The Chambers have adopted and we endorse the following: Chapter 1. -Provisions general article
1-01-1 this Act regulates a matter referred to in article 74, 3 ° of the Constitution.
S.
1 01-2 the general estimates of the fiscal year 2012 is approved: 1 ° in relation to the provision made for endowments, in accordance with the table y related annexed to this Act;
2 ° in relation to funds by programme, in accordance with the totals of the programs contained in budgets by section and by basic allowance, annexed to this Act.
S. 1-01-3 § 1. -The appropriations for programs relating to Government - called livelihood programs - operating expenses include: 1. the remuneration and allowances generally any active staff and availability, the remuneration or wages of auxiliary staff, allowances for higher functions and special functions, intervention in subscriptions to public transit, compensation for accidents at work - including payment of these allowances to members of the family of the victim in the case death - as well as the fees and reduced salaries of temporary or auxiliary staff, injured in service.
2 miscellaneous social service.
3 ongoing costs for purchases of non-durable goods and services:-fees of lawyers and doctors - legal costs in civil, administrative and criminal - cases attendance fees, costs of road and residence of persons foreign to the administrations of the State - remuneration of foreign administration experts and services of third parties;
-Consumer spending relating to the occupation of the premises - including "oil, gas, gasoline, electricity, coal" energy consumer spending - and expenses maintenance - expenses office, transport, taxes, payments, publications of the Department, training professional, clothing and other small administrative expenses;
-Allowances whatsoever to the staff of the State for actual expenses and damage materials, transportation costs relating to travel of service and premiums for insurance of the delegates of the Department going abroad.
4 miscellaneous expenses relating to computing operation.
5. exceptional expenditure for purchases of non-durable goods and services, such as the work and supplies for new space and moving expenses.
6 real estate rents and taxes y of the various services of the Department, paid without the intervention of the Board's buildings.
7. other expenses relating to the operation of the services, including the detailed description is provided in the livelihood programs.
8 expenditures for the acquisition of durable furniture goods: machinery, furniture, equipment and means of transportation.
9 expenses relating to computing investment.
§ 2. By way of derogation from article 52, paragraph 1, 1 °, of the law of 22 May 2003 on the organisation of the budget and the accounts of the federal State, the commitment appropriations for basic allowances relating to the remuneration and allowances whatsoever "11.00.03 - final and trainee staff" and "11.00.04 - other staff" as well as basic 12.00.48 and 12.21.48 may be redistributed between them and only them within a single section of the budget.
This derogation shall not apply to basic allowances relating to the expenditure of the strategic bodies of Ministers and Secretaries of State.
§ 3. By way of derogation from article 52, paragraph 1, 1 °, of the law of 22 May 2003 on the organisation of the budget and the accounts of the federal State, the commitment appropriations of basic 1100.05 and 1140.05 - social service expenditures - and a basic benefit expenses of operating and investment offer of economic codes 12 and 74, specific or non and under or rather than a subsistence program can be redistributed between them and only them within a single section of the budget.
This derogation shall not apply to basic allowances relating to expenditures of the strategic bodies of Ministers and Secretaries of State, or basic 12.00.48 and 12.21.48.
§ 4. By way of derogation from paragraph 3, basic y referred may be redistributed within a same section of the budget, also to basic 21.00.01 and 21.40.01 § 5. Notwithstanding article 52 of the law of 22 May 2003 on the organisation of the budget and accounting for the federal State and without prejudice to the provisions of §§ 2 to 4, the president of the competent Management Committee may, after the agreement of the president of the Board of Directors of the FPS Budget and management control, redistributing appropriations for commitments on the one hand and the liquidation of basic credits. However, the proposed increases may not exceed a maximum amount of EUR 50,000 per basic allowance. When a same basic allowance subject to successive increases, the amounts are summed for the purposes of this provision.
This derogation also applies to the Ministry of defence, for which the jurisdiction conferred on the president of the Executive Committee is the Chief of the defence, and the Federal Police, for which that jurisdiction is assigned to the Commissioner-general.
This derogation shall not apply to basic allowances relating to the expenditure of the strategic bodies of Ministers and Secretaries of State.

§ 6. By way of derogation from article 52, paragraph 1, 1 °, of the law of 22 May 2003 on the organisation of the budget and the accounts of the federal State, the commitment appropriations of the basic benefit relating to expenditures for staff on the one hand and to the expenses of operation and investment on the other hand the strategic of Ministers and Secretaries of State bodies, may be redistributed only among themselves within a single program.
S. 1 01-4 provisions can be allocated to the lawyers, experts and bailiffs acting on behalf of the State.
S. 1 01-5 by way of derogation from article 48, paragraph 3 of the law of 22 May 2003 on the organisation of the budget and the accounts of the federal State of subsidies may be granted in accordance with article 43 of the Act of January 12, 1989 related to the Brussels Institutions, and the Fund for financing the international role and the function of capital of Brussels.
CHAPTER 2. -Special provisions of Section 02 departments.
-FPS Chancellery of Prime Minister s. 2.02.1 by derogation from art. 66 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, advances to a maximum of 250,000 euros can be granted to the accounting officer of the FPS Chancery of the Prime Minister.
Through these advances, the accounting officer may make the payment of claims of any nature, including the purchase of movable heritage assets, not exceeding 1,000 euros.

2.02.2 within basic allowances concerned, the following subsidies may be granted: 31/1 program. -1 EXTERNAL COMMUNICATION. Grant to the international press Centre "Résidence Palace";
2 subsidies any missions information and communication approved by the Council of Ministers 3. "VOCATIO" subsidy;
4. subsidy to the European movement - Belgium;
5 grant to the King Baudouin Foundation (Fonds Prince Philippe);
6 subsidy ASBL 'one night... ". A Grain";

8. subsidy to the German Marshall Fund.
PROGRAM 31/2... -BI-CULTURELLES INSTITUTIONS 1.
Subsidy to the Théâtre Royal de la Monnaie;
2 subsidy to the National Orchestra of Belgium;
3 subsidy at the Palace of fine arts.
PROGRAMME 32/3... -INTERVENTIONS social Union premiums.
S. 2.02.3 Prime Minister is allowed to pass, in the interests of Treasury Board and provided that the legislation on public procurement to be respected, of the swap agreements to promote the renewal of the ICT Shared Services equipment.
S. 2.02.4 within the limits of the appropriations entered in the 21/1 program "Network ICT", can also be set - apart from the recurrent operating costs and investments - expenditure of any nature relating to services provided, as well as the installation and maintenance of software and hardware of different services-users connected to the network of ICT.
S. 2.02.5. the Directorate-General External Communication is authorized to make expenditures for information and communication missions in favour of the federal public services and programmatoires. To this end, the Directorate-General External Communication receives, via IPC, prior to the payment of these expenses, advances on the part of SPF and SPP concerned.
S. 2.02.6 by derogation from article 1-01-3, § 2 and 3 of this Act, it may be a new breakdown of commitment appropriations of the basic allowance 31.11.1211.27 by means of a redistribution - "Costs various external communication concerning", within the program 31/1 - "External Communication".
S. 2.02.7 Notwithstanding the s.18, § 1, 2 ° of the Act of 19 April 1963 establishing an institution

