discharge his obligations under this rule. Where applicable, the government of the interested port State must ensure that the vessel is prevented from aircrafting until it can take the sea or leave the port to the appropriate repair site safely for the ship itself or for the persons on board.
(d) In all cases, the Administration must be fully responsible for the complete execution and effectiveness of the inspection and visit and must undertake to take the necessary steps to meet this obligation. »
Rule 7
Visits to passenger vessels
Replace the current text with the following:
“(a) Any passenger vessel shall be subject to the visits specified below:
(i) an initial visit prior to the commission of the vessel;
(ii) a renewal visit every twelve months, except where rules 14 (b), 14 (e), 14 (f) and 14 (g) apply;
(iii) additional visits, as required.
(b) The above visits shall be carried out as follows:
(i) the initial visit must include a complete inspection of the vessel's structure, its machinery and its weapons equipment, including the outer face of the vessel's bottom, as well as the interior and exterior of the boilers. This visit shall ensure that the general provision, materials and samples of the structure, boilers, other pressure receptacles and their auxiliaries, the main and auxiliary machinery, the electrical installations, the radio installations, including those used in the life-saving equipment, the systems and the safety and protection devices against the fire, the equipment and the rescue devices present, the navigation equipment of the shipboard, the publications The visit must also be made to ensure that the state of all parts of the vessel and its armament is satisfactory in all respects, and that the vessel is provided with the lights, marks, sound signals and distress signals prescribed by the provisions of these rules and international regulations to prevent collisions at sea in force;
(ii) the renewal visit shall include an inspection of the structure, boilers and other pressure receptacles, machinery and weapons, including the outer face of the vessel's bottom. This visit shall ensure that, with respect to the structure, boilers and other pressure receptacles and their auxiliaries, the main and auxiliary machinery, the electrical installations, the radio installations, including those used in the rescue equipment, the systems and the safety and protection devices against fire, the equipment and the rescue devices, the navigation equipment on board, the nautical publications satisfied, the means of The lamps, marks, means of sound signalling and distress signals placed on board must also be submitted to the above-mentioned visit to ensure that they comply with the requirements of these rules and international regulations to prevent collisions at sea in force;

The visit shall ensure that the necessary repairs or renovations have actually been carried out, that the materials used for these repairs or renovations and the execution of the work are at all satisfactory points of view and that the vessel shall meet in all respects the requirements of these rules and international regulations to prevent collisions at sea in force, as well as the provisions of the laws, decrees, orders and regulations promulgated by the Administration for the purposes of these rules and regulations.
(c) (i) The laws, decrees, orders and regulations referred to in paragraph (b) of this rule shall be such in all respects, that from the point of view of safeguarding human life, the vessel shall be appropriate to the service to which it is intended;
(ii) these laws, orders and regulations shall, inter alia, establish the requirements for hydraulic tests, or other acceptable tests, before and after the commissioning, applicable to main and auxiliary boilers, connections, steam pipes, high pressure tanks, liquid fuel tanks for internal combustion engines, including test procedures and intervals between two consecutive tests. »
Rule 8
Visits of rescue equipment and other parts of the arming of cargo ships
Replace the current text with the following:
“(a) Rescue equipment and other parts of the arming of the cargo vessels of a gross tonnage equal to or greater than 500 tons, which are referred to in paragraph (b) (i), shall be subject to the visits specified below:
(i) an initial visit prior to the commission of the vessel;
(ii) renewal visits made at the time intervals specified by the Authority but not exceeding five years, except where rules 14 (b), 14 (e), 14 (f) and 14 (g) apply;
(iii) a periodic visit made within three months prior to or after the second anniversary date or within three months before or after the third anniversary of the Certificate of Safety of Armoury Equipment for Ships, which must replace one of the annual visits specified in paragraph (a) (iv);
(iv) an annual visit made within three months before or after each anniversary of the Certificate of Safety of Arming Equipment for Ships of Charge;
(v) additional visits as prescribed in Rule 7 (b) (iii) for passenger vessels.
