The Chambers adopted and We sanction the following:
Article 1
er. This Act regulates a matter referred to in Article 78 of the Constitution.
Art. 2. In the Act of 26 April 2010 on various provisions concerning the organization of supplementary health insurance, Article 72, the current text of which will form § 1
er, is supplemented by § 2 written as follows:
“§2. By derogation from Article 38, paragraph 2, of the Act of 9 July 1975 referred to above, the reviewer referred to in the preceding paragraph may exercise a revisoral mandate, without being approved in accordance with Article 40 of the Law of 9 July 1975, in the mutualist society referred to in Article 43bis, § 5, of the Law of 6 August 1990 which would be constituted before 1
er January 2012 by contribution of activities referred to in Article 2, § 1
erter, paragraph 1
er, the Act of 9 July 1975, namely health insurance within the meaning of branch 2 of Schedule 1
re of the Royal Decree of 22 February 1991 on the General Regulation respecting the control of insurance companies, as well as the supplementary coverage of the risks that belong to the assistance as referred to in branch 18 of Schedule 1
re to the extent that these activities were carried out previously by the mutualist society referred to in Article 70 § 1
erParagraph 1
er(a), or § 2, subparagraphs 1
er or 2, of the Act of 6 August 1990 referred to in the preceding paragraph, the mutuality or national union in which the reviewer exercised a revisoral mandate. This exemption is for the duration that would have been applied in accordance with the preceding paragraph if the reviewer had continued his mandate with the existing mutualist company, referred to in Article 70, § 1

er(a), or § 2, subparagraphs 1
er or 2, the Act of 6 August 1990, the mutuality or the national union referred to above. »