S. 2.02.8 pursuant to art. 18 of the Act of 22 April 1958 concerning the status of the national Orchestra of Belgium, the 2012 grant to the National Orchestra of Belgium (31.20.4140.22 AB) is paid for 75% in the first quarter.
The balance will be sent each time in 3 equal instalments for the months of October, November and December.
S. 2.02.9 in pursuance of art. 13, 3 ° of the Act of 7 May 1999 on the establishment of the Palais des Beaux-Arts in the form of a public limited company with a social purpose and amending the Act of 30 March 1995 on the networks of distribution of broadcasts and the pursuit of home in the bilingual region of Brussels-capital and by way of derogation from art. 32 of the management contract concluded between the Belgian State and the Société anonyme public law purpose social "Palais des Beaux-arts" of 11/18/2002, approved by the Royal Decree of 2/12/2002 (Official Gazette 12/21/2002) the subsidy 2012 to SA's public social aid centre for fine arts ' (31.20.4140.25 AB) is paid for 75% in the first quarter.
Section 03. -SPF Budget and control of the art management. 2.03.1 by way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and the accounts of the Federal State, advances to a maximum of EUR 500,000 may be granted to the compt ables FPS Budget and management control.
Through these advances, the accounting officer is authorized to pay claims of any nature, including the acquisition of assets heritage furniture whose amount does not exceed EUR 5,500.

(2) the costs for missions abroad and for postage for correspondence, as well as advances y related.
Accountant responsible for the payment of mission expenses abroad is authorized to grant advances to staff sent on missions abroad.
S. 2.03.2 the appropriation entered under agenda 41/1 may, with the agreement of the Minister for the Budget, be allocated according to needs, by royal order, between the appropriate programs of the budgets of the departments concerned.
By way of derogation from article 5, paragraph 2, of the Act of 16 March 1954 concerning the control of certain public interest organizations, distribution by royal decree of this appropriation may also increase the financial intervention of the State in favour of the public interest organizations.
Section 04. -FPS Personnel and Organisation article 2.04.1 by way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and the accounts of the Federal State, advances to a maximum of 250,000 EUR can be granted for the accounting of services and institutions whose expenditures are listed in this section.
By means of these advances, accountants are allowed to pay all costs of service exceeding not 5.500 EUR, as well as, whatever the amounts, consumption of water, gas and electricity charges, telephone, oil and fuel for cars as well as benefits and allowances of all kinds allocated budget.
May be paid to the means of these advances, regardless of amounts: 1) spending social nature;
(2) the costs for missions abroad and for postage for correspondence, as well as advances y related.
Accountants responsible for the payment of mission expenses abroad are allowed to make advances to employees sent on missions abroad.
S.
2.04.2 within basic allowances concerned, the following subsidies may be granted: program 21/0. -DIRECTION and management subsidy to VZW 'Social Service of the Ministry of public service' on the 04.21.01.1140.05 basic allowance.
PROGRAM 31/1. -PERSONNEL and ORGANISATION, subsidies to the promotion or the study of the public service in general, improving the culture of the staff, to the equal opportunities policy and diversity within the federal State may be granted to the basic allowance 04.31.10.3300.01 load.
PROGRAM 31/2. -TRAINING of officials 1 ° assessment of 10,450 euro at the international Institute of Administrative Sciences on the allocation of base 04.31.20.33.00.24;
2 ° assessment of 95,000 euros at the European Institute of public administration in Maastricht on 04.31.20.33.00.24 basic allowance;
3 ° intervention for training activities organized by representative trade unions on the basic allowance 04.31.20.33.00.23 according to the defined terms by stopped royal March 24, 2003 on the granting of a subsidy to representative trade unions referred to in article 7 of the Act of 19 December 1974 organizing the relations between public authorities and trade unions of the officials of these authorities.
S. 2.04.3 the appropriation entered in the 04.31.10.01.00.02 basic allowance may, after approval by the Minister for Budget, be allocated according to needs, by royal order, between the appropriate programs of the budgets of the departments concerned.
By way of derogation from article 5, paragraph 2, of the Act of 16 March 1954 concerning the control of certain public interest organizations, the distribution by royal decree of this appropriation can also increase the financial intervention of the State in favour of these public interest organizations.
S. 2.04.4 the cash on which account are charged salaries and various allowances for statutory final and trainee staff and contract staff of the Office of selection of Federal (SELOR), Administration of the State to separate Management Service, may submit a debit balance to a maximum of EUR 450,000. If this amount is exceeded, the Minister for Budget may decide a derogation, in agreement with the Minister of finance based on a substantiated file.
S. 2.04.5 the Minister of the public service is authorized, litigation, transactions and make payments to the Caisse des Dépôts et Consignations.
Section 05. -SPF Technology Information and Communication Arts.
2.05.1 by way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and the accounts of the Federal State, advances to a maximum of 250,000 EUR can be granted for the accounting of services and institutions whose expenditures are listed in this section.

2.05.2 by derogation from article 1-01-3, § 2 and § 3 of this Act, the commitment of basic allowances relating to the remuneration and allowances appropriations generally any "1100.03 - final and trainee staff 'and' 1100.04 - other staff", as well as the basic allowance "1211.20 - contracts for the provision of services by the Egov a.s.b.l." may be redistributed only among themselves within Agenda 21/0.