(b) The visits specified in paragraph (a) shall be carried out as follows:
(i) the initial visit shall include a complete inspection of fire protection systems and devices, life-saving equipment and devices, except for radio installations, navigational equipment, the means of boarding of pilots and other parts of the weapon to which Chapters II-1, II-2, III and V apply, and allow them to verify that they comply with the requirements of these rules, that they are suitable for the purpose of the vessel and that they are The above-mentioned visit must also verify that fire control plans, nautical publications, fires, marks, sound signals and distress signals placed on board meet the requirements of these rules and, where appropriate, the International Regulations to Prevent Sea Collisions in force;
(ii) Renewal visits and periodic visits shall include an inspection of the equipment referred to in paragraph (b) (i) and allow verification that it meets the relevant requirements of these Rules and of the International Regulations to prevent collisions at sea in force, is in a satisfactory condition and is suitable for the service to which the vessel is intended;
(iii) the annual visit shall include a general inspection of the equipment referred to in subsection (b) (i) and allow for verification that it has been maintained under the conditions set out in Rule 11 (a) and that it remains satisfactory for the service to which the vessel is intended.
(c) Periodic visits and annual visits specified in paragraphs (a) (iii) and (a) (iv) shall be carried on the Certificate of Safety of Arming Equipment for Ships of Charge. »
Rule 9
Visits to the radio and radar installations of cargo vessels

“(a) The radio facilities of the cargo vessels, to which Chapters III and IV apply, including those used in the life-saving equipment, shall be subject to the visits specified below:
(i) an initial visit prior to the commission of the vessel;
(ii) renewal visits made at the time intervals specified by the Authority but not exceeding five years, except where rules 14 (b), 14 (e), 14 (f) and 14 (g) apply;
(iii) a periodic visit made within three months before or after each anniversary of the Certificate of Safety of Radio-Equipment for Dependant Ships;
(iv) additional visits, as prescribed in Rule 7 (b) (iii) for passenger vessels.
(b) The visits specified in paragraph (a) shall be carried out as follows:
(i) the initial visit shall include a complete inspection of the radio facilities of the cargo vessels, including those used in the life-saving appliances, and shall verify that they meet the requirements of these rules;
(ii) Renewal visits and periodic visits shall include an inspection of the radio facilities of the cargo vessels, including those used in the life-saving appliances, and allow for verification that they meet the requirements of these rules.
(c) The periodic visits specified in paragraph (a) (iii) shall be carried on the Certificate of Safety of Radio-Electric Equipment for Dependant Ships. »
Rule 10
Visits to the hull, machinery and equipment of cargo ships

“(a) In the case of a ship of charge, the structure, machinery and equipment referred to in paragraph (b) (i) (other than the items for which a Certificate of Safety of Armoured Equipment and a Radio Safety Certificate for Ship of Charge are issued) shall be subject to the visits and inspections specified below:
(i) an initial visit that includes an inspection of the outer face of the vessel's bottom before it is commissioned;
(ii) renewal visits made at the time intervals specified by the Authority but not exceeding five years, except where rules 14 (b),14 (e), 14 (f) and 14 (g) apply;
(iii) an intermediate visit made within three months prior to or after the second anniversary date or within three months before or after the third anniversary of the Certificate of Construction Security for Ships, which must replace one of the annual visits specified in paragraph (a) (iv);
(iv) an annual visit made within three months prior to or after each anniversary date of the Certificate of Construction Security for Shipyard;
(v) at least two inspections of the outer face of the vessel's bottom during any five-year period, except where rules 14 (e) or 14 (f) apply. Where rules 14 (e) or 14 (f) apply, this five-year period may be extended to coincide with the extension of the validity of the certificate. In all cases, the interval between two such inspections shall not exceed thirty-six months;
(vi) additional visits, as prescribed in Rule 7 (b) (iii) for passenger vessels.
