29 MARCH 2012. - Miscellaneous Provisions Act (II) (1)



ALBERT II, King of the Belgians,
To all, present and to come, Hi.
The Chambers adopted and We sanction the following:
PART 1er. - General provision
Article 1er. This Act regulates a matter referred to in Article 77 of the Constitution.
PART 2. - Public health
UNIC CHAPTER. - Amendments to the Compulsory Health Care and Compensation Insurance Act, coordinated on 14 July 1994
Art. 2. Section 144 of the Compulsory Health Care Insurance Act and Coordinated Indemnities on July 14, 1994, reinstated by the Act of December 21, 2006, the following amendments are made:
1° in § 2, paragraph 1er, the word "know" is replaced by the words "have full jurisdiction to know":
2° it is inserted a paragraph 4, which reads as follows:
Ҥ4. Title IV of Part IV of the Judicial Code does not apply to Trial Chambers and Boards of Appeal. "
Art. 3. In section 145, § 5, of the same Act, restored by the Act of December 21, 2006, the words "or the employee designated by him" are inserted between the words "the officer of the Medical Evaluation and Control Service" and the words "may seize".
Art. 4. In section 156 of the Act, reinstated by the Act of 13 December 2006 and amended by the Acts of 27 December 2006 and 19 December 2008, the following amendments are made:
1° in § 1erParagraph 1er, the second sentence is replaced by the following sentence:
"Payment deadlines can be granted only on the basis of a reasoned and supported request by any useful document to assess its validity. »;
2° in § 1erParagraph 2 is replaced by the following:
"The sums produce interest in full right at the rate of legal interest in social matters, as provided for in Article 2, § 3, of the law of May 5, 1865 relating to the loan of interest, from the first working day following the notification of the decision, the stamp of the position being declared. »;
3° in § 2, paragraph 1er, the second sentence is replaced by the following:
"The deadline takes place on the first business day following the one where the recommended fold, with acknowledgement of receipt, was presented to the addressee's home or, where applicable, to his or her residence or domicile elected. »;
4° in § 3, the words "the notification of" are inserted between the word "In" and the words "the decision of the officer";
5° in § 3, the second sentence is replaced by the following:
"The deadline takes place on the first business day following the one where the recommended fold, with acknowledgement of receipt, was presented to the addressee's home or, where applicable, to his or her residence or domicile elected. "
Art. 5. In section 157 of the Act, reinstated by the Act of 13 December 2006 and amended by the Act of 19 December 2008, the following amendments are made:
1° in 1er, the words "or the employee designated by him" are inserted between the words "The Officer-in-Chief" and the words "the Trial Chamber";
2° in § 3, the word "final" is inserted between the words "Decisions" and the words "of the officer";
3° § 4 is supplemented by the following sentence:
"The fines and amounts to be refunded shall be the privilege referred to in section 19, paragraph 1er, 4°, of the mortgage law of 16 December 1851. "
Promulgation of this law, let us order that it be clothed with the seal of the State and published by the Belgian Monitor.