2.05.3 within the limits of basic allowances concerned, the following subsidies may be granted: program 21/0. -DIRECTION and management subsidy to VZW 'Social Service of the Ministry of public service' on the 05.21.01.11.40.05 program 31/1 basic allowance. -INFORMATION and COMMUNICATION technology - Allocation ASBL Egov on the allocation of basic 05.31.1.033.00.01.
-Allocation VZW issue ICT on the allocation of basic 05.31.10.33.00.02.
Grants within the framework of a collaboration between FEDICT and national and international organizations for projects recognized mainstream ICT for the citizen.
Section 12. -SPF Justice s. 2.12.1 by way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, advances to a maximum of EUR 2 500 000 can be granted for the following accounting;
Through these advances, receivables concerning operating costs and allowances of all kinds, can be paid for in the box below: 1. a debt with a lower value as determined by the King in relation to markets found by an invoice accepted, to:-the accountant of the Budget, management control and Logistics Management Service. Accountant, responsible for the payment of costs of missions abroad, is authorized to make the necessary advances to employees sent on missions abroad;
-the accounting of the central administration of the Directorate

General of prisons;
-the accountant's branch of the judiciary.
2. whatever the amount of the claim:-the social Services accounting for the payment of social allowances and relief, as well as allocations for cultural and sports circles created by the staff of the SPF Justice;
-the accountant of a penal institution for payment of urgent expenditures for food and maintenance of detainees and internal as well as all the hotel operating costs;
-the accounting officer of the national Centre for electronic surveillance to pay the integration income;
-the accountant of the State security for the payment of the confidential expenses.
S. 2.12.2 for payment of the statements of judicial experts and bailiffs as well as any other legal costs, including those relating to international judicial cooperation, independence-regardless of their amount, the Minister of Justice makes available to the registrars courses and fees of the courts provision.
S. 2.12.3 the recovery of advances in the form of loans to employees, may, where appropriate, be carried out in accordance with article 23, paragraph 4 of the Act of 12 April 1965 on the protection of the wages of the workers.
S. 2.12.4 within basic allowances concerned, the following subsidies may be granted: program 40/2 SERVICE guardianship minor aliens subsidies to organisms public and associations responsible for the guardianship of unaccompanied foreign minors.
PROGRAM 40/3. -STUDIES and DOCUMENTATION 1) subsidies to publications and scientific institutions.
(2) subsidy to the NPO "Commission litigation travel.
(3) subsidy Kinderrechten Coalitie Vlaanderen and the Coordination of NGOs for the rights of the child.
(4) subsidy to the NPO "conciliation Commission - construction".

40/4 PROGRAM.. -COLLABORATION international share of Belgium in the running costs of the International Organization Interpol in Lyon (O.I.P.C.) and the Schengen Information System in Strasbourg (S.I.S.).
Statement by Belgium in the running costs of international organizations.
PROGRAM 51/3. -CARE medical and PARAMEDICAL detainees subsidies to bodies of the therapeutic accompaniment of perpetrators of sexual assault.
PROGRAM 52/0. (-Houses of JUSTICE 1) subsidies to organizations allocated to the Organization of work of general interest and training Court of restorative mediation proceedings, in support of the right to visit and victims legal assistance.
(2) subsidies to local authorities for the financing of the framework of measures and alternative judicial sentences.
PROGRAM 56/0. -SUBSISTENCE subsidy for use by the judicial services of the libraries of the bars in some courthouse.
59/2 PROGRAM. -WORSHIP Islamic subsidy for the recognition of Islamic worship.
59/3 PROGRAM. -Buddhism grant asbl Belgian Buddhist Union for the recognition of Buddhism.
S. 2.12.5. the Minister of Justice is authorized to grant financial support to prisoners under electronic surveillance, which will be charged to the 52.13.34.31.01 AB.
S. 2.12.6 the recipes for order made under the cooperation agreement on the establishment of a National Commission for the rights of the child will be recorded on accounts 85.01.04.89 C and 87.09.74.07 - section "Order of cash Operations".
These recipes can be used to respectively cover expenditure on operation and staff of this Commission.
S. 2.12.7 the Treasury is authorized to make advances when transactions in the account 85.01.06.91 - in the section "Order of cash Operations" - Operations payment and reimbursement of costs arising from missions of Member of staff within the framework of the management of civilian crises in the European Union - create a debtor position of this account to a maximum of 250,000 euros.
S. 2.12.8 by way of derogation from article 61, 2nd paragraph of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, the Minister of Justice is authorized to enter into agreements with the institutions of the European Union to European projects, financed by Europe. These projects target improved operation and integration of justice at European level.
S.
2.12.9. by derogation from article 62 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State and by way of derogation to article 185 of the programme act of December 23, 2009, revenues for the benefit of the Fund of the Commission of games of chance (programme 12-62-5) are abandoned to a maximum of 200,000 euros and allocated to the Fund for the fight against over-indebtedness (program 32-49-2).
Section 13. -SPF interior art. 2.13.1 § 1. By way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, advances to a maximum amount of EUR 5,000 can be granted for the accounting of services and bodies including the expenditures are listed in this section. For expenditure on a mission abroad the maximum amounts to 25.000 EUR.
Through these advances, accountants are allowed to pay all the urgent expenditure not exceeding EUR 500 by expenditure (VAT included).
The advances granted to members of staff in missions abroad can also exceed the supra threshold of EUR 500.
§ 2. By way of derogation to the § 1, advances to a maximum of 25,000 EUR can be granted for: 1) expenditures executed by central accounting officer of DG civil security;
(2) all the program expenditures 55 for the costs of repatriation and removal of persons considered undesirable. The EUR 500 limit does not apply to these expenses.
§ 3. By way of derogation to the § 1 advances for a maximum amount of EUR 15 000 can be allocated for all expenditure carried out by accountants:-centres closed the Office for foreigners;
-DG civil security columns.
S. 2.13.2 within basic allowances concerned, the following subsidies may be granted: program 51/3. -Protocol 1 ° allowances towards perpetrators of acts of courage, victims of their dedication or the assigns of heroes who lost their lives in performing such acts or the obvious aftermath of such acts, as well as for compensation for funeral expenses.
2 ° subsidy to the syndicate of Initiative and Promotion of Brussels, as intervention in the costs of the festivities held every year in the Park of Brussels on the occasion of the national holiday.
PROGRAM 51/9. -POPULATION and election subsidies in the context of the development of applications for the electronic identity card.
PROGRAM 54/0. -PROGRAM to keep 1 ° grant to the fire service training Council.
2 ° intervention in information, documentation and civil security public relations costs.
54/2 PROGRAM. -CIVIL SECURITY OPERATIONS; EQUIPMENT and training for emergency preparedness, fire and '100' CENTRES SERVICES 1 ° subsidy to the Brussels-Capital Region, municipalities, and intercommunal companies for the purchase of special equipment for fire departments.
2 ° interventions for the benefit of the fire service in the costs of information of fire prevention campaigns, support of local initiatives.