(b) The visits and inspections specified in paragraph (a) shall be carried out as follows:
(i) the initial visit must include a complete inspection of the structure, machinery and weapons equipment. This visit shall ensure that the general provision, materials, samples and condition of the structure, boilers and other pressure receptacles and their auxiliaries, the main and auxiliary machinery, including the steering apparatus and associated control systems, the electrical installation and all other parts of the armament meet the requirements of these rules, are in a satisfactory condition and are suitable for the service to which the vessel is intended, In the case of tank vessels, this visit shall include an inspection of pump chambers, piping circuits of cargo and fuel, air vents and associated safety devices;
(ii) Renewal visits shall include an inspection of the structure, machinery and equipment referred to in paragraph (b) (i) and ensure that they meet the requirements of these rules, that they are in a satisfactory condition and that they are suitable for the service to which the vessel is intended;
(iii) the intermediate visit shall include an inspection of the structure, boilers and other pressure receptacles, weapons machines and equipment, the steering apparatus and associated control systems, as well as electrical installations and ensure that they remain satisfactory for the service to which the vessel is intended. In the case of tank vessels, this visit must also include an inspection of pump chambers, piping circuits of cargo and fuel, air vents and associated safety devices, as well as testing the isolation resistance of electrical installations in hazardous areas;
(iv) the annual visit shall include a general inspection of the structure, machinery and equipment referred to in paragraph (b) (i) to ensure that they have been maintained under the conditions set out in Rule 11 (a) and remain satisfactory for the service to which the vessel is intended;
(v) the inspection of the outer face of the vessel's bottom and the examination of the related elements, which is taking place at the same time, shall ensure that they remain satisfactory for the service to which the vessel is intended.
(c) annual visits, intermediate visits and inspections of the external face of the vessel's bottom specified in paragraphs (a) (iii), (a) (iv) and (a) (v) shall be carried on the Certificate of Construction Security for the cargo vessel. »
Rule 11
Maintenance of conditions after visit

“(a) The state of the vessel and its weaponry shall be maintained in accordance with the requirements of these rules so that the safety of the vessel remains at all satisfactory points of view and that the vessel may take the sea safely for himself or the persons on board.
(b) After any of the visits provided for in rules 7, 8, 9 or 10, no change shall be made to the structural provisions, machinery, equipment or other elements subject to the visit unless authorized by the Administration.
(c) Where an accident on board a vessel or a failure on board jeopardizes the safety of the vessel or the efficiency or effectiveness of all life-saving equipment or other fittings, the master or owner of the vessel shall report to the Administration, designated inspector or recognized body responsible for issuing the relevant certificate as soon as practicable, which shall conduct an investigation to determine whether a visit is required in accordance with the requirements of rules 7, If the vessel is in a port of another contracting government, the master or owner must also report immediately to the competent authorities of the port State and the designated inspector or recognized agency must ensure that such a report has been made. »
Rule 12
Certificates issued

(i) A certificate known as Passenger Ship Safety Certificate shall be issued after an initial visit or renewal visit to any passenger vessel that meets the relevant requirements of Chapters II-1, II-2, III, IV and V and other relevant requirements of these Rules;
(ii) a certificate known as the Certificate of Construction Safety for a cargo ship shall be issued after an initial visit or a renewal visit to any cargo vessel that meets the relevant requirements of Chapters II-1 and II-2 (other than those relating to fire protection systems and devices and fire control plans) and other relevant requirements of these Rules;
(iii) a certificate known as the Certificate of Safety of Arming Equipment for Ships of Charge shall be issued after an initial visit or a renewal visit to any ship of charge that meets the relevant requirements of Chapters II-1, II-2, III and V and other relevant requirements of these Rules;
(iv) a certificate known as the Radio Safety Certificate for the cargo ship shall be issued after an initial visit or a renewal visit to any cargo vessel that meets the relevant requirements of Chapter IV and other relevant requirements of these rules;
(v) (1) instead of the certificates specified in paragraphs (a) (ii), (a) (iii) and (a) (iv), a certificate known as the Certificate of Security for the cargo ship may be issued, upon an initial visit or a renewal visit, to any cargo vessel that meets the relevant requirements of chapters II-1, II-2, III, IV and V and other relevant requirements of these rules;
(2) each time reference is made in this chapter to the Certificate of Construction Security for Ships of Charge, the Certificate of Safety of Arming Equipment for Ships of Charge or the Certificate of Radio-Electric Safety for Ships of Charge, the reference is to the Certificate of Safety for Ships of Charge, if used instead of the above-mentioned certificates;
(vi) the Passenger Ship Safety Certificate, the Sealing Ship Safety Certificate, the Carry Ship Safety Certificate, the Carry Ship Safety Certificate, and the Sealing Ship Safety Certificate referred to in subparagraphs (i), (iii), (iv) and (v) must be supplemented by an equipment sheet;
(vii) where an exemption is granted to a vessel in accordance with and in accordance with the requirements of these rules, a certificate of exemption shall be issued in addition to the certificates prescribed in this paragraph;
(viii) the certificates specified in this rule shall be issued or a visa shall be affixed to it, either by the Administration or by any person authorized by the Authority. In all cases, the Administration assumes full responsibility for the certificates.
