CDNI - Amendment to Appendix 1re for Germany
The Conference of the Contracting Parties,
given the proposal from Germany concerning an amendment to Annex 1er Convention;
Recalling that it is up to the Contracting States to jointly determine the network of inland waterways to which the Convention is applicable,
Considering that this amendment of the geographic scope of the Convention in Germany does not question the objective of the Convention;
having regard to articles 14 and 19 of the Convention on the Collection, Deposit and Receipt of Wastes in Rhine and Inland Navigation;
decides that waterways referred to in Article 2 and listed in Appendix 1re are as follows for Germany:
"Germany: All inland waterways intended for general traffic, with the exception of the German sector of Lake Constance and the Rhine sector upstream of Rheinfelden. »
This resolution will enter into force on 1er July 2012.

Application Regulations - Part B
Exceptions for unloading certificate according to Article 6.03 for certain categories of boats and transport
The Conference of the Contracting Parties,
Considering
- that a simplification of the Regulation of Application, Part B, is desirable for certain types of transport in order to reduce the administrative constraints to which the parties concerned are subjected,
- that simplification does not jeopardize the objectives of the Convention,
in light of articles 14 and 19 of the Convention on the Collection, Deposit and Receipt of Wastes in Rhine and Inland Navigation,
adopts the amendments to section 6.03 of the Implementing Regulations, Part B, in Appendix.
This resolution will enter into force on 1er January 2013.

Annex Resolution CDNI 2012-I-2
Schedule 2, Application Regulations, Part B, is amended to read:
1. The following new paragraphs 7 and 8 are added after paragraph 6:
« 7. Paragraphs 1er and 4 do not apply to vessels which, by their type and construction, are suitable and used for:
(a) the transport of containers,
(b) the transport of mobile cargoes (rouliers), parcels, heavy parcels and large aircraft,
(c) the delivery of fuels, drinking water and on-board feeds to sea vessels and inland navigation vessels (vessels),
(d) collection of oily and greasy waste from sea vessels and inland navigation vessels,
(e) the transport of liquefied gases (ADN, Type G),
(f) the transport of liquid crude sulphur (at 180 ° C), cement, flying ash and comparable substances that are transported in bulk or can be pumped, where a system suitable exclusively for the cargo category concerned is used for loading, unloading and storage on board,
(g) the transport of sand, gravel or dredging products from the extraction site to the unloading site as long as the vessel concerned is built and fitted only for such transport,
provided that the vessel concerned transports exclusively the above-mentioned goods and cargoes and that the latter constituted its last cargo.
This provision does not apply to the carriage of mixed cargo on board such vessels.
The competent authority may exempt on a case-by-case basis a building from the application of paragraphs 1er and 4 as part of the execution of specific transport, so prevalent comparable conditions. The evidence of this exemption must be on board the building.
8. Articles 1er and 4 are also not applicable to transport when it comes to unloading in a sea ship. The driver is obliged to be able to justify such unloading on the basis of the relevant transport documents that he must submit to the supervisory authorities upon request. »

Interpretation of the Convention - Boats
The Conference of the Contracting Parties,
Considering
that the Convention on the Collection, Deposit and Receipt of Wastes in Rhine and Inland Navigation (CDNI, September 1996) establishes common rules for the prevention of waste production and for the collection, storage and receipt of wastes in inland navigation,
that the application to pleasure craft is not provided under these common rules,
based on Article 14 of the Convention and on the provisions of the Vienna Convention on the Law of Treaties
notes that the Parties to this Convention interpret the definition "building" in Article 1er of the Convention as excluding pleasure craft.