56/1 PROGRAM. -POLICE ADMINISTRATIVE general training, PREVENTION and equipment 1 ° State Intervention in spending for initiatives to promote contacts of police services with the public.
2 ° of expenditure,

in the field of police and prevention of crime, among others for the realisation or acquisition of infrastructure, equipment, hardware and software to use common and for the financing of campaigns and studies costs.
3 ° subsidy to be granted to Belgian universities or other organizations involved in the study or the control of crime, public initiatives and private prevention of crime, including hooliganism, integrated initiatives of local crime and investigation concerning the presence of certain criminal phenomena.

56/5 PROGRAM. -CELL FOOTBALL subsidies to stimulate projects from the world of football for the safety of the games.
56/7 PROGRAM. -SUMMITS EUROPEANS A Brussels subsidies to local police areas and common security of the Organization of the European summits in Brussels.
PROGRAM 56/8. -Security complete local 1 ° subsidies to local authorities in the context of the subsidised action plans and measures peacekeepers.
2 ° grants to local security policies and prevention.
PROGRAM 59/0. -PROGRAM of subsistence subsidy granted to the Association of the Councils of State and courts administrative sections of the European Union'.

The legislation and regulations on government procurement shall apply with respect to contracts for the acquisition of goods and services to be subject to the conveyance.
PROGRAM 55/1. (- RELATIONS European 1) Contributions of the Belgium international organizations 2) subsidies in favour of European integration article 2.14.7 within the limits of basic 53.41.12.11.10 and 53.41.35.40.01, in the 53/4 programme 'Humanitarian aid', expenses of any kind can be made, subject to prior agreement of the Council of Ministers, as the actions and initiatives of the Belgium in preventive diplomacy.

S. 2.14.9 for the year 2012, the Belgian Fund for food security (basic allowance 54.17.35.60.50) has a commitment authority of 9,400,000 EUR.
Any commitment to take under this section is subject to the approval by the controller of the commitments.
S. 2.14.10 subsidies allocated to an indirect actor within the framework of a multiannual programme shall be justified on the date provided for in the by-laws or conventions y related. The unencumbered balance of such annual subsidy, attributed to load in a previous fiscal year, may be deducted from the subsidy allocated to support of this budget year to the same indirect actor.

2.14.11 in principle, subsidies for projects and programmes of international organizations must be justified in the manner laid down in the orders and arrangements y related. However, subsidies granted during fiscal years earlier, as well as the unused balances may be reoriented for justification in due form and with the concurrence of the Minister for Development Cooperation or for the allocation of basis 53.41.35.40.02 - Prevention of conflicts, consolidation of peace and human rights, the Foreign Affairs Minister. S. 2.14.12 in 2012, the State may enter into new multi-year commitments with partner countries for a total amount of EUR 250,000,000. S. 2.14.13 the claim of 10 044 464,40 USD (arrested on December 31, 2010 value) including the features Belgium on the Inter-American Bank of development (IDB) may be reassigned to the amount of USD 7 681 910 for the cost of the participation of Belgium in the ninth replenishment of the Inter-American Bank of development (IDB). S. 2.14.19 in 2012, the Minister for Foreign Affairs may sign promises of financial interventions in the context of interest rate subsidies referred to in the basic allowance 51.21.31.12.01 for a total amount of EUR 70,000,000. In addition, these promises outstanding may not exceed 210.000.000 EUR.
Any promise of action taken under this section, is subject to the controller of commitments that will verify the application of the procedures for administrative and budgetary control and compliance with the ceiling.
Before the tenth of each month, the controller of the commitments shall send the Court of Auditors, for information, a prepared statement in triplicate, accompanied by supporting documents, containing both the amount of the promises it made in the past month and the amount of the promises it made since the beginning of the year.
Section 16. -Ministry of defence Art 2.16.1. by way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and accounting of the State

Federal, advances may be granted for execution of contracts awarded by the Belgian Military Supply Office (BMSO) located in Washington.
Advances may also be granted to the accounting officer of the advances of the Ministry of defence as well as to the staff of the Ministry of defence.
These advances are transferred by the Minister of finance or his servant on the accounts of the beneficiaries.
In case of emergency or when the circumstances so require, these advances are paid by the accounting officer of the advances of the Ministry of defence, which receives funds from the Minister of finance or his servant.
The total amount of the advances referred to in the preceding paragraphs may not exceed EUR 27 million.
Art 2.16.2. by derogation from article 117 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State and by way of derogation from article 151 of the programme act of 2 August 2002, the Minister of defence is allowed, both in technical cooperation and emergency aid to third countries and in the mutual assistance provided for in article 3 of the North Atlantic Treaty, to proceed without charge to the provision of service and/or sell equipment and/or materials from the stocks of the Armed Forces in the countries to which assistance is granted.
Art 2.16.3 the Minister of defence is allowed to liquidate provisional advances on: has) the compensation to be paid by the State to the head of damage suffered by staff members or by third parties;
(b) expenditures for hospitalization in civilian institutions, long-term treatments and supplies of pharmaceutical products by civil dispensaries;
c) fees of foreign facilities.
Art 2.16.4 contracts to be awarded by the Ministry of defence in the United States of America or the Canada may be concluded according to the negotiated procedure.
The funds obtained through appropriation orders issued in the past can be used to pay for expenses arising from the above contracts.
Surplus funds are donated to the Treasury as soon as the accountant concerned has submitted to the Court accounts on behalf of management with the final statement of the contracts for which these funds have been allocated.
Obligations arising from purchase orders given to the Belgian Military Supply Office (BMSO) in Washington before the beginning of the budgetary year and which could be contracted before that date may be during the fiscal year within the balance of the amounts that were incurred by the head of these purchase orders.