(b) A Contracting Government shall not issue a certificate in accordance with and in conformity with the requirements of the 1960, 1948 or 1929 International Conventions for the Protection of Human Life at Sea, after the date on which this Convention comes into force for it. »
Rule 13
Certificate issued by another government

"A Contracting Government may, at the request of the Authority, have a ship visited. If it considers that the requirements of these rules are observed, it shall issue certificates to the vessel or authorize the issuance of certificates and, where applicable, apply a visa or authorize its application on the certificates available to the vessel in accordance with these rules. Any such certificate must contain a statement stating that it was issued at the request of the government of the State whose ship is authorized to defeat the flag. It has the same value and is accepted under the same conditions as a certificate issued under Rule 12. »

“(a) The Passenger Vessel Safety Certificate shall not be issued for a period exceeding twelve months. The Certificate of Construction Safety for Ships of Charge, the Certificate of Security for Armoured Ship Equipment and the Certificate of Radio-Electric Safety for Ships of Charge shall be issued for a period of time fixed by the Administration, without the duration of such a period exceeding five years. The Certificate of Exemption shall not have a validity period greater than that of the certificate to which it refers;
(b)
(i) Notwithstanding the requirements of paragraph (a), where the renewal visit is completed within three months of the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of the renewal visit until the following date:
(1) in the case of a passenger vessel, a date not later than twelve months after the expiry date of the existing certificate;
(2) in the case of a ship of charge, a date that is not more than five years after the expiry date of the existing certificate;
(ii) where the renewal visit is completed after the expiry date of the existing certificate, the new certificate is valid from the date of completion of the renewal visit until the following date:
(1) in the case of a passenger vessel, a date not later than twelve months after the expiry date of the existing certificate;
(2) in the case of a ship of charge, a date that is not more than five years after the expiry date of the existing certificate;
(iii) where the renewal visit is completed more than three months before the expiry date of the existing certificate, the new certificate is valid from the date of completion of the renewal visit until the following date:
(1) in the case of a passenger vessel, a date not later than twelve months after the date of completion of the renewal visit;
(2) in the case of a dependant vessel, a date that is not later than five years after the date of completion of the renewal visit.
(c) Where a certificate other than a Passenger Vessel Safety Certificate is issued for a period of less than five years, the Authority may extend the validity of the certificate beyond the expiry date up to the maximum period specified in paragraph (a), provided that the visits specified in rules 8, 9 and 10, which are to take place when the certificate is issued for five years, are carried out as required.
(d) If, after a renewal visit, a new certificate may not be issued or provided to the vessel before the expiry date of the existing certificate, the person or body authorized by the Administration may apply a visa to the existing certificate and that certificate must be accepted as valid for a new period that may not exceed five months from the expiry date.
(e) If, on the expiry date of a certificate, the vessel is not in a port in which the vessel is to be visited, the Authority may extend the validity of the certificate. However, such an extension must be granted only to allow the vessel to complete its journey to the port in which it is to be visited, only in the event that this measure appears to be timely and reasonable. No certificate shall thus be extended for a period of more than three months and a vessel to which this extension has been granted is not entitled, under this extension, after arriving at the port in which it is to be visited, to leave without having obtained a new certificate. When the renewal visit is completed, the new certificate is valid until the following date:
(i) in the case of a passenger vessel, a date not later than twelve months after the expiry date of the existing certificate before the extension has been granted;
(ii) in the case of a dependant vessel, a date that is not later than five years after the expiry date of the existing certificate before the extension has been granted.
