13 NOVEMBER 2011. - An Act to amend the Act of July 22, 1985 on Civil Liability in the Field of Nuclear Energy (1)

The Chambers adopted and We sanction the following:
. - Introductory provision
. This Act regulates a matter referred to in Article 78 of the Constitution.
CHAPTER 2. - Amending provision of the Act of 22 July 1985
on Civil Liability in the Field of Nuclear Energy
Art. 2. In section 7 of the Act of 22 July 1985 on civil liability in the field of nuclear energy, as amended by the Act of 11 July 2000, the following amendments are made:
1° in paragraph 1er
the words "297.472.229.73 euros" are replaced by the words "1.2 billion euros";
2° the last paragraph is replaced by the following:
"The amounts fixed under paragraph 2, 2°, cannot be lower, for transport, to 80 million euros and, for nuclear facilities, to 70 million euros. »
CHAPTER 3. - Abrogatory and transitional provisions
Art. 3. Section 37 of the Act is repealed.
Art. 4. Operators to whom recognition has been granted under the Act of 22 July 1985 on civil liability in the field of nuclear energy, as amended by the Act of 11 July 2000, shall retain the benefit of such recognition provided that they have adapted to the provisions of this Act, in the noon days following its entry into force, insurance or any other financial guarantee covering their liability.
CHAPTER 4. - Entry into force
Art. 5. This Act comes into force on 1er
Promulgate this law, order that it be clothed with the seal of the State and published by the Belgian Monitor.