Art 2.16.10 the Minister of defence is allowed to use revenue from the interest earned on advances deposited with the 'Federal Reserve Bank of New York"to a maximum of 100,000 euros, under contracts for the supply of aircraft, logistics support, ground and facilities related costs for all of the F-16 fleet.
Art 2.16.11 Office Central to social and cultural Action (OCASC) of the Ministry of defence is allowed to undertake such tasks as provided for in article 1 of the royal decree of 10 January 1978, amended by the royal decree of 7 December 1998, determining the mission and regulating the Organization and functioning of this organization, for the benefit of members of the staff of the Federal Police.
The members of staff of the defence that, in application of article 11 § 2 of the Act of April 10, 1973, establishing the Office Central to social and cultural Action of the Ministry of defence (OCASC) for the benefit of members of the military community, are put at the disposal of the OCASC, remain the responsibility of the defence budget.
Art 2.16.12 by way of derogation from article 61, 2nd paragraph of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, the Minister of defence is allowed to enhance the services provided to the Federal Police, with the exception of those relating to the staff made permanently available to the latter , and to compensate the benefits provided by the Federal Police, on basis of the additional costs incurred.
Apart from occasional benefits, financial coverage of the benefits which the volume is known initially subject to an availability of credit whose amount is determined by the estimate of benefits to achieve and the countdown from those actually worked previously.
Art 2.16.13. the Minister of defence is allowed in international armed forces integration, or to deal with emergency situations, to conclude with foreign countries of the conventions of reciprocal services.
The financial regulation of these operations may be carried out by way of compensation, either when the convention ceases its effects, either at the end of an agreed timeframe, either by the common will of the parties involved. Any balance will be a posting or the Budget of national defence or to the Budget of the ways and means for the benefit the budgetary Fund for benefits against payment.
The Minister of defence is finally authorised with regard to materials, materials, weapons and ammunition to the conventions of divestiture reciprocal exchange and loan with other departments, Belgian or foreign enterprises and third countries provided that is promoted in this way useful to the Armed Forces stocks renewal.
Art 2.16.14 the Minister of defence or the authorising officer by delegation by him is permitted to reproduce, in whole or in part, real estate or other assets to be returned following the reorganization, which belong to the Federal Republic of Germany or a Land and who were

at the disposal of the force or the civilian component for use, and to determine the financial impact of these refunds after negotiations with the State of residence.
The financial contribution net of these refunds, determined on the basis of article 52 of the Agreement supplementing the Convention among States Parties to the the North Atlantic Treaty on the status of their forces, with regard to foreign forces stationed in the Federal Republic of Germany and the Protocol of signature to the supplementary agreement, signed in Bonn on 3 August 1959 and approved by the Act of 6 May 1963 , will be a global count at the end of the restitution of all property real estate or other heritage concerned.
Partial payments can be made by the Federal Republic of Germany.

Any balance or partial payments will be / will be booked to either the budget of departments and public interest organizations concerned or for the benefit of the Fund for reinvestment of revenues from the alienation of immovable property forming part of the heritage entrusted to the management of the Minister of defence and allocated to the program for 16-50-3, after count with the above agencies be used to cover expenses resulting from infrastructure and/or sanitation to areas in Belgium or Germany, run by the Armed Forces or which are related to rendition operations.
Art 2.16.15 expenses very urgent to carry out operations abroad may be implemented under contracts that may be awarded by negotiated procedure. The basic principles of the legislation on public procurement will be applied to the above contracts unless local circumstances do not permit.
Art 2.16.16 the Minister of defence is authorized, with the approval of the Minister of the Budget and by royal order deliberate in Council of Ministers, within the limits of Section 16 - national defence credits, make transfers for the benefit of the programme 16-50-5, "Implementation", in order to meet the specific needs related to humanitarian operations and peace support.
These transfers will be communicated without delay to the House of representatives and the Court of Auditors.
Art 2.16.17 by way of derogation from article 61, 2nd paragraph, of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, the Minister of defence is authorized to enter into agreements with other public bodies in the context of the provision of reciprocal benefits. The financial regulation of these operations may be executed by way of compensation, either when the convention ceases its effects, either at the end of an agreed timeframe, either by the common will of the parties involved. Any balance will be either compensation in kind or a charging to the budget of the defence (General estimates), or to the Budget of the ways and means for the benefit of the budgetary Fund for benefits against payment.
Art 2.16.18 by way of derogation from article 61, 2nd paragraph, of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, the Minister of defence is allowed to acquire a simulator of mine through a joint financial participation of the Kingdom of Belgium and the Kingdom of the Netherlands.
By way of derogation from the provisions of article 19 of the law of 24 December 1993 relating to the procurement and certain contracts for works, supplies and services, the Minister of defence is authorized to conclude a single market, attributed in accordance with the provisions of the law of 24 December 1993 referred to above and to the joint acquisition of a simulator of mine with the Netherlands that mandated for this purpose.
Expenditure under this market operations are subject, prior to any legal commitment, the opinion of the Inspector of Finances in accordance with the provisions of the royal decree of 16 November 1994 on the administrative and budgetary control.
Art 2.16.19 by way of derogation from article 61, 2nd paragraph, of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, the Minister of defence is allowed to use revenue from 2002 from timber sales in the areas that are part of the heritage entrusted to its management collected and charged to the profit of the Fund reinvestment of revenues from the alienation of immovable property forming part of the heritage entrusted to the management of the Minister of defence and allocated to programme 16-50-3, in accordance with article 41 of the programme law of July 19, 2001.
Art 2.16.20 under a contract of sale on the F-16 aircraft to be concluded by the negotiated procedure, in pursuance of article 41 of the programme law of July 19, 2001, the Minister of defence is authorized, as an exception to article 117 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State : - to sell non-surplus equipment making part of the heritage entrusted to its management, - in the context of the delivery of logistics support and related services commitments for consideration towards the buyer, - to give the buyer a pre-financing payment.
Prior to any legal commitment in the context of the conclusion of a contract of sale, including any unilateral commitment, arising from the above-mentioned provisions, the notice of financial oversight and the agreement of the Minister for Budget are requested in accordance with the royal decree of 16 November 1994 on the administrative and budgetary control.
The expenditure and revenue in the sale of non-surplus equipment as well as the services described above are treated as transactions for order within the meaning of article 2.16.9 of this Act.
Art 2.16.21 by derogation from Art 52, 1, 1 ° of the law of 22 May 2003 on the organisation budget and accounting for the federal State and by way of derogation to article 1-01-05, paragraph 3 of this Act, the commitment appropriations of relative operating costs with economic codes 12 base allocations can be redistributed between them and only them within the defence budget.
Art 2.16.22 the commitment authority Fund 16.2 of reinvestment of receipts from disposal of equipment, materials or surplus munitions part of the heritage entrusted to the management of the Minister of defence is EUR 5 million.
Art 2.16.23 the commitment authority Fund 16.3 of reinvestment of revenues from the alienation of immovable property forming part of the heritage entrusted to the management of the Minister of defence is EUR 5 million.
Art 2.16.24 on a proposal from the head of the defence and with the agreement of the president of the Executive Committee of SPF Budget and control of management, the commitment of appropriations and appropriations for liquidation of the base of the defence budget allocations, can be redistributed between them. The amount of the increases may not exceed EUR 50 000 by basic allowance. When a same basic allowance subject to successive increases, the amounts are summed for the purposes of this particular provision.
This particular provision does not apply to the basic benefit relating to the expenditure of the policy organs of the Minister.
S. 2.16.25 recoverable advances granted to the Office for information and assistance to the military families (ICFTU) in 1969, 1993 and 1994, which amounts to 619.733,81 euros total are definitively acquired Central Office of Social Action and cultural for the benefit of members of the military community (OCASC).