(f) A certificate issued to a vessel carrying out short travel, which has not been extended in accordance with the preceding provisions of this rule may be extended by the Administration for a period of grace not exceeding one month the expiration date specified on this certificate. When the renewal visit is completed, the new certificate is valid until the following date:
(i) in the case of a passenger vessel, a date not later than twelve months after the expiry date of the existing certificate before the extension has been granted;
(ii) in the case of a dependant vessel, a date that is not later than five years after the expiry date of the existing certificate before the extension has been granted.
(g) In certain specific cases determined by the Administration, it is not necessary that the validity of the new certificate begin on the expiry date of the existing certificate, in accordance with the requirements of paragraphs (b) (ii), (e) or (f). In these particular cases, the new certificate is valid until the following date:
(i) in the case of a passenger vessel, a date not later than twelve months after the date of completion of the renewal visit;
(ii) in the case of a ship of charge, a date that is not later than five years after the date of completion of the renewal visit.
(h) When an annual, intermediate or periodic visit is completed within a period of less than that specified in the relevant rule:
(i) the anniversary date on the certificate in question is replaced by a visa by a date not to be after more than three months on the date the visit was completed;
(ii) the following annual, intermediate or periodic visit prescribed by the relevant rules must be completed at the intervals specified by these rules, calculated from the new anniversary date;
(iii) the expiration date may remain unchanged, provided that one or more annual, intermediate or periodic visits, as the case may be, are conducted in such a way that the maximum intervals between visits prescribed by the relevant rules are not exceeded.
(i) A certificate issued under Rule 12 or Rule 13 shall cease to be valid in any of the following cases:
(i) if the relevant visits and inspections are not completed within the time limits specified in rules 7 (a), 8 (a), 9 (a) and 10 (a);
(ii) if the visas provided for in these rules have not been applied to the certificate;
(iii) if a ship passes under the flag of another State. A new certificate shall be issued only if the Government issuing the new certificate is satisfied that the vessel meets the requirements of rules 11 (a) and 11 (b). In the case of a pavilion transfer between contracting governments, if the request is made within three months of the transfer, the Government of the State whose ship was previously authorized to beat flag shall, as soon as possible, address to the Administration copies of the certificates provided by the ship before the transfer, as well as copies of the inspection reports, if any. »

“(a) Every ship is subject, in a port of another contracting government, to the control of officials duly authorized by that government to the extent that the control is intended to verify that the certificates issued under Rule 12 or Rule 13 are valid.
(b) These certificates, if valid, must be accepted unless there is good reason to believe that the state of the ship or its weaponry does not correspond in substance to the indications of any of these certificates or that the vessel and its weaponry do not comply with the provisions of rules 11 (a) and 11 (b).
(c) In the circumstances set out in subsection (b) and in the event that a certificate has expired or ceased to be valid, the officer exercising control shall take the necessary measures to prevent the vessel from aircrafting until it is able to take the sea or leave the port to the appropriate repair site, without danger to the vessel itself or the persons on board.
(d) In cases where the control would result in any intervention, the officer exercising control must immediately and in writing inform the consul or, in his absence, the closest diplomatic representative of the State whose ship is authorized to beat the flag, of all the circumstances that made this intervention considered necessary. In addition, designated inspectors or recognized bodies responsible for issuing certificates must also be notified. It must be reported to the Organization of Facts concerning this intervention.
(e) The authority of the port State concerned shall communicate all relevant information relevant to the vessel to the authorities of the next port of call, as well as to the persons and organizations mentioned in paragraph (d), if it cannot take the measures specified in paragraphs (c) and (d) or if the vessel has been authorized to go to the next port of call.
(f) In the exercise of control under this rule, the vessel must be unduly retained or delayed to the extent possible. Any vessel that has been unduly retained or delayed as a result of the exercise of this control is entitled to compensation for losses or damages incurred. »