-in the 'Social Service of the integrated police' ASBL: share taken from the budget as a contribution in the staff costs, general operating expenditures and intervention expenditure, including the share of these expenses required for the management of the catering services within the federal police;
-in the Police Studies Centres.
90/2 PROGRAM.
-FUNCTIONING integrated - in some institutions: contribution of the federal State in the costs for the organisation of tests of selection and professional education and training for the benefit of the members of the integrated police.
-to some organizations and NPO: contribution of the federal State in the financing of projects in order to stimulate the recruitment or promotion of people reflecting socio-cultural diversity encountered in the population;
-to various agencies and non-profit organization which promote

the integration of the local and federal police: intervention by the federal authority in the financing of their projects or their social activities.
S. 2.17.4 operations relating to the budgetary accounts bearing addresses 1787075074B 8 11118, 11128, 11208, 11318, 11328 and 11408, each time followed by code 0030000 (old account 87.07.50.74.B of the 'order of cash operations' section), can create a debtor position of these accounts. However, this debtor position may not exceed a total of 3.500.000 EUR.
S. 2.17.5 in derogation from the provisions of articles 60 and 61 of the Act of 22 May 2003 on the organisation of the budget and the accounts of the federal State, property placed at disposal of a liaison officer, and which are taken out of service, may be sold by him according to the negotiated procedure and according to the rules in force in each country.
It can be made the same way for equipment and goods in stock at the time where a representation of the federal police abroad is permanently lifted, unless the stocks concerned cannot be transferred, free of charge or subject to compensation by the receiving party, the services of the FPS Foreign Affairs, foreign trade and Cooperation development.
In cases where it is conducted a sale on place, the product will be paid to the Budget of ways and means.
Nevertheless, if the material can be returned to the supplier of new similar goods, compensation can be made by subtracting from the value of the property disposed of the amount billed for the purchase of new equipment.
S.
2.17.6 operations relating to the budgetary account with the address 1787075175B 8, followed by the code (to be completed with team Fedcom SPF) (old account 87.07.51.75.B of the 'order of cash operations' section), can create a debtor position of this account. This debtor position may not however exceed 1.200.000 EUR.
Art 2.17.7 by derogation from article 1-01-3 § 2 of this Act, the commitment appropriations referred to in paragraph above basic regarding staff costs, may also be redistributed to allocation of base 11.00.13 - compensation to public for insufficiently paid services transport companies - section 17 - Federal Police and integrated operation.
Art 2.17.8 for fiscal year 2012, the organic budget Fund 17-4 referred to in article 11 of the Act of 21 December 2007 establishing the various (I) provisions has a commitment authority of 833,000 EUR.
Any commitment to take under this section is subject to the approval by the controller of the commitments and the Court of Auditors.
Before the tenth of each month, the controller of the commitments passes to the Court of Auditors, with supporting documents, a prepared statement in triplicate stating, on the one hand, the amount of commitments referred in the past month, and secondly, the amount of the commitments covered since the beginning of the year.
By way of derogation from article 62, § 2 paragraph 4, of the law of 22 May 2003 on the organisation of the budget and the accounts of the federal State, during fiscal year 2012, on this same organic budget Fund, is allowed a debit position in liquidation which may not exceed EUR 1.884.000.
Art 2.17.9 for administrative simplification in the follow-up of the implementation of the budget of the federal police, but also of the General Inspectorate of the federal police and local police (AIG) and the Secretariat of the integrated police (SSGPI) as well as in the management and payment of consumable materials and other small supplies, the federal police is authorized to carry out or have make corrections of writing between its appropriations budget accounting where are initially charged above mentioned operating expenses and the corresponding appropriations registered on the substantive divisions 55 or 60.
Art 2.17.10 the appropriation entered under the 90/1 program (AB 11.01.00.01) - Provisional appropriation intended to encourage recruitment policy in the areas of police facing a severe shortage of personnel may on the proposal of the Minister of the Interior be allocated according to needs, by royal order, between the programs, activities and budget items appropriate budgets of the federal police or the SPF inside.
When the distribution, all or part of this amount may be registered in the form of a grant.
Art 2.17.11 administrative simplification in the follow-up of the implementation of the budget of the federal police as well as in the management and payment of certain remuneration of members of the operational staff involved in funds or sea escorts, actions performed as part of the road safety action plans, implementation within areas of seconded staff or the body of intervention or funded projects by the Union European and under the budgetary fund 17/4 'Fund external borders and return', the federal police is authorized to carry out or make adjustments to write accounting budgetary appropriations which are originally charged staff mentioned above and the variable appropriations related to the budget destination which the revenue generated by these escorts are paid actions or implemented.
Section 18. -Finance art. 2.18.1 § 1. By way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, cash advances can be granted for accounting of the Budget and Management Service management control, for a maximum amount of EUR 500,000;
These accountants are allowed to pay by cash advances, all service charges not exceeding 5,500 EUR (excluding VAT).

§ 2. The accountant of the responsible Budget and management control, framing of the account 'miscellaneous revenue' Service, is authorized to make expenditures exclusively in the framework and within the financial limits programs which have been prefinanced on this account by the European Union or other international bodies.
Prior to their implementation of payment, invoices and statements of claim relating to these programmes should be coated with the visa of the authorising of the Service Management Budget and management control.
§ 3. By way of derogation from article 25 and by application of article 25 bis and article 229 of the royal decree of December 10, 1868, with General regulations on the accounting of the State, restaurants in the Social Service accountants are allowed to hold cash up to 400 EUR for each restaurant or cafeteria for which they are accountable.
S.
2.18.2 Finance Minister may provide loans and assistance Department serving officers, former officers, retired or not, the beneficiaries of financial officers and members of their family. It can grant subsidies to associations of officers of the Department and existing meeting centres and create the SPF finance staff. Voluntary and discretionary subsidies may also be granted to national and international organizations.
Within the limits of relevant basic allowances, grants and following contributions may be granted: program 40/0. -Management bodies - living 1. Subsidies to asbl Inter Nos. 2. Program 80/0. -Taxes and recovery - living 1. Contributions by Belgium to the financing of programmes of the OECD on taxation and public finance 2. Annual contribution of Belgium to the IOTA (Intra-European Organisation of Tax Administrations) 3. Contributions by Belgium to the world Organization of customs 4. Grants and contributions to national and international organizations for joint initiatives in the tax field 5. Share of the Belgium in the operating costs of bodies art. 2.18.3 § 1. "By way of derogation from article 1-01-3, § 2 of this Act, appropriations of the basic allowance"80.61.11.00.03 - final and trainee staff"may be redistributed to the basic allowance' 80.61.11.00.09 - staff of the Administration of customs and Excise made available in other jurisdictions of the SPF finance and other SPF and public services."
§ 2.
By derogation from article 1-01-3, § 3 of this Act, credits of basic allowances referred to in this paragraph relating to the operating expenses of the section 18 - SPF Finances can also be redistributed to the basic allowance "40.03.34.41.40 - payments to third parties".
S.
2.18.4 the Minister of finance may make advances for urgent payments resulting from obligations of Belgium through its participation in financial institutions international and which are addressed to the Treasury departments responsible for international relations.
S.
2.18.5 by way of derogation from article 62 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, the organic Fund "Fund for the payment of advances on maintenance claims" is allowed to submit commitment and winding up a position

debtor, which may not exceed the amount of EUR 70.170.000.
S. 2.18.6 by way of derogation from articles 60 and 61 of the Act of 22 May 2003 on the organisation of the budget and accounts of the federal State, the Minister of finance is authorized to use the revenues from the securitization transaction tax back, up maximum 1.5 per cent of the target, in order to cover expenditure arising from the implementation of this operation.
S. 2.18.7 in cases where very short payment deadlines are not the application of the proper budgetary procedure, the Treasury is authorized to pay by advances by prior agreement the Minister of finance and the Minister or the Secretary of State, who has the budget in its attributions, the costs of execution of guarantees by the federal State under article 36/24 of the law of 22 February 1998 establishing the Organic Statute of the Bank National of Belgium and its orders of execution, including: 1 ° the royal decree of 16 October 2008 made pursuant to article 117A of the Act of 2 August 2002 on the supervision of the financial sector and financial services;
2 ° the royal decree of 14 November 2008 implementing the law of 15 October 2008 on measures promoting financial stability and in particular establishing a State guarantee for the credits granted and other operations carried out in the context of financial stability, in what concerns the protection of deposits and life insurance , and amending the law of 2 August 2002 on the supervision of the financial sector and financial services;
3 ° the royal decree of 10 December 2008 on the guarantee of certain risks borne by financial institutions;
(4) the royal decree of 16 March 2009 on the protection of deposits and insurance on the life by the special protection fund for deposits and life insurance;
5 ° the royal decree of 14 April 2009 granting a State guarantee to certain operations relating to the rescue of Fortis;
6 ° the royal decree of 14 April 2009 granting a State guarantee to certain borrowings of the communal Holding;
7 ° the royal decree of 10 August 2009 cover of losses on certain financial instruments by KBC.
The budgetary appropriations needed for the regularization of these expenditure commitment and liquidation will be requested by taking, as soon as possible, a deliberation of the Council of Ministers in accordance with the provisions of article 70 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State.
Section 19. -Direction of buildings art.
2.19.1 the budget of the Board of the buildings for the 2012 fiscal year, annexed to this Act, is hereby approved.
This budget is for revenue to 1.067.754.583 EUR, which 789.289.000 EUR allocations on the part of the federal State, and for expenditure EUR 1.068.628.167, including EUR 882.584 carried over from the fiscal year 2011. In spending, it features (differentiated appropriations) for an amount of EUR 302.271.304 in commitment appropriations.
Revenues and expenditures for order are valued at 16.105.000 EUR.
S. 2.19.2 the Minister who has the buildings Agency in charge is permitted to contract, apart from the amount of the commitment appropriations limiting investment programmes, included in articles 533.01, 533.03 533.04, 533.11, 533.12, 533.13, 533.14, 533.16, 536.02, 536.11 and 536.13 of the budget of the buildings agency joined the Act, obligations of hire purchase and similar operations (including investments by third parties through private funding or contracts of) long term rental for provision of real estate to the use of the public authorities).

S. 2.19.4 buildings authority is authorized to make expenditures for first installation work in the buildings leased it to the use of services it must provide housing Act of 1 April 1971 on the establishment of a health authority's buildings.
If it comes to installation work that can be considered as finishing or standard equipment, these costs are borne by the budget of the Board of the buildings.
If, on the other hand, it comes to installation work that come from current or future occupant needs and which cannot be regarded as standard equipment and finishings, the costs are borne by the occupant. In this case, buildings authority receives, prior to the payment of expenses, provisional advances on the part of occupiers services. It is not possible for the direction of the buildings to a any pre-financing of these expenditures.
S. 2.19.5 buildings authority is authorized to make expenditures, regardless of nature, necessary for the management of certain buildings where simultaneously lodged several utilities but which are regarded as entities for their effective management (e.g., administrative Centres, the palaces of the Cinquantenaire in Brussels, some large rented complexes).
The buildings authority is authorized to put the amount of these expenses borne by the occupants of the buildings in question, either by the recovery of payments made, or by the use of an account to order. In these two cases, the Régie receives, prior to the payment of expenses, provisional advances on the part of these occupants.

2.19.6 buildings authority is authorized to support certain expenses relating to fixed occupation charges personal secretariats and strategic bodies of Ministers and Secretaries of State housed in rented buildings or buildings of the State and who do not cohabit with their administration. The amount of these expenses is limited to 49 579 EUR per Minister and 24 789 EUR by Secretary of State for the buildings of the State and of 99 157 EUR by Minister and 49 579 EUR by Secretary of State for buildings leased. Directives for the distribution and the use of this credit are secured together by the Minister for the Budget and the Minister who has the buildings authority in charge.
Should be considered as occupation, among others: the maintenance of central heating and air conditioning costs, fees for window cleaning, maintenance of facilities and telephone exchanges, elevators and other lifting, of electrical installations and facilities security, charges related to the common parts, maintenance of lawns, parks and gardens management fees, regional taxes and installation of safety devices.
S. 2.19.7 buildings authority is authorized to use competition actually operated recipes, the proceeds from the sale of real estate and other real estate transactions. The proceeds of these operations will go to the Fund established under article 335 of the programme act of 22 December 1989.
The availabilities of the Fund not used at the end of a fiscal year are carried forward to the following fiscal year where they merge with the latter-specific recipes.
S. 2.19.8 Notwithstanding sections 19 and 20 of the Act of 1 April 1971 on the establishment of a Board of buildings, the buildings authority is authorized to incur expenses for the execution of ordinary and extraordinary maintenance works, studies and other miscellaneous works in certain well-defined buildings that are not state-owned, when these expenses are explicitly paid by the Régie of buildings by contracts agreements, or other agreements.
S.
2.19.9 by derogation from article 2 of the law of 1 April 1971 on the establishment of a Board of buildings, the buildings Agency is authorized to support repair (including studies) in the building of the "Academia Belgica" in Rome.
S. 2.19.10 buildings authority is authorized to make expenditures for securing the Royal estates of Laeken, Belvédère, Stuyvenberg and Châteauneuf.
S. 2.19.11 by way of derogation from article 2 of the law of 1 April 1971 on the establishment of a Board of buildings, the buildings authority is authorized to support the costs associated with the housing of the Federal Agency for the safety of the food chain.
S. 2.19.12 by way of derogation from article 2 of the law of 1 April 1971 on the establishment of a health authority's buildings, the buildings authority is authorized to contribute to the implementation of a technical review and the development of an annual report on the general status and compliance with legislation and regulations (French) into force, building renovated «Maison de Belgian and Luxembourgish students» in Paris (Fondation Biermans-Lapôtre).

The costs associated with these activities will be the responsibility of the federal public service programming science policy.
S. 2.19.13 the buildings authority is authorized to pay contractors the work of construction and renovation (including studies) of block A of the "Residence Palace" complex in Brussels for the needs of the Council of the European Union, through funds made available by the Treasury.
In the 2012 fiscal year, these expenses will be limited to EUR 18 307 500 in commitment and to EUR 107 210 300 in liquidation.
Reimbursement of the totality of the investment of the project will be paid directly by the Council of the European Union to the Treasury.
S.
2.19.14 the buildings Agency is authorized to make expenditures for various investment and studies work in buildings that are not owned by the State but which are used for the accommodation of the services of the State, public services managed by the State or for certain categories of staff remunerated by the State, provided that these expenditures are explicitly put the responsibility of the Board of buildings by the provisions of a lease or a decision of the Council of Ministers and that they are not the responsibility of the occupants of the buildings concerned.
S. 2.19.15 by derogation from article 2 of the law of 1 April 1971 on the establishment of a Board of buildings, the buildings authority is authorized to support investment and maintenance work in reception centres open, for the purposes of the Federal Agency of reception of asylum seekers.
S.

Section 33. -FPS mobility and transport art.
2.33.1 by way of derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and accounting of the State federal, cash advances may be granted for the accounting of Federal Public Service mobility and transport, which are validated by the authorising officer, leader of the Service, or by his delegate officer and are assigned by the competent Minister in order to cover the payment of the following expenses.
The accountant has to do this to a specific financial account, opened in his name and on which the custodian transfers the amount of the advance

from the account of the financial expenditures of the Federal mobility and transport Public Service. This transfer is a purely financial transaction.
The maximum amount for which an advance of funds for small expenses may be granted is € 5,000-worth.
An advance of supplementary fund for small expenses may be requested where the balance of payment on the financial account of the accountant is of EUR 2 500 or less.
The amount of a small expenditure may not exceed 500 EUR VAT included.
The accountant can put at the disposal of the officials of the means of payment for small expenses, either in cash, or via an electronic wallet, or a debit card.
The maximum amount for which an advance of funds for expenses on a mission abroad may be granted is 25.000 EUR.
An advance of additional funds for these expenses may be requested where the balance of payment on the financial account of the accountant is EUR 10,000 or less.
The accountant can put at the disposal of the staff on mission abroad by means of payments for expenses, or cash up to an amount of EUR 500, either via a debit card, or transfer.
The employee for which means of payment have been made available by the accounting officer, must justify its expenses through supporting documents in order to provide evidence of expenditure included in the account for the accountant. He must pay the balance, without delay, of the advance received funds and expenditures justified the accountant of competent cash advances.
The accountant counts carried out by means of advances on the appropriate commitments and winding-up credit.
If a cash advance or a part of it is no longer necessary for the continuity of the service, the accountant reverse the balance without delay on account of the financial revenue of the master record keeper.
The competent Minister shall monthly inform the Court of Auditors about the advances that he attributed.
The authorising officer, leader of the Federal Public Service mobility and transport officer or his delegate, is responsible for the regular monitoring of applications and the grant of advances of funds by accountants.
Accountants and their alternates are appointed by the Minister or his delegate. The designation order describes the specific tasks of accountants, indicates the number of the financial account on which the accounting officer will receive his cash advance, and fixes the date from which the accounting officer carries its management, in accordance with the rules laid down by the competent Minister. A copy of this order is forwarded to the Minister of Budget and finance.
S. 2.33.2. by derogation from article 62 of the law of 22 May 2003 on the organisation of the budget and the accounts of the federal State, the funds mentioned below may be in 2012 a debit balance of:-the Fund for the Organization of exceptional transport: 250 000 EUR - the Fund for the operation of railway transport dispatch: 522 000 EUR - the Fund for the operation of the rail safety authority : 2 150 000 EUR - the Fund for the operation of the rail accident investigation agency: 275 000 EUR.

S. 2.44.4 too collected amounts paid to the CPAs in previous years under the Act of 2 April 1965 concerning support for relief by the public Centres for social assistance, the Act of 7 August 1974 establishing the right to a minimum of livelihoods and the Act of 26 May 2002 concerning the right to social integration can be considered for fiscal year 2012 as the year advances in course.
S. 2.44.5 is approved the budget of the Federal Agency of reception of applicants for asylum for the year 2012, annexed to this Act.
This budget is for revenue to EUR 351 209 514 and expenditures to 371 699 798 EUR.
S. 2.44.6 the balance available from previous years under the Act of 7 August 1974 establishing the right to a minimum of means of livelihood and of the Act of 26 May 2002 concerning the right to social integration, can be used to cover expenses in the current fiscal year.
The balance available from previous years in the context of the Act of 2 April 1965 the relief provided by the public social assistance centres, support can be used to cover expenses in the current fiscal year.

2.44.7 by derogation from article 66 of the law of 22 May 2003 on the organisation of the budget and accounts of the federal State, advances may be granted to the competent accountant organic Fund 'Belgian European social fund' expenditure needs. None of these advances is subject to a maximum amount, except with regard to the 1994-1999 programming, for which they cannot exceed the available credit.
S. 2.44.8 § 1.
Commitment authorizations are granted for the following organic Fund of the sums indicated:-federal European social fund (56/2) programming 2007 - 2013: 9.522.000 EUR;
